To achieve that potential, both the promises and the perils of innovation must be investigated, including the risks and opportunities of joint procurement across borders in the European Union and the United States. This in-depth research investigates innovation in public procurement from three different perspectives. First, leading academics and practitioners assess the purchase of innovation, with a particular focus on urban public contracting in smart cities involving meta-infrastructures, public-private partnership arrangements and smart contracts. A second line of inquiry looks for ways to encourage innovative suppliers. Here, the collected authors draw on emerging lessons from the US and Europe, to explore both the costs and the benefits of spurring innovation through procurement. A third perspective looks to various innovations in the procurement process itself, with a focus on the effects of joint and cross-border procurement in the EU and US landscapes. The chapters review new technologies and platforms, the increasingly automated means of selecting suppliers, and the related efficiencies that “big data” can bring to public procurement. Expanding on research in the editors’ prior volume, Integrity and Efficiency in Sustainable Public Contracts: Balancing Corruption Concerns in Public Procurement Internationally (Bruylant 2014), this volume builds on a series of academic conferences and exchanges to address these issues from sophisticated academic, institutional and practical perspectives, and to point the way to future research on the contractual models that are emerging from new procurement technologies.

Under the European Union’s 2030 Biodiversity Strategy, EUmember States will be responsible for designating the additional protected and strictly protected areas, either by expanding or completing the so-called ‘NATURA 2000’ Network or under national protection schemes through the establishment of national MPAs, including possible transboundary MPAs and OECMs established in accordance with the provisions of the relevant regional seas conventions. This book provides a discussion of the juridical status of the Adriatic and Ionian Seas as parts of a wider enclosed or semi-enclosed Mediterranean Sea, followed by an assessment of the interrelation between global, regional, sub-regional and national legal frameworks on MPAs and OECMs. It offers a comprehensive analysis of the legal basis regarding the establishment of national and, where appropriate, transboundary MPAs and OECMs. Discussing relevant examples of good practice related to transboundary and MPAs, the book will provides an overview of the challenges and opportunities related to the establishment of a transboundary Mediterranean Specially Protected Area of Mediterranean Importance (SPAMI), based on the provisions of the relevant Protocol to the Barcelona Convention, as well as on the challenges and opportunities related to the establishment of a transboundary international marine park and on the feasibility of the establishment of one or more Particularly Sensitive Sea Areas (PSSAs) within the Adriatic and Ionian Seas, and beyond. The establishment and management of transboundary marine protected areas therefore presents major governance challenges. Book excerpt: Preface – Introduction 1 Heiderose Kilper “New Disparities in Spatial Development in Europe” – several topics are included in both the title and theme of the German Annual of Spatial Research and Policy for the Year 2009. We are frst of all concerned with the concept of spatial disparities, which has its roots in national spatial planning and spatial development policy. Regional development as interregional equalisation policy, for example, is well-anchored in the German constitution through fundamental legal standards and the division of powers among the respective federal states. The “establishment of uniform living conditions within the federal territory” and “securing the uniformity of living conditions beyond the borders of any single federal state” (Section 72 Paragraph 2 of German Basic Law [GG]) are expressly specifed as aims of government action in the constitution of the Federal Republic of Germany. With the major reform of Germany’s fnancial system in 1969 and incorporation of the joint task “Improvement 1 of the Regional Economic Structure” in Section 91a of German Basic Law [GG] interventions on the part of the federal government and the wealthy federal states for the beneft of states and regions with less economic success were legitimised in constitutional terms as well. All of this would be inconceivable without the concept of spatial disparities.

European structure can be analyzed from the perspective of these areas that are studied in different proportions also in the national university curricula. In a narrow sense we can speak of administrative law governing this European space. The notion of European administrative space can be thought modeled on European economic and social space, being connected with the legal system-wide cooperation. Traditionally, a common administrative space is possible when a set of legal principles, rules and regulations are respected uniformly in a territory covered by a national constitution. Thus we can speak of each sovereign state administrative law. The issue a law on public administration which fits all sovereign states that joined the EU was debated intensely since the establishment of the European Community. This book is edited with the support of the Romanian Ministry of Research and Innovation.
