After more than ten years of preparation, China recently adopted its first nationwide contaminated land law—the Law of the People’s Republic of China on the Prevention and Control of Soil Contamination, which entered into effect in the beginning of 2019. The law deals exclusively with risk management in connection with soil contamination, and the remediation of contaminated land. This book analyzes various facets of how China is managing the risks associated with soil contamination and remediating contaminated sites by means of legislation. Chapters 1 and 2 reveal the current extent of the soil contamination problem in China and the initial policy responses of the country’s central government. In turn, Chapters 3 and 4 address the regulatory frameworks and the latest contaminated land legislation at both the local and national level. Lastly, Chapters 5 through 9 offer concrete recommendations, based on lessons learned in the US and UK, for reforming contaminated land management in China. It is still heavily reliant on general environmental protection legislation to regulate soil- or land-polluting activities and it is becoming increasingly evident that contaminated land issues should be addressed in a more cohesive and equitable national framework. The US Congress enacted the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) in 1980 to regulate remediation and redevelopment of contaminated sites. This groundbreaking legislation delineates a complex and far-reaching liability scheme for various potential responsible parties. However, throughout its history CERCLA's defining features imposing 'strict, joint and several, and retroactive liability' have been roundly criticised for resulting in limited coverage of claims, curtailment of statutory defences, unfairness to innocent parties and high transaction costs. China has already incorporated several key liability standards for example strict liability and joint and several liability provisions; however, the regimes developed in both jurisdictions remain problematic and in many cases ineffective. Bearing in mind the lessons learned from CERCLA, this article argues that a more flexible contaminated land liability regime might be appropriate for China. A number of criteria should be considered in the development of China's nationwide contaminated land legislation, which include: adoption of the 'polluter pays' principle; establishment of the 'retroactive liability' on a firm legal basis; adoption of joint and several liability; and establishment of 'state liability' within China. In particular, the profound social and economic transformation in China must be taken into account in both the design and development of a contaminated land liability regime and this article highlights some of the important issues in this regard.

While a proper contaminated land liability mechanism is being developed, the principles of state liability and retroactive liability, and the principle that polluters pay should be followed. Public participation should be encouraged in contaminated land management.

Groundwater management is a formidable challenge, one that remains one of humanity’s foremost priorities. It has become a largely non-renewable resource that is overexploited in many parts of the world. In the 21st century, the issue moves from how to simply obtain the water we need to how we manage it sustainably for future generations, future economies, and future ecosystems. The focus then becomes one of understanding the drivers and current state of the groundwater resource, and restoring equilibrium to at-risk aquifers. Many interrelated dimensions, however, come to bear when trying to manage groundwater effectively. An integrated approach to groundwater necessarily involves many factors beyond the aquifer itself, such as surface water, water use, water quality, and ecohydrology. Moreover, the science by itself can only define the fundamental bounds of what is possible; effective IGM must also engage the wider community of stakeholders to develop and support policy and other socioeconomic tools needed to realize effective IGM. In order to demonstrate IGM, this book covers theory and principles, embracing: 1) an overview of the dimensions and requirements of groundwater management from an international perspective; 2) the scale of groundwater issues internationally and its links with other sectors, principally energy and climate change; 3) groundwater governance with regard to principles, instruments and institutions available for IGM; 4) biophysical constraints and the capacity and role of hydroecological and hydrogeological science including water quality concerns; and 5) necessary tools including models, data infrastructures, decision support systems and the management of uncertainty. Examples of effective, and failed, IGM are given. Throughout, the importance of the socioeconomic context that connects all effective IGM is emphasized. Taken as a whole, this work relates the many facets of effective IGM, from the catchment to global perspective.
