Si la comparación es obra de síntesis, su estudio tiene que ser forzosamente sintético. La síntesis se ha producido al máximo. Tres familias jurídicas, pero no antagónicas sino integrando una comunidad humana, un mismo nivel y un mismo plano de civilización. Por eso, las interferencias son marcadas. Vamos a tratar de señalarlas. Hoy no se puede estudiar Derecho Procesal ni otra alguna disciplina jurídica más que en forma comparada o comparatista. No se puede dejar de comparar; y la comparación como nos dice Cappelletti y como acabo de señalar es obra de síntesis. Pero se compara y se sintetiza con mayor facilidad que en tiempos pasados porque el mundo se ha hecho cada vez más pequeño o más manejable. La comparación ya no es entre países o entre Códigos, sino entre familias; y éstas, a los efectos de nuestro estudio, sólo son tres. Tradicionalmente nos encontramos con dos sistemas: civil law y common law. Después surgirá, con dimensiones especiales, un tercer sistema o una tercera familia: la socialista. Pero, entiéndase bien: los sistemas o las familias no están representados al menos principalmente por Códigos o leyes sino por justicias. Y así, el resultado más extraordinario a que el trabajo de Cappelletti conduce es que las diferencias entre las dos tradicionales familias se van atenuando o se van difuminando; pero después nos lleva a otro más asombroso, al destacarnos que en las dos Alemanias sigue rigiendo el mismo Código: la vieja Zivilprozessordnung sirve de instrumento en un país o en una zona de régimen socialista. Ante los dos fenómenos señalados por el autor, pensamos que la justicia no es una cuestión de leyes, sino de hombres. Si common law y civil law se aproximan, abandonan su antagonismo, esto no ocurre tanto en sus leyes como en el manejo de ellas por los hombres. Si el mismo Código sirve para las dos Alemanias, ello se ha de deber a que la ZPO no es tan burguesa como podría creerse o a que la justicia socialista no lo es tanto que le impida utilizar sin modificación instrumentos de creación burguesa; acaso a que la justicia es sustantiva y lo que se le añade, queriendo calificarla, son adjetivos. Cuestión de hombres, decimos, que nos explica fenómenos judiciales y científicos".

It examines the meaning and relevance of the concept of efficiency for the operation of courts and court systems,seeking to answer questions such as: in what sense can we say that the adjudicative process works efficiently? What are the relevant criteria for the measurement and assessment of court efficiency? Should the courts try to operate efficiently and to what extent is this viable? What is the proper relationship between 'efficiency' and 'justice' considerations in a judicial proceeding? To answer these questions, a conceptual framework is developed on the basis of empirical studies and surveys carried out mainly in the United States, Western Europe and Latin America. Two basic ideas emerge from it. First, economic rationality has penetrated the legal and judicial systems at all levels and dimensions, from the level of society as a whole to the day-to-day operation of the courts, from the institutional dimension of adjudication to the organizational context of judicial decisions. Far from being an alien value in the judicial process, efficiency has become an inseparable part of the structure of expectations we place on the legal system. Second, economic rationality is not the prevalent value in legal decision-making, as it is subject to all kinds of constraints, local conditions and concrete negotiations with other values and interests.
