Book excerpt: Desde los años setenta del siglo pasado, la comunidad internacional coopera a escala universal para hacer frente a acuciantes problemas ambientales que acechan al conjunto de la humanidad, y que ponen en riesgo el desarrollo humano, social y económico de gran parte de la población de la Tierra. Así, numerosos tratados internacionales abordan la lucha contra problemas ambientales de dimensión planetaria, tales como el cambio climático, la descomposición de la capa de ozono, la creciente desertificación del planeta o la pérdida de diversidad biológica a gran escala. Sin embargo, por importantes que sean las obligaciones que los Estados asumen en estos tratados, de nada sirven si sus disposiciones no se aplican, y los países no cumplen los compromisos adquiridos. En atención a ello, estos tratados establecen mecanismos y procedimientos específicos para promover su aplicación y cumplimiento e incrementar la eficacia de la cooperación internacional para la protección del medio ambiente. La presente obra centra su objeto de estudio en el control internacional de la aplicación de los acuerdos ambientales universales. Para ello, parte de que estos mecanismos y procedimientos son fruto del contexto normativo del cual emergen: su gestación obedecería precisamente a la adaptación de las normas secundarias del Derecho internacional elaboradas para la aplicación de normas primarias reguladoras de relaciones bilaterales y recíprocas, a un contexto normativo nuevo, presidido por la naturaleza crecientemente colectiva de los regímenes ambientales universales. Así pues, se estudian en ella los aspectos institucionales y procedimentales del funcionamiento del control internacional de la aplicación de los acuerdos ambientales universales, en atención a la naturaleza jurídica de las obligaciones convencionales centrales.

The guidance was prepared in compliance with the FAO/WHO International Code of Conduct on Pesticide Management, which sets out a framework and voluntary standards of conduct for stakeholders in pesticide management, in particular governments and the pesticide industry. Endorsed by FAO, WHO, governments, pesticide producers, non-governmental organizations and other stakeholders, the Code outlines their shared responsibility to promote best practice and risk reduction throughout the pesticide life cycle. The Code of Conduct thereby establishes the commitment and moral obligation of stakeholders to comply with the agreed standards of conduct and to assume their respective responsibilities. These include governments’ responsibility to promote pesticide risk reduction and the industry’s responsibility to produce products that are adapted to the context of their use and to provide stewardship of those products throughout their life cycle. This guidance was prepared with the support of the FAO/WHO Joint Meeting on Pesticide Management (JMPM) to provide further guidance on the provisions of the Code of Conduct related to its observance and implementation. It reflects the joint FAO/WHO approach to pesticide management, thus addressing the topic in both agricultural and public health settings.
