A key objective of the paper is to examine which aspects of the rights interface merit further research. In comparing the two regimes a final subsidiary objective of this paper is to try and identify which areas, if any, in one sector can shed light on areas for future research in the other.

Book excerpt: The Clean Water Act (CWA) requires that wetlands be protected from degradation because of their important ecological functions including maintenance of high water quality and provision of fish and wildlife habitat. However, this protection generally does not encompass riparian areasâ€"the lands bordering rivers and lakesâ€"even though they often provide the same functions as wetlands. Growing recognition of the similarities in wetland and riparian area functioning and the differences in their legal protection led the NRC in 1999 to undertake a study of riparian areas, which has culminated in Riparian Areas: Functioning and Strategies for Management. The report is intended to heighten awareness of riparian areas commensurate with their ecological and societal values. The primary conclusion is that, because riparian areas perform a disproportionate number of biological and physical functions on a unit area basis, restoration of riparian functions along America's waterbodies should be a national goal.

Book excerpt: Water resources were central to England's precocious economic development in the thirteenth and sixteenth centuries, and then again in the industrial, transport, and urban revolutions of the late eighteenth and early nineteenth centuries. Each of these periods saw a great deal of legal conflict over water rights, often between domestic, agricultural, and manufacturing interests competing for access to flowing water. From 1750 the common-law courts developed a large but unstable body of legal doctrine, specifying strong property rights in flowing water attached to riparian possession, and also limited rights to surface and underground waters. The new water doctrines were built from older concepts of common goods and the natural rights of ownership, deriving from Roman and Civilian law, together with the English sources of Bracton and Blackstone. Water law is one of the most Romanesque parts of English law, demonstrating the extent to which Common and Civilian law have commingled. Water law stands as a refutation of the still-common belief that English and European law parted ways irreversibly in the twelfth century. Getzler also describes the economic as well as the legal history of water use from early times, and examines the classical problem of the relationship between law and economic development. He suggests that water law was shaped both by the impact of technological innovations and by economic ideology, but above all by legalism.

This book questions the fundamental assumption that ‘the law’ only applies to humans, and that the earth, as a system, has intrinsic rights and responsibilities. In the last ten years the planet has experienced its hottest period since human evolution, and by the year 2100, unless substantive action is taken, many species will be lost, and planetary conditions will be intolerable for human civilisation as it currently exists. Relationships between humans, the biosphere, and all planetary systems must change. The authors address these challenging topics, setting the groundwork of ESL to ensure sustainable development of the coupled socio-ecological system that the Earth has become. Earth System Law is an interdisciplinary and transdisciplinary research project, and, as such, this book will be of great interest to researchers and stakeholders from a wide range of disciplines, including political science, anthropology, economics, law, ethics, sociology, and psychology.

As the population grows and demand for water rises, reliance on groundwater increases. In many cases the groundwater underlies boundaries, or is part of a hydraulic system that crosses boundaries. In such cases there is always the danger that the 'prisoner's dilemma' will run its course and all parties will compete over who will pump the most water, ultimately destroying the storage potential to the detriment of future generations of all parties reliant on the groundwater. This book explores the options and means for averting this all too realistic scenario by managing these shared groundwater resources. Nowhere is the likelihood of excessive use of groundwater greater than in the water-scarce Middle East, and especially in the Israeli-Palestinian case. Here both sides are heavily reliant on a shared aquifer, the Mountain aquifer. This book is the outcome of a seven-year effort to find ways to manage the Mountain aquifer, perhaps the most important resource shared by Israelis and Palestinians. As part of this cooperative study, four workshops were held in which a selected number of Palestinian, Israeli, and foreign experts were invited. The chapters in this book were originally presented in one of these workshops. To these papers introductory and concluding chapters were added.

Nearly 500 full color plates representing illustrations from gardens in more than 30 countries are provided to assist and guide students and other interested individuals with history and the fundamental issues of public garden management. The 15 chapters begin with the need for public gardens, types of public gardens, historical backgrounds, as well as design diversity. Numerous quotations are included from many garden lovers, landscape architects, philosophers, and others. The authors primary aim in writing this book was based on the confidence that a relevant reference, between the encyclopedic nature of some and the specific subject matter of others, could be used to provide fundamental information for management of public as well as private gardens. The boundary between botanical and zoological gardens and parks is no longer as distinct as it once was. In part it is because a garden is not a garden without plants and in part it has become apparent that for all practical intents and purposes all animals need plants for their survival. Visitors of zoological gardens expect to see more than just animals; zoos are landscaped grounds. Moreover, most communities find it financially difficult to simultaneously operate a botanical garden or an arboretum as well as a zoological garden and city parks. A number of public gardens are currently referred to as botanical and zoological garden. Population density and the publics desires and expectations, as well as financial requirements, are among the reasons for some major city parks, such as Golden Gate in San Francisco, Central Park in New York City, and Lincoln Park in Chicago which integrate botanical or zoological divisions as well as museums and recreational facilities.
