Available in PDF, EPUB and Kindle. Book excerpt: Recent years have seen a number of pressing developments in copyright law: there has been an enormous increase in the range and type of work accorded protection; the concept of the ‘original work’ has entered into national copyright acts; and intangible entities are now entitled to protection by copyright. All these are consequences of legislative and technological developments that can be traced back over two centuries and more. the result. This book presents an interdisciplinary study of the growth of copyright law, largely based on archival research and on archival materials only recently made available online. The new history here articulated helps to explain why print is no longer today the sole or even the chief object of copyright protection. Taking its key examples from British, French and Danish copyright law, the book begins by exploring how the earliest copyright laws emerged out of the technological understanding of a printed ‘copy,’ and out of the philosophical notions of originals and copies, tangibles and intangibles. Dr Teilmann-Lockgoes on to examine the concept of the ‘work’ as it develops both conceptually and legally, as the object of protection, and then explains how, in a curious consequence, 'the work' turns the ‘copy’ into the 'mere' material instantiation of the intangible 'original'. The book concludes by addressing the considerable and complicated problems now emerging in copyright law following the inclusion of design within the scope of its protection. In this field Danish law, striving to protect Danish design, has been setting the trend for over a hundred years. In its examination of terminological exchanges between the diverse legal traditions and philosophical discourse, and in its thorough investigation of particular terms central to copyright legislation, this interdisciplinary book will be of great interest to scholars and students of copyright and intellectual property law; it also makes an important contribution to literary studies, legal history and cultural theory.

Book European Modernity and Beyond

Download or read book European Modernity and Beyond written by Göran Therborn and published by SAGE. This book was released on 1995-03-06 with total page 416 pages. Available in PDF, EPUB and Kindle. Book excerpt: In this book one of Europe′s foremost sociologists offers a profound and accessible overview of the trajectory of European societies, East and West, since the end of World War II. Combining theoretical depth with factual analysis, Göran Therborn addresses the questions that underpin an understanding of the nature of European modernity, including: To what extent is the period 1945-2000 producing fundamental change and what are the areas of continuity? Have the societies of Europe become more similar to others on the globe or more distinctively European? What are the prospects of Europe after decades of postwar change and the end of the Cold War? Issues covered include the division of paid and unpaid labour, patterns of rights in different social spheres, the development of mass consumption, the evolution of risks, the spatial range of economic and cultural change, collective memory and identities, the geography of happiness, and modes of collective action. The author relates these issues to the two great social steering projects of the period - socialism in the East and the European Union in the West.

Available in PDF, EPUB and Kindle. Book excerpt: While the role of comparative law in the courts was previously only an exception, foreign sources are now increasingly becoming a source of law in regular use in supreme and constitutional courts. There is considerable variation between the practices of courts and the role of comparative law, and methods remain controversial. In the US, the issue has been one of intense public debate and it is still one of the major dividing issues in the discussion about the role of the courts. Contributing to the existing discussion of the use of comparative law in the courts, this book provides an inclusive, coherent, and practical analysis of the relevant law and jurisprudence in comparative law in the courts. It examines the consequences for court procedures and the form of judgments, as well as how foreign sources are drawn upon in private international law, European law, administrative law, and constitutional law as well as before general courts. The book also includes case studies of comparative law used in particular spheres of the law, such as tort law and consumer law. Written by practising judges and lawyers as well as leading academics, this book serves as a central reference point concerning the role of comparative law before the courts.

This book was released on 2016-05-19 with total page 273 pages. Available in PDF, EPUB and Kindle. Book excerpt: Imported from India, China, the Levant, and Persia and appreciated for their diversity, designs, fast bright colours and fine weave, Asian textiles became so popular in France that in 1686 the state banned their import, consumption and imitation. A fateful decision. This book tells the story of smuggling on a vast scale, savvy retailers and rebellious consumers. It also reveals how reformers in the French administration itself sponsored a global effort to acquire the technological know-how necessary to produce such textiles and how the vitriolic debates surrounding the eventual abolition of the ban were one of the decisive moments in the development of Enlightenment economic liberalism.

  • Pages : 260 pages

Download or read book Family Religion and Law written by Prakash Shah and published by Routledge. This book was released on 2016-04-15 with total page 260 pages. Available in PDF, EPUB and Kindle. Book excerpt: This collection discusses how official legal systems do and should respond to the reality of a plurality of family types and origins within their jurisdictions. It further examines the challenges that arise for practitioners, including lawyers and judges, when faced with such plurality. Focussing on empirical research, the volume presents legal and sociological data of unprecedented comparative depth. It also includes a discussion of how members of minority families respond to the need to organise their legal relationships, and to resolve their disputes in the shadow of official legal systems which differ from those of their familial and communal traditions. The work invites reflection, and demonstrates the urgency and complexity of the questions regarding the search for justice in the field of family life in Europe today.
