Book excerpt: Excerpt from Elements of American Jurisprudence Jurisprudence, as the word is used in the title of this book, denotes the science of which law, as such, is the subject-matter; the science which deals, not with the commands and prohibitions whereof the law consists, but with the law itself, its nature, its origin, its history, its divisions, its forms, its interpretation, and the methods of its application to practical affairs. Of law in general, considered as an essential feature of political society and abstracted from all definite systems of law, there is a universal science known as General Jurisprudence; and of every system of law, differing as each does from every other in some of its exterior characteristics, there is a special science, - the Particular Jurisprudence of the State in which that law prevails. Thus American Jurisprudence is a special science, treating of the laws of the United States and of the States of which the American Union is composed. Manifestly some knowledge of this science is important to every educated citizen who aspires to the intelligent discharge of his political duties; a more intimate acquaintance with it is indispensable to the lawyer and the judge who participate in the interpretation and administration of the law; while for the jurist and the legislator the mastery over it must be still broader and more profound. In the present work it has been the purpose of the author to assist the various grades of students in their preparation for these different positions in political life.
