Using comparative analysis and theory testing methodology, this research will explore the history of United States' posture and thoughts regarding space and nuclear deterrence with an alternative framework for space deterrence: a tiered, tailored framework. A more tailored approach, based upon strategic cultural and behavioral analysis behind force postures of offensive space superiority and damage limitation capability enable a more flexible and survivable posture for Tier 1 space deterrence in the second nuclear age.

Various national initiatives are envisaged resulting in a “space race” in the field of constructing spaceports and building micro launchers. However, right from the beginning when choosing the launch site (land or sea based-rocket launches) there are various factors relating to international space law, European regulations and national rules that must be considered, as spaceports are rarely explicitly addressed in current legal and policy frameworks. While launching sites used to be operated by governments, private commercial initiatives are increasingly entering the field. This paradigm shift must be reflected within regulations relating to various aspects of space liability by enlarging the long-established terms of the United Nations space treaties to accommodate commercial space flights. Questions of permission, supervision and control require special liability regulations to avoid detrimental consequences stemming from the concept of “launching states” in view of the rise of private driven commercial space activities on a global level. Furthermore, not only do environmental aspects need to be thoroughly examined but also the concept of critical infrastructure requires special attention from a security perspective to anticipate, inter alia, cyber-attacks. For these reasons, several European and national regulations may need to be enlarged to apply to the entire space sector, using a harmonized approach that has direct implications for the regulations, programmes, and missions of the European Union and the European Space Agency, bearing in mind that the upcoming spaceports in Europe are an essential asset to substantially boost the European New Space.

Book excerpt: "Some scholars argue that the world has entered the 'Second Nuclear Age' in which nuclear proliferation has invalidated traditional deterrence assumptions. Air Force leaders believe this new 'multipolar, proliferated world requires new ideas, concepts, and analyses.' To address this concern, this paper explores the possibility of limited nuclear wars and how the United States may respond to them. In doing so, it reopens the debate between Thomas Schelling and Herman Kahn regarding the nature of deterrence and reconsiders one of Strategic Air Command's boldest strategic weapons system proposals. The paper combines modern nuclear scholarship with recently declassified Air Force documents from the 1960s to argue that the Second Nuclear Age will require a more Kahn-like 'escalation dominance' deterrence posture rather than the Schelling-inspired 'balance of terror' deterrence that guided Cold War postures. Further, the old nuclear Triad may no longer be sufficient. The paper concludes that space-based nuclear deterrence may be the only method to establish true dominance and that Project Orion, an audacious plan championed by SAC General Thomas Power to develop advanced spaceships propelled by nuclear explosives, may be a vital strategic capability to ensure the United States can reliably deter adversaries in the Second Nuclear Age"--Abstract.

This analysis from the CSIS Aerospace Security Project addresses different methods and technologies that can be used by the United States government, and others, to deter adversaries from attack. A wide range of active and passive defenses are available to protect space systems and the ground infrastructure they depend upon from different types of threats. This report captures a range of active and passive defenses that are theoretically possible and discusses the advantages and limitations of each. A group of technical space and national security experts supported the analysis by working through several plausible scenarios that explore a range of defenses that may be needed, concepts for employing different types of defenses, and how defensive actions in space may be perceived by others. These scenarios and the findings that resulted from subsequent conversations with experts are reported in the penultimate chapter of the report. Finally, the CSIS Aerospace Security Project team offers conclusions drawn from the analysis, actionable recommendations for policymakers, and additional research topics to be explored in future work.
