Download or read book Unifying and Harmonising Substantive Law and the Role of Conflict of Laws written by and published by Martinus Nijhoff Publishers. This book was released on 2010-07-05 with total page 289 pages. Available in PDF, EPUB and Kindle. Book excerpt: Traditionally, conflict of law rules designate only national substantive law as the applicable law. Many unifying and harmonizing substantive law instruments of both States and non-State organizations, however, are designed specifically for application to cross-border relationships. Achieving this objective is, generally, hindered by conflict of law rules. The requirements which non-national law needs to fulfil in order to be accepted as the law governing a cross-border relationship deserve clarification. Not only uniform law, such as the CISG and the envisaged European substantive law instrument for the law of obligations, but, particularly, instruments which are aimed at harmonizing substantive law, challenge the established systems of conflict of laws. In seeking a positive approach towards the application of a law other than national law various aspects need to be considered: (1) is the decision taken by a court or an arbitral tribunal; (2) what field of law (contract/delict/tort or family relationships) is involved; and (3) the objective or subjective (choice by the parties) designation of the applicable law.

Available in PDF, EPUB and Kindle.

This book was released on 2018-03-19 with total page 652 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book presents a broad overview of succession law, encompassing aspects of family law, testamentary law and legal history. It examines society and legal practice in Europe from the Middle Ages to the present from both a legal and a sociological perspective. The contributing authors investigate various aspects of succession law that have not yet been thoroughly examined by legal historians, and in doing so they not only add to our knowledge of past succession law but also provide a valuable key to interpreting and understanding current European succession law. Readers can explore such issues as the importance of a father’s permission to marry in relation to disinheritance, as well as inheritance transactions and private, dynastic and cross-border successions. Further themes addressed by the expert contributors include women’s inheritance rights, the laws of succession for the prince in legal consulting, and succession in the Rota Romana’s jurisprudence.
Download or read book Creation of the Ius Commune written by John W. Cairns and published by Edinburgh University Press. This book was released on 2010-07-30 with total page 320 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book discusses in detail how medieval scholars reacted to the casuistic discussions in the inherited Roman texts, particularly the Digest of Justinian. It shows how they developed medieval Roman law into a system of rules that formed a universal common law for Western Europe. Because there has been little research published in English beyond grand narratives on the history of law in Europe, this book fills an important gap in the literature. With a focus on how the medieval Roman lawyers systematised the Roman sources through detailed discussions of specific areas of law.

Download or read book Models of Implementation of Article 12 of the Convention on the Rights of Persons with Disabilities CRPD written by Maciej Domański and published by Taylor & Francis. This book was released on 2023-11-22 with total page 839 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book examines the implications of Article 12 of the UN Convention on the Rights of Persons with Disabilities (CRPD), its resulting standard of protection for persons with disabilities and the way it is understood and implemented in its diverse signatory states. Its overarching theme is to assess the impact of CRPD Article 12 on the private law concept of legal capacity and its limitations, the significance of which carries over into the realm of penal law regulations. Its impact is analysed primarily from the legal point of view, but with due regard for its psychological and psychiatric ramifications. Recognising the importance of these disciplines is important when implementing CRPD Article 12 into domestic law, as they contribute to the determinants in creating a qualificatory legal framework for all, persons with disabilities in particular, to exercise their rights to legal capacity without let or hindrance. As active legal capacity is a notion rooted in and coming from private law, this forms the main research perspective. The first section discusses the foundational concepts constituting the CRPD Article 12 standard from domestic private law and international law perspectives. The work shows that the concepts adopted in private law interact with the protection of persons with disabilities as victims provided for in criminal law. In addition, where relevant, authors also look at public law institutions that are connected with the private law solutions. The volume will be an essential reference for academics, researchers and policy-makers working in the areas of private law, criminal law, mental health law, human rights, discrimination law as well as psychology and psychiatry.
Download or read book The Transmission of Well being written by Margarida Durães and published by Peter Lang. This book was released on 2009 with total page 542 pages. Available in PDF, EPUB and Kindle. Book excerpt: What does well-being mean when we talk about men and women in the past? Their sheer chances of survival, their protection from want, their social status, their individual agency and their self-esteem were all strongly mediated by the family, the predominant social institution. Family laws and customs of family formation created differences between insiders and outsiders in terms of well-being. Within families, there were strong differences in autonomy, status and freedom between the genders and generations. The book offers a fascinating exploration of gender differences in well-being in many regions of historic Europe, with some comparative perspectives. It explores how historic family systems differed with respect to choosing a marriage partner, transmitting property, living and care conditions of widows and widowers and the position of children born out of wedlock.

This book was released on 2014-02-06 with total page 121 pages. Available in PDF, EPUB and Kindle. This lesson highlights the historical importance of the revival of Roman law in the medieval West. Along with canon law and the work of the Bolognese jurists, it spread throughout Europe under the name of ius commune. Much more than a strictly legal phenomenon, it brought about a true cultural change, which affected all areas of medieval society.

The historical processing of our Roman legal heritage is treated from the perspective of comparative legal history. The book is written for undergraduate law students, but is also relevant for scholars from other disciplines.

Available in PDF, EPUB and Kindle.
