No sabemos muy bien qué son o hasta dónde alcanzan los delitos económicos pero sí que no obstante son objeto de especial preocupación social y atención judicial y académica. La sociedad está alarmada por la delincuencia económica y los cada vez más minuciosos y brillantes estudios doctrinales no hacen sino reflejar dicha consternación y tratar de paliarla con nuevas propuestas legislativas o con mejores lecturas de los tipos penales existentes.Preocupa la delincuencia económica y de la empresa como delincuencia “de ricos”, de “cuello blanco”, rasgo criminológico que resta comprensión y suma indignación a la irregularidad movida por el lucro. Preocupa también por su imbricación en la corrupción pública: por la percepción de que ciertos delitos económicos terminan haciendo tambalear nuestras instituciones democráticas. Y preocupa también, ahora académicamente y en un cierto sentido inversamente, el que tal preocupación provoque una reacción normativa e interpretativa que debilite las asentadas garantías sustantivas y procesales.

The author also examines current international mechanisms to combat money-laundering; whether these efforts have been successful or unsuccessful; and whether multilateral instruments are an effective tool in the war against international organized crime. As national borders have opened and trade barriers have fallen, transnational crime has grown at unprecedented levels. The current situation, better revealed by the so-called “Panama Papers,” is a result of a lack of local cooperation in the investigations, prosecution, and/or extradition of criminals. Governments profit from ill-gotten wealth hosting international criminal enterprises in their own territories, thus providing a fertile ground for illicit practices, closing their eyes to the nexus among false or inappropriate identification, fraudulent records, corruption, and money laundering. The first part is a comparative study regarding the lawfulness of multiple sanctioning systems under the ne bis in idem, studying the evolution and the current state of the case law of the United States Supreme Court, the Canadian Supreme Court, the European Court of Human Rights (ECtHR), and the Court of Justice of the European Union (CJEU). The second part of the book critically analyses three problems with the case law of the ECtHR and the CJEU. Part three deals with reconceptualizing the prohibition of multiple punishment and the prohibition of multiple prosecutions. Finally, the fourth part addresses other possible protections against multiple sanctioning systems. Two other safeguards that limit multiple sanctioning systems are the prohibition of disproportionate sanctions and the right to be tried within a reasonable time.
