Book National Socialist Criminal Law

Download or read book National Socialist Criminal Law written by Kai Ambos and published by Nomos Verlag. This book was released on 2019-09-27 with total page 207 pages. Available in PDF, EPUB and Kindle. "neue Rechte" schließt daran nahtlos an.

Book The Colombian Peace Process and the Principle of Complementarity of the International Criminal Court

Download or read book The Colombian Peace Process and the Principle of Complementarity of the International Criminal Court written by Kai Ambos and published by Springer Science & Business Media. This book was released on 2010-06-30 with total page 168 pages. Available in PDF, EPUB and Kindle. Book excerpt: Striking a balance between peace and justice has long been debated by scholars and practitioners. There has been definite progress in a world in which blanket amnesties were at times granted with little hesitation. There is a growing understanding that accountability has both pragmatic and principled arguments in its favor. Practical arguments as much as shifts in norms have created a situation in which the choice is increasingly seen as "which forms of accountability" rather than a stark one between peace and justice. The Colombian Justice and Peace Law 975 and its implementation offer an interesting and unique approach to dealing with the international crimes committed in Colombia’s decades-long armed conflict. Yet, will this approach suffice with regard to Colombia’s obligations under international law to investigate and prosecute international crimes? Does it meet the standards of the ICC, which has been monitoring the Colombian situation for some time now? In particular, does it pass the complementarity test laid out in the ICC statute or will the ICC have to intervene in Colombia to enforce international criminal law?

Book The Triggering Procedure of the International Criminal Court

Download or read book The Triggering Procedure of the International Criminal Court written by Héctor Olásolo and published by Martinus Nijhoff Publishers. This book was released on 2005 with total page 423 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Rome Statute, unlike the statutes of the International Criminal Tribunals for the former Yugoslavia and for Rwanda, creates a permanent court whose dormant jurisdiction covers the territory and includes the nationals of States Parties and is universal in cases where the Security Council makes a referral. Besides, unlike the "ad hoc" tribunals, which have jurisdiction over specific crisis situations whose personal, territorial and temporal parameters have been defined in their respective statutes by the UN Security Council, in the case of the ICC it is not possible to determine a priori in which situations the ICC will be involved. As a result, the most relevant activity of the Court is the determination of those situations regarding which the dormant jurisdiction of the Court will be triggered. The book "The Triggering Procedure of the International Criminal Court" constitutes the first comprehensive analysis of the proceedings that, prior to any criminal investigation, aim to make such a fundamental determination.

Book Encyclopedia Corruption in the World

Download or read book Encyclopedia Corruption in the World written by Judivan J. Vieira and published by AuthorHouse. This book was released on 2018-04-18 with total page 158 pages. Available in PDF, EPUB and Kindle. Book excerpt: The publication of this book collection by Prof. Judivan J. Vieira, PhD, is driven more by mission than editorial pursuits. The research is composed of five volumes, and it is the result of the authors willful work in a field of study that has been his passion since his graduation in law school in 1993. Corruption is inherent to the human being, and according to the author, it is a metastatic cancer within the rights of a democratic society. Throughout the five volumes, Judivan Vieira analyzes the various perspectives of this disease that delays and wipes out nonhegemonic countries and threatens developed countries. In the last volume of the collection, the author offers the solution to remediate this disease of the soul, which prevents social well-being and relegates us to live in formal democracies.

Download or read book Afterlives of Confinement written by Susana Draper and published by University of Pittsburgh Pre. This book was released on 2015-08-15 with total page 249 pages. Available in PDF, EPUB and Kindle. Book excerpt: During the age of dictatorships, Latin American prisons became a symbol for the vanquishing of political opponents, many of whom were never seen again. In the postdictatorship era of the 1990s, a number of these prisons were repurposed into shopping malls, museums, and memorials. Susana Draper uses the phenomenon of the "opening" of prisons and detention centers to begin a dialog on conceptualizations of democracy and freedom in post-dictatorship Latin America. Focusing on the Southern Cone nations of Uruguay, Chile, and Argentina, Draper examines key works in architecture, film, and literature to peel away the veiled continuity of dictatorial power structures in ensuing consumer cultures. The afterlife of prisons became an important tool in the "forgetting" of past politics, while also serving as a reminder to citizens of the liberties they now enjoyed. In Draper's analysis, these symbols led the populace to believe they had attained freedom, although they had only witnessed the veneer of democracy—in the ability to vote and consume. In selected literary works by Roberto Bola–o, Eleuterio Fernandez Huidoboro, and Diamela Eltit and films by Alejandro Agresti and Marco Bechis, Draper finds further evidence of the emptiness and melancholy of underachieved goals in the afterlife of dictatorships. The social changes that did not occur, the inability to effectively mourn the losses of a now-hidden past, the homogenizing effects of market economies, and a yearning for the promises of true freedom are thematic currents underlying much of these texts. Draper's study of the manipulation of culture and consumerism under the guise of democracy will have powerful implications not only for Latin Americanists but also for those studying neoliberal transformations globally.

Book Criminology and Post Mortem Studies

Download or read book Criminology and Post Mortem Studies written by Sara Palermo and published by BoD – Books on Demand. This book was released on 2021-10-20 with total page 228 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book is not a handbook of criminology and forensic medicine but rather a tool that reviews socio-historical and scientific data and notes of methodology based on the different sciences aimed at the study of crime in all its many facets (sociology, jurisprudence, criminalistics, psychology, forensic neuroscience, and forensic medicine). The chapters deal with single aspects of the subject, such as juvenile delinquency, fraud, and the relationship between society, individual personality, and sexual criminal behavior. They then go into more detail, analyzing individual aspects of legal medicine in light of the evolution of the discipline between the 20th and 21st centuries, including infant and adult post-mortem examination and genetic DNA identification.
