Book Diritto penale ed enti collettivi

Download or read book Diritto penale ed enti collettivi written by Tommaso Guerini and published by G Giappichelli Editore. This book was released on 2018-03-27 with total page 289 pages. Available in PDF, EPUB and Kindle.

Book The Civilian Legacy of the Roman Army

Download or read book The Civilian Legacy of the Roman Army written by and published by BRILL. This book was released on 2024-06-27 with total page 528 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Roman army represented an important social and organizational reference model for the Romano-Barbarian societies, which progressively replaced the Western Empire in the transition from Late Antiquity to Early Middle Ages. The great flexibility of the decision-making and organizational solutions used by the Roman army allowed the ‘new lords’ to readapt them and thus maintain power in early medieval Europe for a long time. From a perspective ranging from political, social and economic history to law, anthropology, and linguistic, this book demonstrates how interesting and fruitful the investigation of this specific cultural imprint can be in order to gain a better understanding of the origins of the civilization that arouse after the fall of the Roman world. Contributors are Francesco Borri, Fabio Botta, Francesco Castagnino, Stefan Esders, Carla Falluomin, Stefano Gasparri, Wolfgang Haubrichs, Soazick Kerneis, Luca Loschiavo, Valerio Marotta, Esperanza Osaba, Walter Pohl, Jean-Pierre Poly, Pierfrancesco Porena, Iolanda Ruggiero, Andrea Trisciuoglio, Andrea A. Book Transformations in Criminal Jurisdiction

Download or read book Transformations in Criminal Jurisdiction written by Micheál Ó Floinn and published by Bloomsbury Publishing. This book was released on 2023-08-24 with total page 395 pages. Available in PDF, EPUB and Kindle. Book excerpt: Can traditional approaches to criminal jurisdiction adapt to the new global reality of the digital era? In this innovative book, leading experts in criminal, international and internet law unite to address this fundamental question. They consider how jurisdictional regimes are orientated around concepts of territoriality and extraterritoriality, how these categories are increasingly blurred in the digital era, and how a range of jurisdictional transformations are occurring in the process. Part I presents novel doctrinal, empirical and theoretical perspectives on criminal jurisdiction, exploring how states are shaping and reimagining jurisdictional concepts in the crafting and interpretation of criminal offences, and the ramifications of increasing jurisdictional concurrency in state practice. Part II focuses on the investigative and enforcement powers of the state to assess how these issues are transforming traditional understandings of jurisdictional rules and boundaries, the challenges and opportunities that these present for law enforcement authorities, and the sorts of constraints and safeguards that may be necessary as a result. The picture that emerges is a world of jurisdictional rules in a state of flux, which demands the diversity of legal perspectives presented in this book for documenting, rationalising and moving beyond the transformations that are taking shape in modern statecraft.

Available in PDF, EPUB and Kindle. Book excerpt: "Environmental crime is a growing challenge for policy makers and law enforcers. This is an important and timely study which examines in depth how environmental crime is treated at national level within the European Union and the impact of the 2008 EU Directive on environmental crime on national systems. It will be required reading by anyone concerned with making environmental law more effective." Richard Macrory, Emeritus Professor, University College London The aim of this important new collection is to explore how environmental crime is controlled and environmental criminal law is shaped and implemented within the European Union and its Member States. It examines the legal framework, looking in particular at Directive 2008/99/EC, and the specific competences of the EU in this domain. In addition, it provides a detailed analysis of environmental criminal law in seven Member States, focusing inter alia on the basic legislation, the way in which environmental pollution is criminalised and the main actors in place to enforce environmental criminal law. In so doing, it provides a much needed explanation of the evolution of environmental criminal law in Europe at Union level and how this is implemented in selected Member States.

Book The Role of Fraternity in Law

Download or read book The Role of Fraternity in Law written by Adriana Cosseddu and published by Routledge. This book was released on 2021-12-06 with total page 288 pages. Available in PDF, EPUB and Kindle. Book excerpt: This collection discusses the concept of fraternity and examines the issue of its role in law. Since the end of World War II, fraternity has been cited in several national constitutional charters, in addition to the United Nations Universal Declaration of Human Rights. But is there space for fraternity in law? The contributions to this book form an ideal “bridge” between the past and present to trace the different pathways taken to address the meaning of fraternity, and to identify its possible legal relevance. The book lays out paths that have placed fraternity in varied and challenging legal contexts in an age of globalization and conflict, where the multiplicity of national and supranational sources of law seems to show its inadequacy to govern complexity, and coexistence between diversities that appear irreconcilable. The purpose is not to recover fraternity as a forgotten principle, but to reimagine it today to address the aim and force of law within a plurality of cultures. The analysis considers a possible universal dimension that models unity within diversity, and aspires to serve as a prologue to a transition from research to dialogue between different legal systems and traditions. The book will be of interest to academics and researchers working in the areas of Comparative Law, Legal History and Legal Philosophy.
