Book excerpt: Signed into law in 2000, the Trafficking Victims Protection Act (TVPA) defined the crime of human trafficking and brought attention to an issue previously unknown to most Americans. But while human trafficking is widely considered a serious and despicable crime, there has been far less consensus as to how to approach the problem—owing in part to a pervasive emphasis on forced prostitution that overshadows repugnant practices in other labor sectors affecting vulnerable populations. Responding to Human Trafficking examines the ways in which cultural perceptions of sexual exploitation and victimhood inform the drafting, interpretation, and implementation of U.S. antitrafficking law, as well as the law's effects on trafficking victims. Drawing from interviews with social workers and case managers, attorneys, investigators, and government administrators as well as trafficked persons, Alicia W. Peters explores how cultural and symbolic frameworks regarding sex, gender, and victimization were incorporated into the drafting of the TVPA and have been replicated through the interpretation and implementation of the law. Tracing the path of the TVPA over the course of nearly a decade, Responding to Human Trafficking reveals the profound gaps in understanding that pervade implementation as service providers and criminal justice authorities strive to collaborate and perform their duties. It presents a compelling, empirically based argument that although there is currently a panoply of measures aimed at preventing human trafficking, prosecuting offenders and protecting trafficked victims in both Europe and the Commonwealth Caribbean, these measures have in practice been fraught with a number of challenges, whether of a normative, institutional or individual nature. The continued existence of these challenges strongly suggests that there exists a 'disconnect' between anti-trafficking law and practice which is not peculiar to small-island developing States since they also extend to developed States, including the United Kingdom. Although these challenges are not insurmountable, this monograph advances the argument that sustained social, economic, political and legal commitments are both necessary and desirable, and that without such commitments, only pyrrhic victories would be won in the fight to eradicate the scourge of the twenty-first century. Since they were signed into law in 2000, U.S. federal laws and policies on human trafficking have been understood as concrete expressions of the civic values of personal and political freedom. Yet these policies have also been characterized by a marked preoccupation with regulation, and especially sexual regulation. Yvonne C. Zimmerman offers a groundbreaking exploration of the relationship between freedom and sexual regulation in American anti-human trafficking law and policies. . She argues that the religious values of American Protestantism have indelibly shaped the federal government's approach to engaging human trafficking, and that the trajectory of the U.S.'s anti-trafficking efforts cannot be fully grasped without understanding the unique ways in which sex, morality, and freedom are connected in Protestant Christian configurations of morality. Zimmerman shows that particularly under the George W. Bush administration, the U.S.'s anti-trafficking project expressed a vision of freedom whose structure and logic is thoroughly Protestant. . Her analysis challenges the assumption that combating human trafficking necessarily entails sexual regulation, and reveals the extent to which the preoccupation with sexual regulation has functioned to discourage alternative understandings and practices of freedom, particularly for women.
