Tel n’est pas le propos de cet ouvrage, qui est le fruit de réflexions de juristes d’horizons intellectuels et géographiques très différents. La rencontre du droit économique et des droits de l’homme est plus naturelle qu’il n’y paraît. Les droits de l’homme sont consubstantiels à l’économie de marché, qui, fondée sur des libertés, a besoin de liberté. Le dialogue naturel entre ces deux champs, droit économique et droits de l’homme, n’est cependant pas toujours harmonieux. De sérieux conflits opposent le marchand et le non-marchand. Au-delà des oppositions classiques entre les droits de l’homme, on a vu apparaître des droits dont la vocation porte sur ce qu’il est convenu d’appeler des « valeurs non marchandes » : l’environnement, la culture, la santé, l’alimentation, la solidarité. L’une des questions majeures est donc de savoir s’il est possible de faire souffler de l’humanisme dans le champ des relations économiques. Plus fondamentalement, les droits de l’homme sont-ils un moyen de réguler juridiquement les activités économiques dans une société globalisée ou, au contraire, un handicap pour les entreprises ? Cette interrogation débouche inévitablement sur la possibilité d’une coexistence entre universalité et relativité des droits de l’homme. Cet ouvrage a ainsi pour ambition d’inviter le lecteur à se saisir des difficultés à penser et pratiquer les droits de l’homme dans une économie mondialisée.
