The right to detain a chattel or land, from the possession of the owner, until a debt is discharged. The right of a tailor to keep the coat which he has made from his customer's cloth, until his charges are paid, is such a lien. It is, at common law, a right of detention, not of sale. It presupposes possession of the chattel acquired by the consent of the owner; it cannot begin in a forcible or involuntary dispossession of the owner, by the person asserting it. Book The First Principles of Law Classic Reprint

Download or read book The First Principles of Law Classic Reprint written by Henry Taylor Terry and published by Forgotten Books. This book was released on 2018-01-31 with total page 708 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The First Principles of Law The aim of this book is to set out in as plain and simple a manner as possible, and' in what the author ventures to think 18 a somewhat more philosophical arrangement than the usually accepted one of Blackstone, the most general and elementary principles of the law. It was written primarily for the use of the author's students beginning the study of the law; but it is hoped that it may be of service to students of law elsewhere, as well as possibly to readers who without intending to become lawyers wish to get a knowledge in outline of the nature and methods of legal science. It is not designed to take the place of the laiger and more complete treatises with which students generally, begin the1r legal studies, but rather to be used in connec tion with them: and for this reason many subjects have been omitted, such as Agency, Partnership and the greater part of the Law of Persons, which, though 01 the greatest interest and importance in themselves, may still be looked upon as being, so to speak, detachable from the main fabric of legal principles and affording merely special applications of rules and principles which the student ought to understand before he comes to the study of those special branches. Book A Treatise on the Poor Laws of Pennsylvania Classic Reprint

Download or read book A Treatise on the Poor Laws of Pennsylvania Classic Reprint written by Calvin G. Beitel and published by . This book was released on 2015-09-27 with total page 632 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from A Treatise on the Poor Laws of Pennsylvania For nearly a quarter of a century the author has held the position of counsel for the Board of Poor Directors of his county. During this time he has often felt the need of a work on the poor laws in a more compact form than the various digests of the laws and decisions of the courts, covering nearly two hundred years of legislation. Some years ago he commenced to arrange the decisions under the acts which had required judicial construction, and finally led to the present work. As nearly all legislation in reference to the poor prior to the act of June 13, 1836, has been repealed, or rather embodied in the latter act, the plan adopted was to take that act section by section and under each give the decisions of the courts construing them, and in doing so the author has not confined himself to the courts of last resort, but has digested the cases of all the lower courts that he thought of any value. There are instances where certain sections of the act of 1836 have been supplemented or modified to some extent by later legislation, and wherever it was possible these supplemental acts were placed immediately under the section meant to be modified. It has been the object to compile a work which would, if possible, be complete in itself and relieve the reader or student of the necessity of resorting to the reports.
