Cowen Hill, elaborate and comprehensive beyond any work of the kind, have given to these volumes the highest value and widest reception. The new form in which the present edition appears, demands from the editor a few words of explanation. The notes are printed in the same volume with, and (as far as practicable) immediately under the text to which they refer - a change in the mode of printing that will doubtless preve convenient, and greatly facilitate the labor bf comparing one part of the work with another. The notes, which contain frequent references from one to another, are numbered from the beginning of the first to the end of the third volume, and are printed without alteration; those added to the previous edition by Mr. Van Cott, retain the designation of stars by which they were distinguished from the others, and the citation of new authorities and statutes in this, are inclosed in parentheses. Keeping this in mind, the reader will readily place the responsibility of the successive annotations where it belongs. By a careful study of the notes, it will be seen that as a general rule, the division of either of them into separate parts cannot be made without breaking that fine chain of reasoning and discussion that runs through nearly all of them, making each a complete essay in itself. In a few cases the note embracing two subjects and appearing to be fairly divisible, has been divided, so as to bring each part under the appropriate head of the text; and here and there, where the author in his late revision has adopted into the text only part of such a note, the part so appropriated has not been reprinted in its original form. In frequent instances the original note, citing and commenting upon English authorities, has been wholly absorbed and embodied in the text, enriching that at the expense of the annotators; in these instances, of course, the note has not been reprinted, as such. Occasionally, the note, in its nature indivisible, has been only partly incorporated into the text, and has therefore, as a rule, been retained in full as written. In brief, the entire work has been reproduced with the design of preserving the notes intact, as far as practicable. I have therefore been content to elaborate a little more fully one or two points which were the pivots of my argument, sending the rest of the lecture to press in almost the same form as it was delivered. It is hoped, however, that the treatise may find some small justification beyond this compulsion. Undoubtedly the subject with which it deals is in the air. The events of the war between Russia and Japan and the approach of the meeting of the second Hague Conference, which it is hoped will form a code of the laws of war on sea, have combined to arouse public interest in the development of the International Law of War and Neutrality. Public opinion has greater influence in deter mining changes in this branch of jurisprudence than in any other, because these changes depend finally on the common consent of nations, which is but the expression of the united opinion of the people; and this in turn must be guided by the expositions of jurists. The aim of this book is to formulate, from a study of the chief authorities, the general principles which underlie modern usages, to point out where particular practices are obsolete and violate those principles, and to suggest the lines upon which reform may proceed. It may seem by its title to clash with an elaborate treatise which has recently been written on War and Commerce by Mr. Atherley-j ones, but its scope is at once narrower and wider. It avoids as far as possible lengthy historical disquisitions, and it does not seek to trace a path through the wilderness of single instances. It is more concerned with present usages and tendencies, and it covers the effects of war in all its relations to private property, as well of enemies as of neutrals, and both on land and on sea. It is clearly differentiated also in scope from the standard treatises on International Law, for it deals exclusively with that part of the law which affects private persons, and aims rather at interesting the student than satisfying the lawyer. In 1896, when he was 21, he wrote in a letter to a friend that he had begun a great work quot on the means of Expression in Music quot If ever I finish the thing, into print it shall go. Thirty years later, he was talking about a series of four text-books on music. But into print neither the one scheme nor the other went the final expression of his ideas on music was never written. It never could be written, because it was never final in the mind of that incessant discoverer in music. Nor was his method of writing that of finality. The nearest point to finality which Tovey ever reached in his expression of a formal philosophy in music is tobe found in the articles on technique and aesthetics of music as he called them himself in the list of his writings supplied to Who s Who which he contributed to the Encyclopaedia Britannica. Those articles, written from 1906 onwards for the eleventh edition of the Ency clopaedia, and revised again, almost rewritten, for the fourteenth edition in 1929, were necessarily cast in the imposed form of treatises under word-headings. Yet they coalesce very firmly into a clear and coherent testament, almost into a text-book of the art of music in its widest meaning. Like the Glossary to the Essays in Musical Analysis, the entries are unconnected, the whole comprehensive, and while not attempting completeness, afford the reader a wider range of musical thought and a fuller discussion of technical problems than most of the exhaustive and laborious theses now available. Tovey himself set great store by these articles. They formed for him the basis of his teaching at the University of Edinburgh. They are the background to those fuller considerations of musical compositions which are his Essays in Musical Analysis. It was his own proposal that these articles should be gathered together into one volume, an idea expressed to me as long ago as 1926. Means were then taken towards the end of publishing, and it was agreed that Tovey should in his own time make any alterations or correc tions necessary for the new method of presentation. But many other fresh and no doubt more important ideas and schemes came bubbling up into that wonderfully fertile brain, and nothing was done about the book of musical articles. I say more important because, though he was in life so fully occupied, it has now been foundpossible to publish these articles after the author s death. This book contains all the articles which Tovey wrote for the VI EDITORIAL PREFACE Encyclopaedia Britannica, as they now appear there, with the exception of one on Modern Music and the biographies.
