Book excerpt: Despite providing society with a set of crucial services, large groups of workers in the informal economy are subject to exclusion and discrimination, and their lives are characterised by various types of vulnerabilities and deprivations that result from the denial of social, economic, political and legal protection. Although not new to the development vocabulary, the informal economy has received renewed attention in recent years largely due to the ILO's 'decent work' agenda and various efforts to promote 'legal empowerment of the poor'. With an explicit focus on labour rights, the book focuses on a nuanced understanding of the regulatory and operational challenges and dilemmas related to implementing the two approaches in selected countries in sub-Saharan Africa. In addition to analyzing structures and relations of power between the formal and the informal economies, the book critically discusses the work of governments, civil society organizations and the poor themselves to address the daily challenges of living in the informal economy.

The informal sector in Dar-es-Salaam faces a number of problems which would require specific measures to improve productivity, increase capacity utilisation, stabilise existing employment as well as promote new employment. The paper emphasises the need for policy reform that could abolish registration requirements on new entrants and exempt enterprises of less than four years of age from all forms of taxes. Four areas of assistance through the development of projects are also recommended: financial assistance, management training, marketing of products, technical training and introduction of improved technology.

Book excerpt: This thesis is concerned with the content, context and consequences of conceptions and representations of the 'informal economy'. The central argument is that the 'informal economy' presents a political and social, normative and essentially contested concept that has real (discursive, material, social) effects on current transformations of the world of work and of social order. 'Informal economy', as concept and imaginary, is central to formalization and informalization which are here primarily understood as discursive and political processes. The discussion engages with the perennial dispute in academia and policy-making over whether the 'informal economy' presents a relic of underdevelopment, a paragon of ingenious economic activity, the last resort for survival amidst capitalist accumulation processes or a community-based alternative to capitalist economic organization. At their fundament, these competing perspectives are divided over the appropriate role of the state in governing the economy. Political discourses along these lines, in turn, impact on the configuration of state governance and societal organization. The analysis builds on insights from interviews and participant observation from six months of research work in 2014-2016 in Dar es Salaam, Tanzania, and on a review of the research literature. It presents a multidisciplinary effort, bringing together development studies, political economy and labour law to discuss the use(s) of the concept in the two dissimilar sectors of street trade and domestic work. Drawing on the discursive analytical strategies of Reinhart Koselleck and the Cultural Political Economy perspective as well as the framework of intersectionality, the study illustrates how, in Tanzania, 'informal' work is legally, socially and discursively constituted in dissimilar ways in small-scale trade and domestic work. Rather than a clearly definable or fixed category, informality of work is relative and relational; it intersects with post-colonial trajectories, class, gender, race and ethnicity, age, family status, income and education levels, as well as workers' visibility in public and private workplaces.

Yet policy responses are dismissive and evictions commonplace. Despite being progressively marginalised from public space, street traders in the global south are engaged in spatial and political battlegrounds to reclaim space, and claim de facto property rights over their place of work, through quiet infiltration, union power, or direct action. This book explores 'rebel streets', the challenges faced by informal economy actors and how organised groups are seeking to reframe legal understandings to create new claims to space and urban rights. The book sets out new thinking and a conceptual framework for improved understanding of the plural relationship between law, rights, and space for the informal economy, the contest between traditional, modernist and rights-based approaches to development, and impacts on the urban working poor. With a focus on street trading, the book seeks to reframe the legal context in which modern informal economies operate, drawing on key areas of academic inquiry and case studies of how vendors are staking claim to urban rights. The book argues for a reconceptualisation of legal instruments to provide a rights-based framework for urban work that recognises the legitimacy of urban informal economies, the scope for collective management of urban resources, and the social value of public space as a site for urban livelihoods.
