Book Delivery of Goods under Bills of Lading

Download or read book Delivery of Goods under Bills of Lading written by Anders Møllmann and published by Routledge. This book was released on 2016-12-01 with total page 240 pages. Available in PDF, EPUB and Kindle. Book excerpt: Probably the core characteristic of a bill of lading is that the original bill of lading must be presented at the port of destination for a consignee to be entitled to delivery of the goods and for the carrier to get a good discharge of its delivery obligation by delivering the goods to said consignee. This notion is accepted virtually worldwide, but the more precise content of the "presentation rule" differs from jurisdiction to jurisdiction. Furthermore, and of importance, the legal basis establishing the "presentation rule" differs. With the technological advances in maritime transport as well as in communications technology and the emergence of more complicated trading patterns, a system where a specific tangible piece of paper issued at the port of loading has to be presented at the port of discharge to obtain delivery of the goods seems almost archaic and can obviously create problems. Thus, in practice very often – especially in some trades such as the oil trade – the bill of lading is not available at the port of discharge when the ship is ready to deliver the cargo. The book will first analyse the "presentation rule", its finer contents and its legal basis. It will then go on with (legal) analyses of three developments and responses to the problems that the bill of lading system gives rise to in practice, viz. the commercial, the international legislature’s, and the technological response. The commercial response analysed here consists of contractual exemption or limitation clauses in the bill of lading set up as a defence against claims for misdelivery. The international legislature’s response denotes the adoption of the Rotterdam Rules which as the first international convention on carriage of goods by sea includes elaborate rules on delivery of the goods. Finally, the technological response denotes the possibility of using electronic (equivalents of) bills of lading. The analyses will include a comparative approach examining both English and Scandinavian law to elucidate the issues with greater clarity.

The aim of this project was to develop cooperation between large Nordic cities in the form of a public buyer's network. The network was to conduct market dialogues on a selected area and promote environmental solutions. Gathering public contracting authorities with the same need and then challenge the market together is an effective way to create a larger market for newly developed solutions. The topic has been to work towards zero emission delivery of goods. From 2019 until the autumn of 2021 there have been various activities which you can read about in this report.

Book The Robots Are Coming

Download or read book The Robots Are Coming written by Andres Oppenheimer and published by Vintage. This book was released on 2019-04-30 with total page 418 pages. Available in PDF, EPUB and Kindle. Book excerpt: Staying true to his trademark journalistic approach, Andrés Oppenheimer takes his readers on yet another journey, this time across the globe, in a thought-provoking search to understand what the future holds for today's jobs in the foreseeable age of automation. The Robots Are Coming! centers around the issue of jobs and their future in the context of rapid automation and the growth of online products and services. As two of Oppenheimer's interviewees -- both experts in technology and economics from Oxford University -- indicate, forty-seven percent of existing jobs are at risk of becoming automated or rendered obsolete by other technological changes in the next twenty years. Oppenheimer examines current changes in several fields, including the food business, legal work, banking, and medicine, speaking with experts in the field, and citing articles and literature on automation in various areas of the workforce. He contrasts the perspectives of "techno-optimists" with those of "techno-negativists" and generally attempts to find a middle ground between an alarmist vision of the future, and one that is too uncritical. A self-described "cautious optimist", Oppenheimer believes that technology will not create massive unemployment, but rather will drastically change what work looks like.

Book Optimizing the Delivery of Multiple Ecosystem Goods and Services in Agricultural Systems

Download or read book Optimizing the Delivery of Multiple Ecosystem Goods and Services in Agricultural Systems written by Maria A. Tsiafouli and published by Frontiers Media SA. This book was released on 2017-10-18 with total page 201 pages. Available in PDF, EPUB and Kindle. Book excerpt: Agricultural land is subjected to a variety of societal pressures, as demands for food, animal feed, and biomass production increase, with an added requirement to simultaneously maintain natural areas and mitigate climatic and environmental impacts. The biotic elements of agricultural systems interact with the abiotic environment to generate a number of ecosystem functions that offer services benefiting humans across many scales of time and space. The intensification of agriculture generally reduces biodiversity including that within soil, and impacts negatively upon a number of regulating and supporting ecosystem services. There is a global need toward achieving sustainable agricultural systems, as also highlighted in the United Nations Sustainable Development Goals. There is hence a need for management regimes that enhance both agricultural production and the associated provision of multiple ecosystem services. The articles of this Research Topic enhance our knowledge of how management practices applied to agricultural systems affect the delivery of multiple ecosystem services and how trade-offs between provisioning, regulating, and supporting services can be handled both above- and below-ground. They also show the diversity of topics that need to be considered within the framework of ecosystem services delivered by agricultural systems, from knowledge on basic concepts and newly-proposed frameworks, to a focus on specific ecosystem types such as grasslands and high nature-value farmlands, pollinator habitats, and soil habitats. This diversity of topics indicates the need for broader-scope research, integrated with targeted scientific research to promote sustainable agricultural practices and to ensure food security.

Book Surviving Supply Chain Integration

Download or read book Surviving Supply Chain Integration written by National Research Council and published by National Academies Press. This book was released on 2000-03-23 with total page 162 pages. Available in PDF, EPUB and Kindle. Book excerpt: The managed flow of goods and information from raw material to final sale also known as a "supply chain" affects everythingâ€"from the U.S. gross domestic product to where you can buy your jeans. The nature of a company's supply chain has a significant effect on its success or failureâ€"as in the success of Dell Computer's make-to-order system and the failure of General Motor's vertical integration during the 1998 United Auto Workers strike. Supply Chain Integration looks at this crucial component of business at a time when product design, manufacture, and delivery are changing radically and globally. This book explores the benefits of continuously improving the relationship between the firm, its suppliers, and its customers to ensure the highest added value. This book identifies the state-of-the-art developments that contribute to the success of vertical tiers of suppliers and relates these developments to the capabilities that small and medium-sized manufacturers must have to be viable participants in this system. Strategies for attaining these capabilities through manufacturing extension centers and other technical assistance providers at the national, state, and local level are suggested. This book identifies action steps for small and medium-sized manufacturersâ€"the "seed corn" of business start-up and developmentâ€"to improve supply chain management. The book examines supply chain models from consultant firms, universities, manufacturers, and associations. Topics include the roles of suppliers and other supply chain participants, the rise of outsourcing, the importance of information management, the natural tension between buyer and seller, sources of assistance to small and medium-sized firms, and a host of other issues. Supply Chain Integration will be of interest to industry policymakers, economists, researchers, business leaders, and forward-thinking executives.

Book excerpt: The Acquis Group - also known as the European Research Group on Existing EC Private Law - pursues the objective of presenting, in a restated form known as the Acquis Principles (ACQP), the large and sometimes incoherent patchwork of existing EC private law. These Principles reflect the current state of EC law in a structure which allows for the identification of commonalities, contradictions, and gaps in the Acquis. The Acquis Principles include: general rules formulated on the basis of existing EC law; an accompanying commentary, outlining the foundations in the Acquis; and definitions of core legal terms and a glossary on terminology. This present volume is the second of a series. The book combines a revision of the parts of the ACQP published in the first volume - Contract I - with many new rules on remedies for non-performance, as well as certain specific situations or contracts, such as delivery of goods, package travel, and payment services.
