Book excerpt: For the Department of Defense (DOD) in FY2010, the Administration requested a total of $663.8 billion in discretionary budget authority. This includes $533.8 billion for the so-called "base budget"--All DOD activities other than combat operations in Iraq and Afghanistan-- and $130.0 billion for what are termed "overseas contingency operations," including those in Iraq and Afghanistan. The Administration also requested $75.9 billion in supplemental DOD appropriations for FY2009 to cover war costs. This amount, plus the $65.9 billion "bridge fund" for FY2009 emergency war funding included in the Supplemental Appropriations Act for FY2008 (P.L. 110-252), brings the total appropriated for FY2009 war costs to $141.8 billion. The Administration's DOD request, made public May 7, 2009, incorporated Defense Secretary Robert Gates's April 6 recommendations concerning funding for several major weapons programs. While DOD long had been focused primarily on preparing for conventional warfare with cutting edge weapons like the Air Force's F-22 fighter, Gates said, U.S. forces are sufficiently superior to potential adversaries that DOD can set less technologically ambitious goals for future conventional weapons. This would allow DOD to focus more resources on equipment better suited to the type of operations underway in Iraq and Afghanistan.

The Administration's DOD request, made public May 7, 2009, incorporated Defense Secretary Robert Gates' April 6 recommendations to curtail funding for several major weapons programs focused on conventional warfare. The FY2010 national defense authorization bills drafted by the House and Senate Armed Services Committees generally supported this shift in policy, which the Obama Administration's budget request reflected. However, both committees added to their respective bills authorization to continue production of the Air Force's F-22 fighter, and to continue development of an alternative engine for the F-35 Joint Strike Fighter. The Obama Administration warned that a bill that continued either program would be vetoed. On June 25, the House passed by a vote of 389-22 its version of the FY2010 national defense authorization act, H.R. 2647, which would authorize a total of $534.0 billion for the DOD base budget--$264.8 million more than requested--and $129.3 billion for war costs. The bill also would authorize $16.5 billion for defense-related nuclear activities of the Energy Department, which was $83.3 million more than requested. On July 2, the Senate Armed Services Committee reported its version of the authorization bill, S. 1390, which would authorize $534.6 billion for the DOD base budget, $129.3 billion for war costs, and $16.4 billion for the Energy Department.

Book excerpt: Defense spending is a major focus of attention in Congress every year, initially in action on the congressional budget resolution, which recommends overall spending for national defense, and later when Congress considers annual defense authorization and appropriations bills. Congress also regularly considers supplemental appropriations for military operations abroad, often early in the agenda of a new legislative session. In the Second Session of the 111th Congress, supplemental appropriations for military operations in Iraq and Afghanistan for the remainder of FY2010 are again expected to be considered early in the year. A supplemental appropriations bill may become a vehicle for debate about U.S. troop levels in Afghanistan and their mission and about the metrics by which to determine the degree to which U.S. goals in that country are being achieved. In legislative action on regular FY2011 defense authorization and appropriations bills, issues may include proposals to increase or to limit military personnel pay and benefits, whether to sustain a temporary increase in the size of ground forces, and whether to add or reduce requested funding for particular major weapons programs. These perennial issues may be particularly salient this year because, in addition to submitting its annual DoD budget request, the Administration will publish the results of the legislatively-mandated Quadrennial Defense Review (QDR), which is intended to be a far-reaching assessment of U.S. force structure and plans. Congress also may address a wide range of defense policy matters including proposals to reform the weapons acquisition process in an effort to reduce chronic cost overruns and delays; social issues, such as the "don't ask, don't tell" policy toward gays in the military; buy American requirements for material used in weapon systems; and limits on outsourcing of civilian defense jobs.

L. 109-163, provided authority for DOD to transfer to the State Department up to $100 million in defense articles, services, training or other support in FY2006 and again in FY2007 to use for reconstruction, stabilization, and security activities in foreign countries. [...] The FY2008 NDAA included a provision requiring the Secretary of State to "coordinate with the Secretary of Defense in the formulation and implementation of a program of reconstruction, security, or stabilization assistance to a foreign country that involves the provision of services or transfer of defense articles or funds" under this authority. [...] In a March 20, 2008, letter, DOD requested that Congress double Section 1207 authorized funding to $200 million per year, extend the authority for five fiscal years, and broaden the authority to permit DOD to provide that services or transfer defense articles and funds to the head of any U. S. government department or agency, not just the Department of State. [...] Pointing to the Secretary of Defense's April 15, 2008, testimony at a HASC hearing that Section 1207 authority "is primarily for bringing civilian expertise to operate alongside or in place of our armed forces," SASC stated that the legislative intent of Section 1207 authority was broader, and was meant "to enable the Secretary of Defense to support the provision by the Secretary of State of recon [...] This would require coordinating the efforts of various congressional committees, but it would restore the traditional role of the DOS [Department of State] in funding U. S. foreign assistance."9 In action on the FY2010 defense authorization and appropriations acts, and the FY2010 State Department, Foreign Operations, and Related appropriations act, armed services authorizers, defense appropriators.
