Distinct conceptions of global justice differ in their specific criteria of global justice. We are responsible for global regimes such as the global trading system and the rules governing military interventions. Book excerpt: The introduction by the Amsterdam Treaty of the flexibility clauses, authorising a majority of Member States to cooperate more closely in areas covered by the Treaties, has been received with mixed feelings. Flexibility is by no means a new phenomenon in the EU's development. It has been on the Community's agenda already since the 1970s. The Single European Act introduced several provisions allowing for flexible approaches to the single market, whilst the Maastricht Treaty launched a differentiated approach to the EMU and social policy. In addition to these forms of differentiation in primary Community law, for many years there has also been a number of quite important, though less visible, forms of differentiation in secondary Community law. This book aims to link both levels of differentiation and seeks to unveil the many faces of differentiation in EU law. It analyses whether, and to which extent, there is a shift in European integration from a system of unity and uniformity to one of flexibility and differentiation. A first series of contributions to the book analyse a number of exemplary policy fields (EMU, social policy, environment, free movement of persons, justice and home affairs) in order to identify their degree of differentiation. Book excerpt: Conflict among nations for forty-five years after World War II was dominated by the major bipolar struggle between the United States and the Soviet Union. With the end of the Cold War; states in differing legions of the world are taking their affairs more into their own hands and working out new arrangements for security that best suit their needs. This trend toward new &"regional orders&" is the subject of this book, which seeks both to document the emergence and strengthening of these new regional arrangements and to show how international relations theory needs to be modified to take adequate account of their salience in the world today. Rather than treat international politics as everywhere the same, or each region as unique, this hook adopts a comparative approach. It recognizes that, while regions vary widely in their characteristics, comparative analysis requires a common typology and set of causal variables. It presents theories of regional order that both generalize about regions and predict different patterns of conflict and cooperation from their individual traits. This report examines these provisions. The referendum on the Treaty in the Republic of Ireland took place during the course of the inquiry. The "no" vote in Ireland raised the question of whether to continue: it was decided to do so for two main reasons: the first is that, irrespective of the Lisbon Treaty, the principle of subsidiarity will remain an important part of EU and Community law; and the second is that the UK will retain its right to decide whether to opt into European legislation on visas, asylum and immigration under Title IV of the present EC treaty. The conclusions on the provisions of the Lisbon Treaty on subsidiarity include: the substance of the subsidiarity Article in the Lisbon Treaty is the same in its effect as the existing Article in the EC Treaty; examination of EU proposals for compliance with the principle of subsidiarity is a long-established and fundamental part of the scrutiny process of the European Scrutiny Committee of the House of Commons; whether a proposal does or does not comply is a matter of political judgement and is unlikely to be capable of an entirely objective assessment.

Book excerpt: This book uses historical analysis, constitutional economics, and complexity theory to furnish an account of city subsidiarity as a legal, ethical, political, and economic principle. The book contemplates subsidiarity as a constitutional principle, where cities would benefit from much wider local autonomy. Constitutional economics suggests an optimal limit to jurisdictional footprints (territories). This entails preference for political orders where sovereignty is shared between different cities rather states where capital cities dominate. The introduction of city subsidiarity as a constitutional principle holds the key to economic prosperity in a globalizing world. Moreover, insights from complexity theory suggest subsidiarity is the only effective response to the ‘problem of scale.’ It is a fitness trait that prevents highly complex systems from collapsing. The nation-state is a highly complex system within which cities function as ‘attractors.’ The collapse of such systems would ensue if there were strong coupling between attractors. Such coupling obtains under legal monism. Only subsidiarity can make the eventuality of collapse improbable. The emergent and self-organizing properties of subsidiarity entail a shift in policy emphasis towards cities with a wide margin of autonomy.
