Book excerpt: "The United States Code is the official codification of the general and permanent laws of the United States of America. The Code was first published in 1926, and a new edition of the code has been published every six years since 1934. The 2012 edition of the Code incorporates laws enacted through the One Hundred Twelfth Congress, Second Session, the last of which was signed by the President on January 15, 2013. It does not include laws of the One Hundred Thirteenth Congress, First Session, enacted between January 2, 2013, the date it convened, and January 15, 2013. By statutory authority this edition may be cited "U.S.C. 2012 ed." As adopted in 1926, the Code established prima facie the general and permanent laws of the United States. The underlying statutes reprinted in the Code remained in effect and controlled over the Code in case of any discrepancy. In 1947, Congress began enacting individual titles of the Code into positive law. When a title is enacted into positive law, the underlying statutes are repealed and the title then becomes legal evidence of the law. Currently, 26 of the 51 titles in the Code have been so enacted. These are identified in the table of titles near the beginning of each volume. The Law Revision Counsel of the House of Representatives continues to prepare legislation pursuant to 2 U.S.C. 285b to enact the remainder of the Code, on a title-by-title basis, into positive law. The 2012 edition of the Code was prepared and published under the supervision of Ralph V. Seep, Law Revision Counsel. Grateful acknowledgment is made of the contributions by all who helped in this work, particularly the staffs of the Office of the Law Revision Counsel and the Government Printing Office"--Preface.

Book Employee Representation in Multinational Companies

Download or read book Employee Representation in Multinational Companies written by Thomas Haipeter and published by Springer. This book was released on 2018-09-26 with total page 301 pages. Available in PDF, EPUB and Kindle. Book excerpt: Investigating the issue of employee representation in multinational companies (MNCs), this book sets out to systematically conceptualise the modes of articulation between different action fields. While previous studies have focused on forms of employee representation that have emerged throughout recent decades, rather little is known about the interaction and coordination of representational bodies and actors, such as trade unions and European or World Works Councils. Given the growing importance of transnational restructuring in MNCs, understanding the conditions under which employees are able to participate in company decision-making is a crucial issue. Based on empirical case studies and interviews with employee representatives from ten countries across Europe, the authors investigate the role of representational bodies in periods of company restructuring. Proposing a shift in perspectives in research on transnational labour relations and bringing new insights into structures and practices of employee representation in MNCs, this book will be a valuable read for both scholars and practitioners.

Download or read book Employee Representation in Non Union Firms written by Paul Gollan and published by SAGE. This book was released on 2006-12-28 with total page 233 pages. Available in PDF, EPUB and Kindle. Book excerpt: `Provides a wide-ranging and though-provoking analysis of non-union forms of employee-representation. While it will unquestionably be of interest to scholars and students specializing in the burgeoning field of non-union employee relations, there is much useful material that could inform union reponses to membership decline′ - British Journal of Industrial Relations `Paul Gollan′s book is an important contribution to our understanding of the significance of non-union employee representation in Britain and its implications for the future of employment relations. It is highly recommended′ - Russell Lansbury, Professor of Work & Organisational Studies, University of Sydney ′Can employees have effective voice without independent collective organisation? In the UK, unlike most of continental Europe, government and employers typically answer yes. Gollan′s detailed study provides sound reasons for scepticism′ - Richard Hyman, Department of Industrial Relations, LSE ′We know very little about the non-union sector in Britain despite the fact that it now embraces the clear majority of the workforce. The publication of Paul Gollan′s Employee Representation in Non-Union Firms therefore represents a very important addition to the field. Based on extensive and detailed in-depth study of some leading non-union employers, it throws new light on the ways in which employee interests are represented in such firms′ - Prof John Kelly, Birkbeck College ′Are non-union systems of representation (NER) an acceptable alternative to union-based systems or do they infact complement more traditional forms of union representation?′ - Bruce Kaufman, Georgia State University Robinson College of Business This book is the first of its kind to answer this challenging question. It offers a comprehensive overview of NER in the UK and locates UK practice within an international context. Readers are invited to consider the potential implications and limitations of NER arrangements, and to examine how unions respond to these NER arrangements through bargaining, consultation and representation processes. Throughout issues are addressed on both a macro and micro level. The book reviews the literature and examines current practice using survey data and original case analysis. Engaging readers who are studying industrial relations, human resource management, employee involvement and consultation, unions and management strategy, it will also be appeal to practioners working in these areas. Book Systems of Employee Representation at the Enterprise

Download or read book Systems of Employee Representation at the Enterprise written by Roger Blanpain and published by Kluwer Law International B.V.. This book was released on 2012-08-01 with total page 385 pages. Available in PDF, EPUB and Kindle. Book excerpt: Amid the trend towards decentralized industrial relations, various new and modified systems of employee representation are taking hold in many countries worldwide. In this highly informative examination of this field of international labour law – originally presented as a series of papers for the 11th JILPT Comparative Labor Law Seminar held in Tokyo in February 2012 – twelve distinguished scholars from Australia, China, France, Germany, Japan, Korea, Sweden, Taiwan, the United Kingdom, and the United States describe their countries’ current perspectives on this issue, along with their own analysis and commentary. Among the specific questions addressed for each jurisdiction are the following: What is the legal framework for an employee representation system? How is the representative body formed and what are its declared powers? Are there legal mechanisms preventing intervention by the employer? Are non-standard employees involved? What methods of deliberation and decision-making are used? How are the activities of representatives protected? Who bears the costs? What is the relationship with collective bargaining? With labour unions? Each contributor also describes typical ways in which the employee representative system works, offering concrete examples such as dismissal, wage determination, and equal treatment. Some deal with situations in which employee representation is in fact nonexistent or malfunctioning in real workplaces. There is also pervasive attention paid to the fundamental matter of what ‘representation’ is for, and the probable future direction of employee representation. Given the need to secure representation for non-union and non-standard employees at the workplace, these reports on the conditions and new developments in this important field provide ample basis on which to build a better system of employee representation in this era of diversified workforces in the globalized market. Accordingly, this book will prove of inestimable value to practitioners and policymakers in labour and employment law anywhere in the world.

Book Board Level Employee Representation in Europe

Download or read book Board Level Employee Representation in Europe written by Jeremy Waddington and published by Routledge. This book was released on 2015-09-16 with total page 299 pages. Available in PDF, EPUB and Kindle. Book excerpt: Board Level Employee Representation in Europe analyses the role, activities and networking of board level employee representatives in sixteen European countries and their counterparts operating in companies that have adopted European status. Board level employee representation is viewed as a key element of worker participation in Europe, but there has been only limited international comparative research that establishes what board level employee representatives do and how their activities vary between countries. Based on a large-scale survey distributed to board level employee representatives (circa more than 4,000 respondents), this study identifies the personal characteristics and industrial location of board level employee representatives, what they do and how they interact with other parties within and outside of the company. This study fills in a knowledge gap at a time when policy debates are considering stakeholder models of corporate governance as a means on the way out of the crisis and the achievement of sustainable economies. The book allows direct comparisons between clusters of countries for the first time, as the same survey instrument has been employed in all the participating countries. The research findings demonstrate a large variation in what constitutes board level employee representation in practice, including the relations between board level employee representatives and parties within and external to the company, and the pattern of influence of board level employee representatives on strategic company decision-making. Aimed at practioners, researchers and policymakers alike, this book makes a vital contribution to the field, and will be the definitive work on board-level employee representation for the foreseeable future.
