Im Bereich des Bildungsrechtes spannt sich der analytische Bogen vom Schulrecht uber das Fachhochschul- bis hin zum Universitatsrecht. Von besonderem Interesse sind dabei u. a. Fragen betreffend Staatsverantwortung und Hochschulsystem und die Umbauprozesse im Hochschulzugang bzw. in der Hochschulzulassung.Ein weiterer Schwerpunkt ist die Frage nach den Funktionen des Rechts in Staat und Wirtschaft. Auch in diesen Bereichen mussen wissensbasierte Veranderungen in ihren rechtlichen und okonomischen Implikationen wissenschaftlich durchdrungen werden. Einerseits hat die Wirtschaft schnelllebige und veranderte Anspruche an die Wissensproduktion (Umweltrecht, Energierecht, Weltraumrecht etc.). Andererseits gerat auch die staatliche Aufgabenbesorgung hinsichtlich der Anwendung wissensbasierter Technologien zunehmend unter Dynamisierungsdruck. Dies bezieht sich nicht nur auf klassische Bereiche des E-Government, sondern auch auf die Bereiche der finanziellen Kontrolle und der politischen Willensbildung. Auf der Ebene der politischen Willensbildung ist daruber hinaus noch ein weiterer signifikanter Veranderungsdruck gegeben, namlich die Verwirklichung geschlechterdemokratischer Strukturen.Minderheiten in einem veranderten gesellschaftlichen Umfeld sind Inhalt eines dritten Themenschwerpunktes. Analysiert werden einerseits die Vorteile fur eine Gesellschaft, die sich dem "diversity"-Gedanken verpflichtet fuhlt, andererseits aber auch die Herausforderungen, die mit der Umsetzung dieses gesellschaftspolitischen Ansatzes verbunden sind. Im Zentrum dieser Uberlegungen stehen insbesondere Religionsvielfalt und Multikulturalitat.

Focusing on the discrepancy between the hypertrophically symbolic function of constitutions and their insufficient legal concretization, it offers a critical counterpoint to constitutional theory that treats constitutional texts as a panacea to solving political, legal, and social problems. In contrast to the premises of Niklas Luhmann's systems theory regarding law and constitution in world's society, symbolic constitutionalization is approached here in both a comprehensive and far-reaching perspective. Chapter 1 sets out the debate about symbolic legislation. Chapter 2 explains the notion of symbolic constitutionalization as a problem embracing the whole legal system. Chapter 3 approaches the issue in terms of allopoiesis of law, characterizing it primarily as a problem in peripheral modernity and referring to the Brazilian experience. The final chapter discusses the tendency to a symbolic constitutionalization of world society in the scope of a paradoxical peripheralization of the centre.

As more and more countries adopt Human Rights legislation and accede to international human rights agreements, and as the European Union introduces its own Bill of Rights, judges struggle to implement these rights consistently and sometimes the reasoning behind them is lost. Examining the practice in other jurisdictions can be a valuable guide. Robert Alexy's classic work reconstructs the reasoning behind the jurisprudence of the German Basic Law and in doing so provides a theory of general application to all jurisdictions where judges wrestle with rights adjudication. In considering the features of constitutional rights reasoning, the author moves from the doctrine of proportionality, procedural rights and the structure and scope of constitutional rights, to general rights of liberty and equality and the problem of horizontal effect. A postscript written for the English edition considers critiques of the Theory since it first appeared in 1985, focusing in particular on the discretion left to legislatures and in an extended introduction the translator argues that the theory may be used to clarify the nature of legal reasoning in the context of rights under the British Constitution.

What accounts for compliance beyond the nation-state? The authors tackle this question by comparing compliance with regulations that have been formulated in a very similar way at different levels of governance. They test compliance with rules at the national level, at the regional level (EU), and at a global level (WTO), finding that in fact the EU has higher levels of compliance than both international and national rules. The authors argue that this is because the EU has a higher level of legalization, combined with effective monitoring mechanisms and sanctions. In this respect it seems that the European Union has indeed achieved a high level of legalization and compliance, though the authors add that this achievement does not settle the related queries with the legitimacy of transnational governance and law.
