The regulations expand the list of acceptable national and international explosion protection standards and add the internationally accepted independent third-party certification system, the International Electrotechnical Commission System for Certification to Standards relating to Equipment for use in Explosive Atmospheres (IECEx), as an accepted method of testing and certifying electrical equipment intended for use in hazardous locations. The regulations also provide owners and operators of existing U.S. MODUs, floating OCS facilities, vessels other than OSVs, and U.S. tank vessels that carry flammable or combustible cargoes, the option of following this compliance regime as an alternative to the requirements contained in existing regulations. Updated as of May 29, 2018 The Coast Guard is establishing safety regulations governing the inspection, standards, and safety management systems of towing vessels. We are taking this action because the Coast Guard and Maritime Transportation Act of 2004 reclassified towing vessels as vessels subject to inspection and authorized the Secretary of the Department of Homeland Security to establish requirements for a safety management system appropriate for the characteristics, methods of operation, and nature of service of towing vessels. This rule, which includes provisions covering specific electrical and machinery requirements for new and existing towing vessels, the use and approval of third-party organizations, and procedures for obtaining Certificates of Inspection, will become effective July 20, 2016. However, certain existing towing vessels subject to this rule will have an additional 2 years before having to comply with most of its requirements. Book excerpt: The primary aim of the International Maritime Solid Bulk Cargoes (IMSBC) Code, which replaces the Code of Safe Practice for Solid Bulk Cargoes (BC Code), is to facilitate the safe stowage and shipment of solid bulk cargoes by providing information on the dangers associated with the shipment of certain types of solid bulk cargoes and instructions on the procedures to be adopted when the shipment of solid bulk cargoes is contemplated. The IMSBC Code, may be applied from 1 January 2009 on a voluntary basis, anticipating its envisaged official entry into force on 1 January 2011, from which date it will be mandatory under the provision of the SOLAS Convention. To keep pace with the expansion and progress of industry, in recent years, the Code has undergone many changes, including: Fully updated individual schedules for solid bulk cargoes; New individual schedules for such cargoes as spent cathodes and granulated tyre rubber; New provisions about sulphur; References to the most recent SOLAS amendments Updated information from the 2008 edition of the IMDG Code. This publication presents additional information that complements the IMSBC Code, such as the Code of Practice for the Safe Loading and Unloading of Bulk Carriers (BLU Code) and Recommendations on the safe use of pesticides in ships applicable to the fumigation of cargo holds. The IMSBC Code and supplement is recommended to Administrations, shipowners, shippers and masters and all others concerned with the standards to be applied in the safe stowage and shipment of solid bulk cargoes, excluding grain.

Book excerpt: 07 October 2019 The Notice of Violation (NOV) program was implemented in 1995 to address the Coast Guard's concern that the civil penalty assessment process was too lengthy when applied to small oil discharges under 100 gallons and minor pollution prevention regulation violations (33 CFR parts 154, 155, and 156). The process time meant that a party frequently would have additional violations before being notified of an initial violation. Early resolution of these minor violations saved time and reduced costs of internal reviews, improved compliance and deterrence, and facilitated corrective action by providing more immediate notice to the charged party. Because of the success of the initial limited NOV program, it was expanded in 2004 to include oil spills of 1,000 gallons or less and to include violations of other laws and regulations that the Coast Guard enforces. Since its inception, the NOV program modified the civil penalty process by creating a regulation, 33 CFR 1.07- 11, that allowed for immediate notification to the responsible party of the alleged violation(s).
