Book excerpt: The book traces the political history of the concept of social policy. „Social policy“ originated in Germany in the mid 19th century as a scholarly term that made a career in politics. The term became more prominent only after World War II. Kaufmann, the doyen of the sociology of social policy in Germany, argues that „social policy“ responds to the modern disjunction between “state” and “society” diagnosed by the German philosopher Hegel. Hegel’s disciple Lorenz von Stein saw social policy as a means to pacify the capitalist class conflict. After World War II, social policy expanded in an unprecedented way, changing its character in the process. Social policy turned from class politics into a policy for the whole population, with new concepts – like "social security", "redistribution" and "quality of life" - and new overarching formulas, "social market economy" and "social state" (the German version of “welfare state”). Both formulas have remained indeterminate and contested, indicating the inherent openness of the idea of the “social”.

The author unravels “layers” of social security that have piled up in the course of history and, so he argues, still linger in the present-day welfare state. The account begins with the first efforts by public authorities to regulate poverty and then proceeds to the “social question” that arose during the 19th-century Industrial Revolution. World War I had a major impact on the development of social security, both during the war and after, through the exigencies of the war economy, inflation and unemployment. The ruptures as well as the continuities of social policy under National Socialism and World War II are also investigated.

Invariably the indigenous elites drew upon British constitutional ideas and institutions regardless of the political conditions that prevailed in their very different lands. Many Asian nations called upon the services of Englishman and Law Professor Sir Ivor Jennings to advise or assist their own constitution making. Although he was one of the twentieth century’s most prominent constitutional scholars, his opinion and influence were often controversial and remain so due to his advocating British norms in Asian form. This book examines the process of constitutional formation in the era of decolonisation and state building in Asia.
