These decisions are not available to the international community since they are not translated to English. Based on this gap, this original book illustrates the main rulings on human rights analyzed by great scholars in Brazil. The text presents a deep discussion regarding the characteristics of the cases and demonstrates how the STF has built the legal arguments to interpret the extension of the fundamental rights.

The politically active Base Ecclesial Communities and the progressive posture of the Roman Catholic Church contrasted with a steadily growing number of evangelicals, mostly aligned with the military regime but attractive precisely to the poor. After democratic transition in the mid-1980s, the context changed considerably. Democracy, growing religious pluralism and mobility, a vibrant civil society, the political ascension of the Worker's Party and growing wealth, albeit within a continuously wide social gap, are some of the elements that show the need of a new approach to theology. It must be a theology that is both critical and constructive, resisting and cooperative, a theology that is able to give orientation to the churches, valuing and encouraging their contribution in society while avoiding attempts of imposition. The Churches and Democracy in Brazil, the fruit of years of interdisciplinary study of the Brazilian context and its main churches and theology, makes its case for an ecumenically articulated public theology. It seeks inspiration mainly in Luther and Lutheran theology, emphasizing human dignity, freedom, trust, the disposition to serve, and the ability to endure the ambiguities of reality, as well as a fresh interpretation of the doctrine of the two regiments. These are the fundamental elements of what makes human beings full members of the body politic: citizenship, their right to have rights and to be able to effectively live them, together with their corresponding duties, in a move of growing political participation conscious of their religious motivation in view of the commonweal.

Book excerpt: In nineteenth-century Brazil the power of the courts rivaled that of the central government, bringing to it during its first half century of independence a stability unique in Latin America. Thomas Flory analyzes the Brazilian lower-court system, where the private interests of society and the public interests of the state intersected. Justices of the peace—lay judges elected at the parish level—played a special role in the early years of independence, for the post represented the triumph of Brazilian liberalism’s commitment to localism and decentralization. However, as Flory shows by tracing the social history and performance of parish judges, the institution actually intensified conflict within parishes to the point of destabilizing the local regime and proved to be so independent of national interests that it all but destroyed the state. By the 1840s the powers of the office were passed to state appointees, particularly the district judges. Flory recognizes these professional magistrates as a new elite who served as brokers between the state and the poorly articulated landowner elite, and his account of their rise reveals the mechanisms of state integration. In focusing on the judiciary, Flory has isolated a crucial aspect of Brazil’s early history, one with broad implications for the study of nineteenth-century Latin America as a whole. He combines social, intellectual, and political perspectives—as well as national-level discussion with scrutiny of parish-level implementation—and so makes sense of a complicated, little-studied period. The study clearly shows the progression of Brazilian social thought from a serene liberal faith in the people as a nation to an abiding, very modern distrust of that nation as a threat to the state.

Getúlio Vargas, from the pampas of the southern frontier state of Rio Grande do Sul, became the dictator who ruled without ever forgetting the lower classes. Vargas was a consummate artist at politics. He climbed the political ladder through seats in the state and national legislatures to the post of federal Finance Minister and to the governorship of Rio Grande do Sul. His career then took him to the National Palace as Provisional President and as Constitutional President, and later as the dictator of his "New State." After his deposition in 1945 and a period of semiretirement, his continuing widespread popularity resulted in his successful come-back campaign in 1950 for the Presidency on the Labor Party ticket. Vargas' contributions to Brazilian political and economic life were many and important. Taking advantage of the power which his political magic provided him, he brought Brazil from a loose confederacy of semifeudal states to a strongly centralized nation. He was a great eclectic, welding into his social, political, and economic policies what he found good in various programs. He was also a great opportunist in the sense that he adroitly took advantage of conditions and circumstances to effect his ends. He was intimately related to the revolutionary changes in Brazilian life after 1930. Vargas, "Father of the Brazilians," attributed achievements such as these to power in his own hands. His foes, however, still feared the political wizard, and they cheered the military when it deposed him. After his return, "on the arms of the people," Vargas saw that the armed forces were determined to repeat history, and in 1954 he chose another path—suicide. All of these exciting events are related in John W. F. Dulles's Vargas of Brazil: A Political Biography. Despite its emphasis on Vargas the politician and statesman, the reader comes to know Vargas the man. For this portrait of Vargas and of Brazil the author has drawn much material from State Department papers in the National Archives and from other public sources, and from interviews with numerous persons who were participants in the events he describes or observers of them. The result is an interesting, revealing, valid account of an important people. Many illustrations supplement the text.
