It explores remedies in the wider context of compliance with, and enforcement of, employment law through criminal law and other regulatory techniques. The book argues that some of the remedies set out in statute or at common law for working people are a poor 'fit' for the employment rights they are supposed to protect. Employment rights are often undervalued in the legal system, because remedies for their infringement are subject to limitations not applicable to rights in other settings. This limits their ability both to uphold the dignity of working people and to deter breaches. Moreover, the remedies on offer do not always suggest a sensible ranking of employment rights in which fundamental rights attract stronger remedies than other kinds of rights and interests. The book suggests why some of these problems might have arisen and makes proposals for reform. It also considers the wider implications for a system of employment law that depends so heavily for its enforcement on working people litigating to enforce their rights. Book excerpt: Joint Industrial Councils: Inception, Adoption, and Utilization, 1917-1939 is a study of how a WWI proposal for permanent improvement in labor-management relations came about, why the target industries ignored it, and how it found a purpose in the second-tier industries for which it was not originally intended. The press, social reformers, academics, and various business interests touted JICs as the beginning of worker control of industry, while skilled trade unions saw them as a plot to harm workers' interests. Their eventual modest use was directed to needs within individual industrial enterprises and not to more global missions, such as the remaking of British industry in general. But successful JICs undertook serious issues that management and unions needed to address, such as wage rates, retirement plans for workers, and safety-related concerns. Moreover, the level of labor-management understanding in JIC industries improved to the point that these industries suffered no strikes in the inter-war period; the conditions of employment for the workers improved; and productivity increased.

Book excerpt: This Royal Commission report on protection of the marine environment focuses on the impact of marine fishing in the seas around the UK, both on fish populations and the wider ecosystem. It consider a range of issues including the role of the fishing industry and its growth over the last 50 years; the legal framework for the marine environment and fisheries, at the national, European and international levels; the impact of fishing and the legacy of overfishing; aquaculture fisheries; marine protected areas; improved fisheries management; and a system of marine spatial planning. The report concludes that, as a society, we give much lower priority to protecting our seas compared with the land, and over-fishing is a global problem which has led to the collapse of fisheries in many areas. This situation requires significant urgent change which recognises the need for sustainable fisheries management and avoids the degradation of our seas, placing it within the context of wider management of human activities in the marine environment. Recommendations made include: the introduction of a Marine Act to establish a statutory framework with strategic objectives for marine environmental protection; a move away from a presumption in favour of fishing rights to a precautionary approach which requires demonstration that fishing activity is environmentally sustainable; establishing a network of marine protected areas within the UK over the next five years, which would lead to 30 per cent of the UK's exclusive economic zone being closed to commercial fishing; and a change in the emphasis of research away from management of fish populations towards a wider focus on the marine environment.
