Book excerpt: Major disasters can disrupt transit operations, destroy vehicles and facilities, and impede the ability of people to reach essential relief and medical services and return to their homes and jobs. GAO determined (1) the federal role in assisting transit agencies after a major disaster; (2) the amounts, sources, and uses of federal disaster assistance for transit since 1998; (3) the factors that affected the timeliness and effectiveness of transit assistance after the 2005 Gulf Coast hurricanes; and (4) additional options for providing assistance to transit after a major disaster. GAO reviewed laws, regulations, and guidance; analyzed DOT and FEMA data; and interviewed officials with FEMA, DOT, state and local agencies, and others. To promote timely and effective assistance to transit, FEMA should develop guidance on the types of transit services that it will fund after a disaster and criteria for the duration of funding. DOT should evaluate the feasibility of options to increase FTA's authority to provide financial disaster assistance to transit, and seek legislative authority as appropriate. Book excerpt: The Department of Transportation (DOT) is in the process of allocating, obligating, and disbursing the $13 billion appropriated by the Disaster Relief Appropriations Act, 2013 (DRAA) for surface transportation relief. Most of the DRAA surface transportation funds--over $10 billion--were appropriated to the Federal Transit Administration's (FTA) new Public Transportation Emergency Relief Program. An FTA damage assessment in January 2013 estimated the costs of repairing facilities damaged by Hurricane Sandy in New York and New Jersey to be about $5.7 billion. To date, FTA has obligated about $1.5 billion for 15 grants and disbursed about $499 million to reimburse transit agencies for emergency response, recovery, and repair costs. These disbursements are consistent with Congressional Budget Office estimates, and transit projects can take years to complete. Furthermore, FTA plans to use nearly half of its DRAA appropriation for resiliency projects (or projects to protect facilities from future damage), most of which will be carried out through a competitive grant process. FTA was evaluating applications when GAO completed its review. FTA's new Public Transportation Emergency Relief Program has more flexibility and fewer restrictions in funding projects compared to the Federal Emergency Management Agency's (FEMA) Public Assistance and Hazard Mitigation programs and the Federal Highway Administration's (FHWA) Emergency Relief Program. For example, FEMA's Hazard Mitigation program places limits on the amount of emergency relief funds that can be used for resiliency projects, while FTA's program does not. FTA's program also has more flexibility in how funds can be used for repairs, allowing transit agencies to improve facilities beyond pre-disaster conditions. The use of emergency relief funds for projects that go beyond recovery efforts is not new--activities funded by FHWA's Emergency Relief Program have also expanded beyond repair and reconstruction. The expanding scope of emergency relief assistance illustrates the fiscal exposure the federal government faces and the challenges of establishing long-term sustainable funding for disaster relief and recovery. Although FTA and FEMA have a memorandum of agreement for assisting transit providers during emergencies, they are limited in their ability to delineate specific roles and responsibilities for future disasters. This limit is because while FEMA receives funding on an ongoing basis, FTA, to date, has only received a supplemental appropriation for Hurricane Sandy and does not know what resources it will have for future disasters. Because FTA and FEMA have the authority to fund many of the same activities by law, transit agencies may experience confusion when seeking assistance under some circumstances. FTA and FEMA have not determined how collaborative efforts, including their communications program and protocol contemplated in the memorandum of agreement, will be monitored, evaluated, and reported, but instead rely on informal communication. As GAO has previously concluded, creating a means to evaluate the results of collaborative efforts can enhance and sustain them, and informal communications between federal agencies do not ensure that collaboration is effective. Establishing more formal monitoring and evaluation of combined efforts could help FTA and FEMA ensure effective collaboration.

Book excerpt: FEMA's Hazard Mitigation Grant Program is a powerful resource in the combined effort by Federal, State, and local government, as well as private industry and homeowners, to end the cycle of repetitive disaster damage. The Robert T. Stafford Disaster Relief and Emergency Assistance Act was passed on November 23, 1988, amending Public Law 93-288, the Disaster Relief Act of 1974. The Stafford Act included Section 404, which established the Hazard Mitigation Grant Program. In 1993, the Hazard Mitigation and Relocation Act amended Section 404 to increase the amount of HMGP funds available and the cost-share to 75 percent Federal. This amendment also encouraged the use of property acquisition and other non-structural flood mitigation measures. In an effort to streamline HMGP delivery, FEMA encourages States to develop their mitigation programs before disaster strikes. States are adopting a more active HMGP management role. Increased capabilities may include: Conducting comprehensive all-hazard mitigation planning prior to disaster events; Providing applicants technical assistance on sound mitigation techniques and hazard mitigation policy and procedures; Coordinating mitigation programs through interagency teams or councils. Conducting benefit-cost analyses; and Preparing National Environmental Policy Act reviews for FEMA approval. States that integrate the HMGP with their frequently updated State Administrative and Hazard Mitigation Plans will create cohesive and effective approaches to loss reduction. This type of coordinated approach minimizes the distinction between “predisaster” and “post-disaster” time periods, and instead produces an ongoing mitigation effort. Hazard mitigation is any sustained action taken to reduce or eliminate long-term risk to people and property from natural hazards and their effects. A key purpose of the HMGP is to ensure that the opportunity to take critical mitigation measures to protect life and property from future disasters is not lost during the recovery and reconstruction process following a disaster. Program grant funds available under Section 404 of the Stafford Act provide States with the incentive and capability to implement mitigation measures that previously may have been infeasible. The purpose of this Desk Reference is to: Provide comprehensive information about FEMA's Hazard Mitigation Grant Program (HMGP); Increase awareness of the HMGP as an integral part of statewide hazard mitigation efforts; and Encourage deeper commitments and increased responsibilities on the part of all States and communities to reduce damage and losses from natural disasters. This Desk Reference is organized to simplify program information and assist the reader with practical guidance for successful participation in the program. Lists of program-related acronyms and definitions are included, along with appendices that amplify selected aspects of the HMGP. The report focuses on major incidents that could necessitate a partial to full evacuation of the central business district or other large portion of an urban area. According to the committee that produced the report, transit agencies could play a significant role in an emergency evacuation, particularly in transporting carless and special needs populations, but few urban areas have planned for a major disaster and evacuation that could involve multiple jurisdictions or multiple states in a region, or have focused on the role of transit and other public transportation providers in such an incident. The report offers recommendations for making transit a full partner in emergency evacuation plans and operations, while cautioning emergency managers, elected officials, and the general public to be realistic in their expectations, particularly in a no-notice incident that occurs during a peak service period.
