Book excerpt: Parmi les mutations les plus significatives de la médecine en cette fin de siècle, l'importance prise par les dimensions sociales, collectives et culturelles de celle-ci jouent un rôle tout particulier. Vient s'inscrire dans cette perspective générale l'institutionnalisation de la bioéthique, telle qu'elle s'est mise en place en France à partir de 1983 et dont témoignent décrets et loi rapportés dans ce volume. L'activité du CCNE en 1998 porte particulièrement la marque des rapports complexes tissés et/ou demandant à l'être entre activité biomédicale et société. Trois des Avis ou Rapports rendus y portent en effet moins sur des questions spécifiquement biologiques ou médicales que sur le contexte social au sein duquel elles se posent et sur les conséquences que telle pratique peut y avoir. II en va ainsi des dimensions éthiques des choix collectifs, du progrès technique et de ses répercussions sur la santé et le modèle de société (n° 57), des questions posées par le vieillissement de la population (n° 59) et du consentement éclairé et de l'information des personnes qui se prêtent à des actes de soin ou de recherche (n° 58). Dans ces trois cas, le Comité n'exprime pas de positions simples et spectaculaires : il présente les multiples aspects de situations complexes, les analyse et évoque les voies qui devraient être évitées ou suivies pour les améliorer. Le Comité s'exprime encore sur le réexamen des lois dites de bioéthique. II évoque aussi la création de collections de tissus et de cellules embryonnaires (Avis n° 52 et 53), relançant la question de la " nature " de l'embryon humain, du respect qu'on lui doit et de l'utilisation que l'on peut ou non en faire, question loin d'être close.

La réflexion du CCNE sur Fin de vie, arrêt de vie, euthanasie (n° 63) comme ses Réflexions autour de la réanimation néonatale (n° 66) forment avec son rapport précédent sur Le vieillissement (n° 58) une trilogie dans laquelle est abordée avec franchise la réalité de l'homme en notre société, en cette fin du XXe siècle. Dans une ambiance surmédiatisée d'offre de consommation, mais aussi dans l'exigence sécuritaire qui se nomme principe de précaution ou risque zéro, peut-on trouver le temps d'une réflexion sereine sur la réalité de la vie humaine, sa dignité, comme sa fragilité et sa brièveté entre ses limites que marquent la naissance et la mort ? Mais, en matière de bioéthique, l'information et le nécessaire débat public s'accommodent mal du sensationnel. Un éclairant débat " Éthique et médias " est engagé sur ce thème entre quelques-uns des plus prestigieux journalistes de la presse écrite et audiovisuelle. Puissent leurs remarques pleines de sagesse nous prémunir de commentaires trop hâtifs sur les nombreuses et difficiles interrogations éthiques que ne manquera pas de susciter la prochaine révision des lois de bioéthique de 1994 dont monsieur le Premier ministre avait choisi de révéler le projet en ouvrant, le 28 novembre, ces journées annuelles 2000 du Comité consultatif national d'éthique.
