Book excerpt: Though recently improved, Chinese legislation on environmental permits is still weak and urgent measures are needed to help the country in moving towards an effective permitting system. This book examines this legislation gap and presents a contribution to solving China’s pollution problems. By analysing the deficiencies of current Chinese provisions on permitting in light of EU legislation, and its Italian application, the book determines which permitting legislative structure and approach China should embrace in practice in order to build more comprehensive legislation on emission permitting. It is argued that a set of ad hoc legislative measures should be implemented so as to strengthen China’s environmental protection and efficiently tackle pollution. The book will be a valuable resource for researchers, academics and policy-makers working in the areas of international environmental law and comparative law.

The contributors to this book examine how international environmental agreements are put into practice. Their main concern is effectiveness -- the degree to which such agreements lead to changes in behavior that help to solve environmental problems. Their focus is on implementation -- the process that turns commitments into action, at both domestic and international levels. Implementation is the key to effectiveness because these agreements aim to constrain not just governments but a wide array of actors, including individuals, firms, and agencies whose behavior does not change simply because governments have made international commitments. The less than satisfactory performance of both government and market approaches to environmental protection has led tothe introduction of a broader range of policy mechanisms, such as education, information-based strategies, economic instruments and self-regulation. Yet these various policy instruments are usually treated as alternatives to one another rather than as complementary. Drawing from studies in North America, Europe and Australia, the authors show how the design of complementary combinations of policy instruments, tailored to particular environmental goals and circumstances, will produce more effective and efficient policy outcomes. They also confront the criticalproblem of how, at a time of fiscal constraint and small government, environmental policy might still be designed in ways that improve outcomes both for the environment and for business.
