Regions where coal was readily available, such as the Ruhr Valley in Germany and western Pennsylvania in the United States, witnessed exponential growth-yet also suffered the greatest damage from coal pollution. These conditions prompted civic activism in the form of "anti-smoke" campaigns to attack the unsightly physical manifestations of coal burning. This early period witnessed significant cooperation between industrialists, government, and citizens to combat the smoke problem. It was not until the 1960s, when attention shifted from dust and grime to hazardous invisible gases, that cooperation dissipated, and protests took an antagonistic turn.The Age of Smoke presents an original, comparative history of environmental policy and protest in the United States and Germany. The codification project takes up a transnational legal trend that has already led to the passing of similar legislation in a number of countries such as the Netherlands, Switzerland and the United Kingdom or the preparation of corresponding drafts, as in France, Sweden, Poland and Hungary. The European Union is also looking into the codification of environmental law. The Commission's draft applies the principle of sustainable environmentally sound development and establishes an integrated cross-media approach in all areas of environmental legislation. One of its principal features is the unified project authorisation model (Vorhabengenehmigung) for environmental legislation, which the Federal Government intends to use as a basis for the planned implementation of the IPPC Directive in a first volume of an Environmental Code. Other aims pursued by the Commission were to strengthen the responsibility of enterprises and of society, develop incentive instruments and expand transboundary environmental protection. The draft was prepared between autumn 1992 and summer 1997. The Commission consisted of eight experts with practical experience in the field of environmental law as judges, university teaching staff, lawyers, administrative officials and an environmental officer in a large industrial company. This volume contains the English translation of the draft. It seeks to make a contribution to international and European discussions about the harmonisation and codification of environmental law. For this reason the introduction to the English version also contains observations about the German legal system and existing environmental legislation which should make it easier for the reader to understand the proposals.

Since the late 1960s capacity-building in environmental policy and management can be observed across the world. It may have made insufficient progress as yet from an environmentalist point of view, but it has produced some remarkable results, and not only in the industrialised world. In the first chapter we present the conceptual framework that underlies the national case studies. In the course ofour research project the authors ofthe book met together twice to discuss this framework in the light of the national experi ences and to harmonise their approaches. In this way we have tried to offer more than a collection of individual and incoherent case studies, focusing only on specific environmental problems, institutions, actors, or instruments. The idea behind this book is to give a systematic, comparative overview ofthe fundamental conditions under which environmental policies is practised in selected countries.

Japan, Germany, and the United States exemplify the deep divisions that exist among states in their approaches to environmental protection. Germany is following what could be called the green social welfare state approach to environmental protection, which is increasingly guided by what is known as the precautionary principle. In contrast, the US is increasingly leaning away from the use of environmental regulations, towards the use of market-based mechanisms to control pollution and cost-benefit analysis to determine when environmental protection should take precedence over economic activities. Internal political divisions mean that Japan sits uneasily between these two approaches. Miranda A. Schreurs uses a variety of case studies to explore why these different policy approaches emerged and what their implications are, examining the differing ideas, actors, and institutions in each state.

The author recounts the fascinating and sometimes dramatic story of these organizations from their origins at the end of the nineteenth century to the present, not only describing how they reacted to powerful social movements, including the homeland protection and socialist movements in the early years of the twentieth century, the Nazi movement, and the anti-nuclear and new social movements of the 1970s and 1980s, but also examining strategies for survival in periods like the current one, when environmental concerns are not at the top of the national agenda. Previous analyses of environmental organizations have almost invariably viewed them as parts of larger social structures, that is, as components of social movements, as interest groups within a political system, or as contributors to civil society. This book, by contrast, starts from the premise that through the use of theories developed specifically to analyze the behavior of organizations and NGOs we can gain additional insight into why environmental organizations behave as they do.
