Book excerpt: Today Europe finds itself in a crisis that casts a dark shadow over an entire generation. The seriousness of the crisis stems from one core political contradiction at the heart of the European project: namely, that what urgently needs to be done is also extremely unpopular and therefore virtually impossible to do democratically. What must be done - and almost everyone agrees in principle on the measures that would be needed to deal with the financial crisis - cannot be sold to the voting public of the core member states, which so far have been less affected by the crisis than those on the periphery, nor can the conditions that core members try to impose be easily sold to voters in the deficit countries. The European Union is therefore becoming increasingly disunited, with deepening divides between the German-dominated ‘core’ and the southern ‘periphery’, between the winners and the losers of the common currency, between the advocates of greater integration and the anti-Europeans, between the technocrats and the populists. Europe finds itself trapped by the deepening divisions that are opening up across the Continent, obstructing its ability to deal with a crisis that has already caused massive social suffering in the countries of the European periphery and is threatening to derail the very project of the European Union. In this short book, Claus Offe brings into sharp focus the central political problem that lies at the heart of the EU and shackles its ability to deal with the most serious crisis of its short history.

Book excerpt: Gerard Delanty offers a critical interpretation of the European heritage today in light of recent developments in the human and social sciences, and in view of a mood of crisis in Europe that compels us to re-think the European past. One of the main insights informing this book is that a transnational and global perspective on European history can reorient the European heritage in a direction that offers a more viable way for contemporary Europe to articulate an intercultural identity in keeping with the emerging shape of Europe, and with its own often acknowledged past. He argues that the European heritage is based less on a universalistic conception of culture than on a plurality of interconnecting narratives. Such a perspective opens up new directions for scholarship and public debate on heritage that are guided by critical cosmopolitan considerations that highlight contention, resistances, competition, and dissonance. He argues that the specificity of the European dimension of culture is in the entanglement of many cultures rather than in an original culture. The cultures of Europe are not separated but have been shaped in close interaction with each other and with the non-European world. Nations are not therefore unique, exceptional, or fundamentally different from each other. The outcome of such intermingling is a multiplicity of ideas of Europe that serve as shared cultural reference points.

A sociology of European integration is thus outlined along four main themes or narratives: first, the elite processes of identity construction and the framework of norms and ideas that carries such a construction (together with notions of European identity, EU citizenship, etc.); second, the socialization of European citizens, processes of banal Europeanism, and social transnationalism through everyday cross-border exchanges; third, the mobilization of resistance and Euroskepticism as a fundamental and collectively mobilized opposition to processes of Europeanization; and fourth, the political sociology of crisis, linked not only to financial turmoil but also, more fundamentally, to a legitimation crisis that affects Europe and the democratic nation-state.

In no other political community is both the prospect of enlargement and the ever-present possibility of withdrawal part of the constitutional framework. We find few other instances where some territories in a political community adopt a common currency while others do not. Examples of thick association agreements, such as we find between the EU and third countries like Switzerland and Norway, are uncommon. Over the last number of years, EU boundaries have been challenged like never before. Brexit poses a fundamental threat to the EU’s territorial integrity and the rights of EU citizens to cross what have been regarded as open borders; the refugee crisis and the increase of terrorism both call into question the EU’s ability to justly and effectively manage its external borders; the rise of populism is a direct challenge to internal free movement as the demand to reassert national borders becomes formidable; while the aftermath of the euro-crisis continues to put Monetary Union in doubt. By distinguishing between three categories of boundary change – boundary-making, boundary-crossing and boundary-unbundling – the authors in this volume attempt to shed light on the sustainability and legitimacy of Europe’s boundaries in question. This monograph considers the codification project in light of a series of broader analytical frameworks – comparative, historical and constitutional – which make modern codification phenomena intelligible. This new reading across fields renders the European codification project (currently being promoted through the Common Frame of Reference and the Optional Sales Law Code proposal) vulnerable to constitutionally-grounded criticism, traceable to normative considerations of private law authority and legitimacy. Arguing that modern codification phenomena are more complex than positivist, socio-legal and historical approaches have suggested over the past two centuries, the book stages a pathbreaking method of analysis of the law-discourse (nomos-centred) which questions at once the reduction of private law to legislation and of law to power and, on this basis, redefines the ways in which to counter law's disintegration and crisis in the context of Europeanisation. Professor Niglia reconstructs the European codification project as a complex structure of government-in-the-making that embodies a set of contingent world views, excludes alternatives, challenges the plurality of private laws and entrenches conflicts that pertain not only to form (codification, de-codification, recodification) but also to dilemmas implicated in determining the substantive orientation of European private law. The book investigates the position of the codifiers and their discontents in the shadow of the codification strategy pursued by the European Commission – noting a new turn in the struggle over the configuration of private law which has taken place since the Savigny-Thibaut dispute of 1814 which this book critically revisits exactly two centuries later.
