Download or read book Fundamentals of Legal Argumentation written by Eveline T. Feteris and published by Springer. This book was released on 2017-07-10 with total page 371 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book is an updated and revised edition of Fundamentals of Legal Argumentation published in 1999. It discusses new developments that have taken place in the past 15 years in research of legal argumentation, legal justification and legal interpretation, as well as the implications of these new developments for the theory of legal argumentation. Almost every chapter has been revised and updated, and the chapters include discussions of recent studies, major additions on topical issues, new perspectives, and new developments in several theoretical areas. Examples of these additions are discussions of recent developments in such areas as Habermas' theory, MacCormick's theory, Alexy's theory, Artificial Intelligence and law, and the pragma-dialectical theory of legal argumentation. Furthermore it provides an extensive and systematic overview of approaches and studies of legal argumentation in the context of legal justification in various legal systems and countries that have been important for the development of research of legal argumentation. The book contains a discussion of influential theories that conceive the law and legal justification as argumentative activity. From different disciplinary and theoretical angles it addresses such topics as the institutional characteristics of the law and the relation between general standards for moral discussions and legal standards such as the Rule of Law. It discusses patterns of legal justification in the context of different types of problems in the application of the law and it describes rules for rational legal discussions. The combination of the sound basis of the first edition and the discussions of new developments make this new edition an up-to-date and comprehensive survey of the various theoretical influences which have informed the study of legal argumentation. It discusses salient backgrounds to this field as well as major approaches and trends in the contemporary research. It surveys the relevant theoretical factors both from various continental law traditions and common law countries.

This book was released on 2014-03-13 with total page 442 pages. Available in PDF, EPUB and Kindle.

Download or read book The Legal Reasoning of the Court of Justice of the EU written by Gunnar Beck and published by Bloomsbury Publishing. This book was released on 2013-01-21 with total page 486 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Court of Justice of the European Union has often been characterised both as a motor of integration and a judicial law-maker. To what extent is this a fair description of the Court's jurisprudence over more than half a century? The book is divided into two parts. Part one develops a new heuristic theory of legal reasoning which argues that legal uncertainty is a pervasive and inescapable feature of primary legal material and judicial reasoning alike, which has its origin in a combination of linguistic vagueness, value pluralism and rule instability associated with precedent. Part two examines the jurisprudence of the Court of Justice of the EU against this theoretical framework. The author demonstrates that the ECJ's interpretative reasoning is best understood in terms of a tripartite approach whereby the Court justifies its decisions in terms of the cumulative weight of purposive, systemic and literal arguments. That approach is more in line with orthodox legal reasoning in other legal systems than is commonly acknowledged and differs from the approach of other higher, especially constitutional courts, more in degree than in kind. It nevertheless leaves the Court considerable discretion in determining the relative weight and ranking of the various interpretative criteria from one case to another. The Court's exercise of its discretion is best understood in terms of the constraints imposed by the accepted justificatory discourse and certain extra-legal steadying factors of legal reasoning, which include a range of political factors such as sensitivity to Member States' interests, political fashion and deference to the 'EU legislator'. In conclusion, the Court of Justice of the EU has used the flexibility inherent in its interpretative approach and the choice it usually enjoys in determining the relative weight and order of the interpretative criteria at its disposal, to resolve legal uncertainty in the EU primary legal materials in a broadly communautaire fashion subject, however, to i) regard to the political, constitutional and budgetary sensitivities of Member States, ii) depending on the constraints and extent of interpretative manoeuvre afforded by the degree of linguistic vagueness of the provisions in question, the relative status of and degree of potential conflict between the applicable norms, and the range and clarity of the interpretative topoi available to resolve first-order legal uncertainty, and, finally, iii) bearing in mind the largely unpredictable personal element in all adjudication. Only in exceptional cases which the Court perceives to go to the heart of the integration process and threaten its acquis communautaire, is the Court of Justice likely not to feel constrained by either the wording of the norms in issue or by the ordinary conventions of interpretative argumentation, and to adopt a strongly communautaire position, if need be in disregard of what the written laws says but subject to the proviso that the Court is assured of the express or tacit approval or acquiescence of national governments and courts.

Download or read book Religious Individualisation written by Martin Fuchs and published by Walter de Gruyter GmbH & Co KG. This book was released on 2019-12-16 with total page 1086 pages. Available in PDF, EPUB and Kindle. Book excerpt: This volume brings together key findings of the long-term research project ‘Religious Individualisation in Historical Perspective’ (Max Weber Centre for Advanced Cultural and Social Studies, Erfurt University). Combining a wide range of disciplinary approaches, methods and theories, the volume assembles over 50 contributions that explore and compare processes of religious individualisation in different religious environments and historical periods, in particular in Asia, the Mediterranean, and Europe from antiquity to the recent past. Contrary to standard theories of modernisation, which tend to regard religious individualisation as a specifically modern or early modern as well as an essentially Western or Christian phenomenon, the chapters reveal processes of religious individualisation in a large variety of non-Western and pre-modern scenarios. Furthermore, the volume challenges prevalent views that regard religions primarily as collective phenomena and provides nuanced perspectives on the appropriation of religious agency, the pluralisation of religious options, dynamics of de-traditionalisation and privatisation, the development of elaborated notions of the self, the facilitation of religious deviance, and on the notion of dividuality.
Download or read book The New Cambridge Medieval History Volume 6 C 1300 c 1415 written by Rosamond McKitterick and published by Cambridge University Press. This book was released on 1995 with total page 1186 pages. Available in PDF, EPUB and Kindle. Book excerpt: The sixth volume of The New Cambridge Medieval History covers the fourteenth century, a period dominated by plague, other natural disasters and war which brought to an end three centuries of economic growth and cultural expansion in Christian Europe, but one which also saw important developments in government, religious and intellectual life, and new cultural and artistic patterns. Part I sets the scene by discussion of general themes in the theory and practice of government, religion, social and economic history, and culture. Part II deals with the individual histories of the states of western Europe; Part III with that of the Church at the time of the Avignon papacy and the Great Schism; and Part IV with eastern and northern Europe, Byzantium and the early Ottomans, giving particular attention to the social and economic relations with westerners and those of other civilisations in the Mediterranean.

Download or read book Contemporary German Legal Philosophy written by James E. Herget and published by University of Pennsylvania Press. This book was released on 2017-11-15 with total page 164 pages. Available in PDF, EPUB and Kindle. Book excerpt: James Herget explains to American legal scholars and students the main points of the characteristic legal philosophy that has developed in the German-speaking world since World War II. After a historical introduction and overview, he discusses critical rationalism, discourse theory, rhetorical theory, systems theory, and institutional legal positivism. He concludes with a general assessment and appends biographical information. Written for American legal scholars and students, who traditionally are exposed only to filtered versions of comparative legal traditions, this volume introduces a new world of legal theory that resonates within the context of other contemporary disciplines and German intellectual history.
Download or read book Conciliar Diplomacy at the Council of Constance 1414 1418 written by Phillip Stump and published by BRILL. This book was released on 2024-05-30 with total page 313 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book re-tells the story of how the Council of Constance ended the greatest Schism in Western Christendom. Using a nuanced and critical analysis of the primary sources, it reframes this drama with the Council itself as the principal actor. The Council performed its own legitimacy and its unity through a process of consensual decision-making and by conducting its own, previously little noticed, diplomacy. It succeeded where previous attempts to end the Schism had failed through its collective.
Download or read book Councils of the Catholic Reformation written by Nelson H. Minnich and published by Taylor & Francis. This book was released on 2024-10-28 with total page 329 pages. Available in PDF, EPUB and Kindle. Book excerpt: This new collection by Nelson Minnich deals with the general councils of the Catholic Reformation in the late medieval and early modern periods. The volume opens with overviews of the various editions of and current scholarship on these general councils. Three studies then give special attention to the role of theologians in these councils: their changing legal status (consultative or deliberative voting rights) and their individual roles and those of the various theological schools in drafting the decrees. Another article examines the legal status of theologians accused of heresy and schism. Two examine the contest between the councils of Pisa-Milan-Asti-Lyon and Lateran V for legitimacy, studying in particular the contrasting image of Julius II (suspended for contumacy by Pisa but the strong leader of Lateran V) and the role ceremonies played in securing legitimacy. Last, there are three studies devoted to the Council of Trent: the status of the Protestants who came to the council, its debates on the priesthood of all believers, and the influence of Lateran V on its procedures, debates, and decrees.
Download or read book Sermo Iuris Rechtssprache und Recht in der augusteischen Dichtung written by Ulrich C.J. Gebhardt and published by BRILL. This book was released on 2009-08-31 with total page 432 pages. Available in PDF, EPUB and Kindle. Book excerpt: Law played a key role in the workings of Roman culture, and legal discourse was important even in non-legal Latin literature. A proper understanding of that literature requires an investigation of the ways legal language is used. Nevertheless, legal elements have so far been widely neglected by scholars of Latin literature, in particular Augustan poetry. After an examination of legal language as a technical discourse and its role in Latin prose, the present book is devoted to a detailed analysis of legal language and imagery in the work of the Augustan poets. It will, therefore, allow for a better appreciation of these poems as well as of their significance for Augustan culture in the broad sense.
Download or read book Fundamentals of Argumentation Theory written by Frans H. van Eemeren and published by Routledge. This book was released on 2013-11-05 with total page 439 pages. Available in PDF, EPUB and Kindle. Book excerpt: Argumentation theory is a distinctly multidisciplinary field of inquiry. It draws its data, assumptions, and methods from disciplines as disparate as formal logic and discourse analysis, linguistics and forensic science, philosophy and psychology, political science and education, sociology and law, and rhetoric and artificial intelligence. This presents the growing group of interested scholars and students with a problem of access, since it is even for those active in the field not common to have acquired a familiarity with relevant aspects of each discipline that enters into this multidisciplinary matrix. This book offers its readers a unique comprehensive survey of the various theoretical contributions which have been made to the study of argumentation. It discusses the historical works that provide the background to the field and all major approaches and trends in contemporary research. Argument has been the subject of systematic inquiry for twenty-five hundred years. It has been graced with theories, such as formal logic or the legal theory of evidence, that have acquired a more or less settled provenance with regard to specific issues. But there has been nothing to date that qualifies as a unified general theory of argumentation, in all its richness and complexity. This being so, the argumentation theorist must have access to materials and methods that lie beyond his or her "home" subject. It is precisely on this account that this volume is offered to all the constituent research communities and their students. Apart from the historical sections, each chapter provides an economical introduction to the problems and methods that characterize a given part of the contemporary research program. Because the chapters are self-contained, they can be consulted in the order of a reader's interests or research requirements. But there is value in reading the work in its entirety. Jointly authored by the very people whose research has done much to define the current state of argumentation theory and to point the way toward more general and unified future treatments, this book is an impressively authoritative contribution to the field.
