Book excerpt: Uno de los temas jurídicos menos tratados en Iberoamérica por la doctrina y la jurisprudencia es el que se refiere al derecho penal del trabajo, a pesar de los enormes abusos y violaciones a los derechos de los trabajadores formales e informales en nuestro medio, todo ello, a partir de un sistema económico que desprotege estructuralmente los derechos fundamentales de las personas inmersas en las relaciones de trabajo. El presente trabajo académico busca estudiar la necesidad de reforzar el derecho penal del trabajo en nuestro medio, determinar y estudiar la clase de comportamientos que deberían ser sancionados en este especial ámbito jurídico, analizar el alcance del bien jurídico protegido, los vacíos legales que se advierten en esta materia y la relación que debe existir en entre el derecho penal y el derecho laboral, en clave de los principios de subsidiariedad y ultima ratio. Además, es una importante oportunidad para reflexionar sobre la eficacia de esta clase de delitos frente a acciones constitucionales como la acción de tutela y las acciones ordinarias de naturaleza laboral. Las reflexiones aquí recopiladas también ponen de presente la peligrosa separación que existe entre la protección semántica de los derechos laborales (en particular la libertad laboral, la integridad de los trabajadores y los derechos de huelga y asociación), y la protección real de tales derechos en la práctica por parte de los tribunales, a lo cual, sin duda, contribuye el poco desarrollo del tema por parte de la doctrina nacional. Precisamente, esta separación entre las normas jurídicas y la protección real de los derechos laborales se alimenta de la indiferencia social, usualmente acompañada por una actitud hostil contra la protección de la clase trabajadora, que tiene consecuencias negativas en nuestra sociedad.
