Book Professional Liability of Architects and Engineers

Download or read book Professional Liability of Architects and Engineers written by Harrison Streeter and published by Wiley-Interscience. This book was released on 1988 with total page 273 pages. Assuming no knowledge of law, this book explains, in simple language, the fundamental concepts involved. The bases for liability are described, together with how to minimize claims. The process by which arguments over claims are resolved is also covered. 32 case studies illustrate how malpractice claims actually arise and how the courts rule on them. The material on expert witnesses should be of particular value to any architect or engineer faced with the prospect of appearing in a courtroom as a witness.

Book Failures and the Law

Download or read book Failures and the Law written by H.P. Rossmanith and published by Routledge. This book was released on 2003-09-02 with total page 584 pages. Available in PDF, EPUB and Kindle. Book excerpt: The interaction between engineering and the law is undergoing dramatic changes. Product liability, laws have been introduced in Japan, patent claims over living organisms have been made in bioengineering and the differing national laws of copyright protection and liability are in the process of harmonisation, especially in the European Union. The pace and complexity of these changes make it essential for technologists, lawyers, engineers and insurance experts to establish a common basis for understanding, co-operation and exchange of expertise. The recently founded International Society for Technology, Law and Insurance aims to foster such co-operation. This volume features 46 selected contributions which address various topical issues and the law. The most important issues relate to engineering risks, quality assurance and assessment and legal implications assiciated with them. Recent failure cases are explained and the technical, legal and insurance-related issues discussed in detail.

Book Practice Management for Design Professionals

Download or read book Practice Management for Design Professionals written by John Philip Bachner and published by John Wiley & Sons. This book was released on 1991-09-03 with total page 406 pages. Available in PDF, EPUB and Kindle. Book excerpt: In the mid-1960s geotechnical engineers paid the highest liability insurance of any profession and by 1969 were virtually uninsurable. As a result, the ASFE was founded and helped these engineers not only lower their insurance rates, but get to the point where, by 1980, they were the least liability-prone members of the design profession. Now, John Bachner and the ASFE tell all other design professionals how to accomplish the same task. This book, which incorporates the ASFE's Introduction to Professional Practice program for advancing architects' and engineers' knowledge of professional practice issues, addresses almost every aspect of the design professionals' practice as they relate to liability, from procedures for verifying the accuracy of technical output to steps for improving client and project selection, workscope development, personnel training and dispute resolution.

Book Using and Understanding Engineering Service and Construction Contracts

Download or read book Using and Understanding Engineering Service and Construction Contracts written by John R. Clark and published by Springer Science & Business Media. This book was released on 2012-12-06 with total page 314 pages. Available in PDF, EPUB and Kindle. Book excerpt: 1. HISTORICAL BACKGROUND In the late 1950s many members of the design professions-Engineers as well as Ar chitects-became concerned about their exposure to claims for professional malprac tice and particularly about the increasing number of claims that had been successfully brought against them arising out of their Construction Phase activities. This led to special studies sponsored by the American Institute of Architects and the Engineers joint Counsel. The outcome was twofold: the development of a policy of professional liability insurance to insure Engineers and Architects against errors and omissions in the performance of their professional services, and the review and development of the customary contractual arrangements defining the design profeSSional's undertakings vis a vis his client (the Owner), the Project to be designed, and the Contractor who was to implement that design. At the outset, the AlA's Owner-Architect Agreement (No. B131), General Conditions (No. A201) and the Owner-Contractor Agreements (Nos. A101 & 111) were the documents most frequently used by design professionals, and these received particular attention. In the early 1960s it became apparent that there was a need for a separate series of documents prepared to address these relationships when the Project to be designed involved primarily engineering considerations. The number of Projects for which the Engineer was employed by the Owner as the prime professional to handle the Project design and construction administration was increasing.

Book Civil Engineering Insurance and Bonding

Download or read book Civil Engineering Insurance and Bonding written by Leslie Edwards and published by Thomas Telford Publishing. This book was released on 1996 with total page 158 pages. Available in PDF, EPUB and Kindle. Book excerpt: This guide is written for engineers to explain some of the basic principles and practices of civil engineering insurance. It concentrates on four main areas, namely the insurance of contract works during construction, public liability, employer's liability and professional indemnity insurance. Adequate insurance can be crucial to the successful completion of a contract and an engineer can be required to administer contract insurance clauses or give advice on them. This guide explains in practical terms: what the clauses are; why they appear; how liability and risk can arise; and what various policies cover. This new edition of Civil engineering insurance and bonding is a substantial revision of the original 1987 publication and now covers the insurance clauses of the ICE Conditions of Contract: 6th edition, the ICE Design and Construct Conditions of Contract, the ICE Conditions of Contract for minor works: 2nd edition, and the NEC 2nd edition
