Syrett challenges this assumption in his sweeping and sometimes shocking history of youthful marriage in America. Focusing on young women and girls--the most common underage spouses--Syrett tracks the marital history of American minors from the colonial period to the present, chronicling the debates and moral panics related to these unions. Although the frequency of child marriages has declined since the early twentieth century, Syrett reveals that the practice was historically far more widespread in the United States than is commonly thought. It also continues to this day: current estimates indicate that 9 percent of living American women were married before turning eighteen. By examining the legal and social forces that have worked to curtail early marriage in America--including the efforts of women's rights activists, advocates for children's rights, and social workers--Syrett sheds new light on the American public's perceptions of young people marrying and the ways that individuals and communities challenged the complex legalities and cultural norms brought to the fore when underage citizens, by choice or coercion, became husband and wife.

To shed light on why this grim statistic still holds true, Women, Business and the Law aims to examine legal differentiations on the basis of gender in 143 of the world's economies. Women, Business and the Law tracks governments' actions to expand economic opportunities for women across six key areas: accessing institutions, using property, getting a job, providing incentives to work, building credit and going to court. The report uncovers legal differentiations for women and married versus unmarried women such as being able to register a business, open a bank account and work at night. These issues are of fundamental importance. When, because of tradition, social taboos or simple prejudice, half of the world's population is prevented from making its contribution to the life of a nation, the economy will suffer. It increases Malawi's high levels of poverty, illiteracy, and maternal mortality. It widens marked gender gaps in education. Many Malawian families see marriage as a way to improve their economic status, sometimes through payment of a dowry, or through continued support by their daughter's husband. Child marriage is also deeply entrenched in Malawi's traditions and patriarchal culture. "I've never experienced happiness," based on in-depth interviews with 80 girls and women in six districts in Malawi, examines how child marriage negatively shapes the experiences, status, and security of Malawian girls and women, and limits their development. It shows how the practice violates their rights to health and education, freedom from physical, mental, and sexual violence, and their right to marry only when they can give their free and full consent. Human Rights Watch recommends the Malawian government adopt a comprehensive approach to child marriage. This should include legal reforms and programmatic initiatives that effectively address the causes and consequences of child marriage, as well as protection for girls and women who seek redress through the justice system.
