Book excerpt: Georges Abi-Saab began his writing and teaching at a time when the process of decolonization, and thereafter the quest for emancipation, began to make its far-reaching impact on the international scene, producing significant changes in the international environment, both quantitatively in increasing the number of nation-States and qualitatively in changing patterns of interests and claims. This was bound to result in new pressures on the international legal system itself and in a questioning of the traditional Eurocentric content of international law. In his work and teaching Professor Abi-Saab viewed the dynamics of international law as a function of two driving forces: the emergence of the third world and the sense of injustice. In his view, the first driving force - the emergence of the third world - raised the problem of exclusion: exclusion from participation in the elaboration of international law and the decision-making process, and exclusion as beneficiaries of the resulting rules of international law. At the same time, this new force introduced diversity into the international scene, reflecting the richness of the international community in its different facets. This process remains relevant today, reflecting the contemporary problem of exclusion of new actors as well as their quest for participation. The second driving force - the sense of injustice - posed a teleological problem for him, that of defining community values in order that they capture the different facets of justice, whether formal or distributive. So long as there is no effective organic structure, international law in his view will continue to remain effectiveness-oriented, reflecting rather than impacting on the structures of power. Nevertheless, it is undeniable that there is an on-going process of development of community values and interests; as Georges Abi-Saab wrote with reference to international crimes: `law, like all social phenomena, is a continuous unfolding, a continuous process of elaboration'. He has also considered that the dynamics of the international legal process itself can be captured from the perspective of international organizations as vehicles for change in the international system. From his early writings, Georges Abi-Saab approached the United Nations Charter as a blueprint - both normative and institutional - for a certain type of international society. International institutions with all their imperfections, continue for him to be the means of realization of the law of cooperation which lies at the heart of his concept of the international system. The themes selected for this volume in honour of Professor Georges Abi-Saab are intended to reflect his unique and pioneering contribution to the field of international law. The contributors are drawn from what he has always considered to be his large `family' of former students: in his forty years of teaching, Georges Abi-Saab has acted as mentor to generations of students from all over the world who have benefited from his vision, insights, originality and creative and stimulating use of language. The contributors also include colleagues and friends who share a similar vision of the international legal system.

Le péril n’est pas seulement contre Haïti! La construction d’un leadership national capable et humaniste s’impose.

Alongside a comprehensive introduction by the editors outlining the scope of the relevant debates, the volume contains 14 chapters, split into four sections. This volume pushes forward a number of important debates on responsibility and its role in contemporary healthcare. The first and second groups of chapters focus, respectively, on (a) the potential justification and (b) nature of 'responsibility-sensitive' policies in healthcare provision; in other words, policies that would hold some patients responsible for their ill health via differences in treatment. These sections include empirically-informed work on public opinion, chapters linking responsibility in healthcare with ongoing debates around criminal responsibility, and new conceptual and theoretical work on the details of responsibility-sensitive policies. Book excerpt: When many people are involved in an activity, it is often difficult, if not impossible, to pinpoint who is morally responsible for what, a phenomenon known as the ‘problem of many hands.’ This term is increasingly used to describe problems with attributing individual responsibility in collective settings in such diverse areas as public administration, corporate management, law and regulation, technological development and innovation, healthcare, and finance. This volume provides an in-depth philosophical analysis of this problem, examining the notion of moral responsibility and distinguishing between different normative meanings of responsibility, both backward-looking (accountability, blameworthiness, and liability) and forward-looking (obligation, virtue). Drawing on the relevant philosophical literature, the authors develop a coherent conceptualization of the problem of many hands, taking into account the relationship, and possible tension, between individual and collective responsibility. This systematic inquiry into the problem of many hands pertains to discussions about moral responsibility in a variety of applied settings.

In many developing countries conventional wisdom concluded that development is best achieved through a centralised development strategy. The failure of this centralised development strategy has brought about the emergence of decentralisation to local government as one of the means to turn the tide of underdevelopment. This book presents decentralisation not only as a manifestation of 'good governance', but also as an indispensable tool towards development. The central question, however, is the following: how should the transitional state convert this into constitutional and legal arrangements? The author proposes a model for capturing the developmental role of local government in institutional arrangements. The new design for local government, put forward in South Africas 1997 Constitution, is based on the notion that local government should be the epicentre of development. This has prompted the author to use this South African concept as well as the first experiences with the implementation of the new local government dispensation as a case study.The importance of the book thus lies in the fact that it produces an institutional model for developmental local government that is not only based on development and decentralisation theories but is also tested in practice. It is hoped that those with an interest in the role of the state in development will find the arguments and conclusions useful. The book also provides a comprehensive overview of the South African design for local government, which is of interest to lawyers, policy makers and other parties involved in the implementation of the South African decentralisation strategy. Jaap de Visser teaches public law at the Law Faculty of Utrecht University in the Netherlands. Until the end of 2002, he worked as a researcher for the Community Law Centre (University of the Western Cape), specialising in local government law.
