And the dominant view of economic regulators (influenced by Mancur Olson’s book The Logic of Collective Action, published in 1965) agrees with them. According to this view, diffuse interests like those of consumers are too difficult to organize and too weak to influence public policy, which is determined by the concentrated interests of industrial-strength players. Gunnar Trumbull makes the case that this view represents a misreading of both the historical record and the core logic of interest representation. Weak interests, he reveals, quite often emerge the victors in policy battles. Based on a cross-national set of empirical case studies focused on the consumer, retail, credit, pharmaceutical, and agricultural sectors, Strength in Numbers develops an alternative model of interest representation. The central challenge in influencing public policy, Trumbull argues, is not organization but legitimation. How do diffuse consumer groups convince legislators that their aims are more legitimate than industry’s? By forging unlikely alliances among the main actors in the process: activists, industry, and regulators. Trumbull explains how these “legitimacy coalitions” form around narratives that tie their agenda to a broader public interest, such as expanded access to goods or protection against harm. Successful legitimizing tactics explain why industry has been less powerful than is commonly thought in shaping agricultural policy in Europe and pharmaceutical policy in the United States. In both instances, weak interests carried the day.

Book excerpt: The question of recourse to self-medication arises at the intersection of two partly antagonistic discourses: that of the public authorities, who advocate the practice primarily for economic reasons, and that of health professionals, who condemn it for fear that it may pose a danger to health and dispossess the profession of expertise. This books examines the reality of self-medication in context and investigates the social treatment of the notion of autonomy ever present in the discourses promoting this practice. Drawing on fieldwork conducted in France, the author examines the material, cognitive, symbolic and social dimensions of the recourse to self-medication, considering the motivations and practices of the subjects and what these reveal about their relationship with the medical institution, while addressing the question of open access to medicines – a subject of heated debate between the actors concerned on themes such as competence, knowledge and responsibility. A rigorous analysis of the strategies adopted by individuals to manage the risks of medicines and increase their efficacy, Self-Medication and Society will appeal to sociologists and anthropologists with interests in health, illness, the body and medicine.

Il ne fait pas de doute que l’apparence extérieure des produits qui nous entourent est susceptible d’exercer une force d’attraction importante, voire une fascination sur le public des consommateurs. Preuve en est la valeur phénoménale progressivement acquise par une firme californienne à la désormais célébrissime pomme – qui était, il faut le rappeler, au bord du gouffre il y a quelques années –. Cette firme a en effet su inventer ou réinventer des produits technologiques à destination de tous à la ligne épurée et attractive, qu’il s’agisse de téléphones, de tablettes ou d’autres produits électroniques. Il est certes clair que l’attractivité de ces produits ne tient pas exclusivement à leur apparence, mais également à leur convivialité et fonctionnalités technologiques. On ne peut toutefois pas doutes que leur « look » y contribue aussi (largement). Il n’est dès lors pas surprenant que nombre d’entreprises dans des secteurs et industries très variés consacrent d’importantes ressources et leur énergie créatrice à développer des produits au design unique, destiné à les distinguer de ceux de leurs concurrents. Comment le droit du design peut-il dès lors protéger cette créativité des produits et à quelles conditions ? Juger du pouvoir d’attraction de la forme d’un produit n’est pas tâche aisée. C’est en somme tenter de faire écho sur le plan légal à la phrase du célèbre designer Milton Glaser : « There are three responses to a piece of design : yes, no and … WOW. WOW is the one to aim for ». Pour explorer le domaine évolutif du droit du design, les auteurs des remarquables contributions qui composent ce livre se sont penchés sur diverses facettes de la thématique en droit international et national. Book excerpt: This book addresses emerging questions concerning who should bear responsibility for shouldering risk, as well as the viability of existing and experimental governance mechanisms in connection with new technologies. Scholars from 14 jurisdictions unite their efforts in this edited collection to provide a comparative analysis of how various legal systems are tackling the challenges produced by the legal aspects of genetic testing in insurance and employment. They cover the diverse set of norms that surround this issue, and share insights into relevant international, regional and national incursions into the field. By doing so, the authors offer a basis for comparative reflection, including on whether transnational standard setting might be useful or necessary for the legal aspects of genetic testing as they relate to the insurance and employment contexts. The respective texts cover a broad range of topics, including the prevalence of genetic testing in the contexts of insurance and employment, and policy factors that might affect this prevalence, such as the design of national health or social insurance systems, of private insurance schemes or the availability of low-cost direct-to-consumer genetic testing. Further, the field of genetics is gaining in importance at the international and regional levels. Relevant concepts – mainly genetic tests and genetic data/information – have been internationally defined, and these definitions have influenced definitions adopted nationally. International law also recognizes a “special status” for human genetic data. The authors therefore also consider these definitions and the recognition of the special status of human genetic data within regional and national legal orders. They investigate the range of norms that specifically address the use of genetic testing in employment and insurance, encompassing international sources – including human rights norms – that may be binding or non-binding, as well national statutory, regulatory and soft-law mechanisms. Accordingly, some of the texts examine general frameworks relevant to genetic testing in each country, including those that stem from general anti-discrimination rules and norms protecting rights to autonomy, self-determination, confidentiality and privacy. In closing, the authors provide an overview of the efficiency of their respective legal regimes’ approaches – specific and generalist – to genetic testing or disclosure of genetic information in the employment or insurance contexts, including the effect of lack of legal guidance. In this regard, some of the authors highlight the need for transnational action in the field and make recommendation for future legal developments.

These are framed increasingly in terms of international concerns about security, human rights, and humanitarian crisis. This presents a stark contrast to the 1960s and ‘70s, when many newly independent African governments pursued the vision of public health “for all,” of comprehensive health care services directed by the state with support from foreign donors. These initiatives often failed, undermined by international politics, structural adjustment, and neoliberal policies, and by African states themselves. Yet their traces remain in contemporary expectations of and yearnings for a more robust public health. This volume explores how medical professionals and patients, government officials, and ordinary citizens approach questions of public health as they navigate contemporary landscapes of NGOs and transnational projects, faltering state services, and expanding privatization. Its contributors analyze the relations between the public and the private providers of public health, from the state to new global biopolitical formations of political institutions, markets, human populations, and health. Tensions and ambiguities animate these complex relationships, suggesting that the question of what public health actually is in Africa cannot be taken for granted.
