Book The Disintegration of the Constitution

Download or read book The Disintegration of the Constitution written by Louis Srote and published by . This book was released on 2012-11-20 with total page 248 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Disintegration of the Constitution chronicles government expansion, from an average American's perspective, and explains how this growth correlates to the erosion of our Constitutional freedoms. The Founding Fathers' intentions for government are examined to better understand what it was they desired, allowing you to better comprehend the meaning behind the Constitution. You will see how the beginning of our nation came to fruition and walk through a brief history of events as they occurred. Causes that lead to the Revolutionary War and our separation from King George III are paralleled with the travesty that is taking place today regarding government oversight and control. Many topical issues are explored, such as the bailouts and stimulus, taxes, healthcare reform, entitlements, media bias, gun control, and our trillion dollar debt and deficit. All are examined in great detail exposing corruption, collusion, deceit, wasteful spending, and fraud at all levels. You will learn how the government has grown beyond its means and become unsustainable, and if left unchecked will lead to the destruction of our economy as we know it. The author explains what must be done to get our country back on the right track, including drafting a clear and concise Amendment to the Constitution that details exactly how to contain government now and in the future.

Book Constitutional Disintegration and Disruption

Download or read book Constitutional Disintegration and Disruption written by Oliver Garner and published by . This book was released on 2020 with total page 286 pages. Available in PDF, EPUB and Kindle. Book excerpt: This thesis analyses constitutional disintegration and disruption in the European Union. These phenomena take the form of Member State withdrawal and opt-outs. The supranational constitutional order of the European Union is legitimated by individuals as Member State nationals and citizens of the European Union. Its construction and reconstruction are exercises of constituent power by the representatives of the Member States. Withdrawal through Article 50 TEU functions as a guarantee to nationals of the Member States that constituent power can be repatriated. The process of disintegration is subject to an orderly process in the interests of all EU citizens under the withdrawal clause. Opt-outs are reservations of constituent power by individual Member States made possible by the executive dominated process of treaty amendment. Opt-outs take effect through ad hoc Protocols addended to the Treaties that disapply EU law in certain sectors. The origins and development of withdrawal and opt-outs are analysed through the Brexit case study of disintegration, and the narrative of disrupted integration concerning the United Kingdom, Denmark, and Ireland. Disintegration through withdrawal has more dramatic consequences for individuals. The constituent status of EU citizenship is terminated for former Member State nationals and the territory of application for EU law contracts. Opt-outs disrupt supranational constitutionalism and the symmetry between individuals as democratic subjects and juridical objects qua Member State nationals and EU citizens. The thesis concludes with reform proposals for a dedicated constitutional clause that would subject the creation and maintenance of opt-outs to supranational constraints. Amendments to the text of Article 50 TEU are proposed to realise its telos to provide a sovereign right of withdrawal for Member State nationals whilst ensuring an orderly process for all EU citizens.

Book European Disintegration

Download or read book European Disintegration written by Hans Vollaard and published by Springer. This book was released on 2018-05-16 with total page 265 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book accounts for whether and how the path of the European Union (EU) has developed towards potential disintegration. These questions have become particularly relevant since the outbreak of the debt crises in the Eurozone and the Brexit referendum. The author critically subverts theories of European integration and analyses the rise and fall of federations, empires and states in a comparative perspective. The most promising theory presented here indicates that Brexit is not likely to be followed by other member states leaving the EU. Nevertheless, the EU has been undermined from within as it cannot adequately address Eurosceptic dissatisfaction from both the left and right. This book is an essential read for everyone interested in the EU and its future.

Book excerpt: Americans on both sides of the aisle love to reference the Constitution as the ultimate source of truth. But which truth? What did the framers really have in mind? In a book that author R.B. Bernstein calls “essential reading,” acclaimed historian Ray Raphael places the Constitution in its historical context, dispensing little-known facts and debunking popular preconceived notions. For each myth, Raphael first notes the kernel of truth it represents, since most myths have some basis in fact. Then he presents a big “BUT”—the larger context that reveals what the myth distorts. What did the framers see as the true role of government? What did they think of taxes? At the Constitutional Convention, how did they mix principles with politics? Did James Madison really father the Constitution? Did the framers promote a Bill of Rights? Do the so-called Federalist Papers reveal the Constitution's inner meaning? An authoritative and entertaining book, which “should appeal equally to armchair historians and professionals in the field” (Booklist), Constitutional Myths reveals what our founding document really says and how we should apply it today.

Book Democracy in Canada

Download or read book Democracy in Canada written by Donald J. Savoie and published by McGill-Queen's Press - MQUP. This book was released on 2019-09-02 with total page 432 pages. Available in PDF, EPUB and Kindle. Book excerpt: Canada's representative democracy is confronting important challenges. At the top of the list is the growing inability of the national government to perform its most important roles: namely mapping out collective actions that resonate in all regions as well as enforcing these measures. Others include Parliament's failure to carry out important responsibilities, an activist judiciary, incessant calls for greater transparency, the media's rapidly changing role, and a federal government bureaucracy that has lost both its way and its standing. Arguing that Canadians must reconsider the origins of their country in order to understand why change is difficult and why they continue to embrace regional identities, Democracy in Canada explains how Canada's national institutions were shaped by British historical experiences, and why there was little effort to bring Canadian realities into the mix. As a result, the scope and size of government and Canadian federalism have taken on new forms largely outside the Constitution. Parliament and now even Cabinet have been pushed aside so that policy makers can design and manage the modern state. This also accounts for the average citizen's belief that national institutions cater to economic elites, to these institutions' own members, and to interest groups at citizens' own expense. A masterwork analysis, Democracy in Canada investigates the forces shaping the workings of Canadian federalism and the country's national political and bureaucratic institutions.

  • Author : Dejan Jović
  • Publisher : Purdue University Press

  • Pages : 433 pages

Download or read book Yugoslavia written by Dejan Jović and published by Purdue University Press. This book was released on 2009 with total page 433 pages. Available in PDF, EPUB and Kindle. Book excerpt: "This book examines the emergence, implementation, crisis and the breakdown of the fourth (Kardelj's) constitutive concept of Yugoslavia (1974-1990), and relations between anti-statist ideology of self-management and the actual collapse of state institutions. Based on interviews with key members of former Yugoslavia's political elite, documents, and other primary sources, the book reconstructs the elite's motives and reasons for the actions that led to state collapse. Contrary to the dominant explanation of the collapse of Yugoslavia, the book argues that Yugoslavia did not collapse primarily because of the complexity of its ethnic structure, of changes in the international environment, or of a deep economic crisis. Although these factors provided the context in which the elite operated, it was the elite's perception of these problems that decisively influenced their decisions."--BOOK JACKET.
