Book excerpt: Since the collapse of Soeharto’s New Order regime in May 1998, Indonesia’s national, provincial, and district governments have engaged in an intense struggle over how authority and the power embedded in it, should be shared. How this ongoing struggle over authority in the forestry sector will ultimately play out is of considerable significance due to the important role that Indonesia’s forests play in supporting rural livelihoods, generating economic revenues, and providing environmental services. This book examines the process of forestry sector decentralization that has occurred in post-Soeharto Indonesia, and assesses the implications of more recent efforts by the national government to recentralize administrative authority over forest resources. It aims to describe the dynamics of decentralization in the forestry sector, to document major changes that occurred as district governments assumed a greater role in administering forest resources, and to assess what the ongoing struggle among Indonesia’s national, provincial, and district governments is likely to mean for forest sustainability, economic development at multiple levels, and rural livelihoods. Drawing from primary research conducted by numerous scientists both at CIFOR and its many Indonesian and international partner institutions since 2000, this book sketches the sectoral context for current governmental reforms by tracing forestry development and the changing structure of forest administration from Indonesia’s independence in 1945 to the fall of Soeharto’s New Order regime in 1998. The authors further examine the origins and scope of Indonesia’s decentralization laws in order to describe the legal-regulatory framework within which decentralization has been implemented both at the macro-level and specifically within the forestry sector. This book also analyses the decentralization of Indonesia’s fiscal system and describes the effects of the country’s new fiscal balancing arrangements on revenue flows from the forestry sector, and describes the dynamics of district-level timber regimes following the adoption of Indonesia’s decentralization laws. Finally, this book also examines the real and anticipated effects of decentralization on land tenure and livelihood security for communities living in and around forested areas, and summarizes major findings and options for possible interventions to strengthen the forestry reform efforts currently underway in Indonesia.

The 1st APPTHI International Conference on Changing of Law (the series) is the first international conference series held in Indonesia by the Association of Indonesian Law College Leaders (APPTHI), inviting several legal experts from countries such as the USA, the Netherlands, Korea, Malaysia, India, as well as South Korea. This activity has 3 major themes each held in several cities, namely: in Jakarta which will be held at Trisakti University on 22 July 2023 with the theme Changing of Law in the digital era, while in Makassar it will take place at the Indonesian Muslim University/UMI) on July 24 2023 with the theme Changing of Law in the Energy sector and Natural Resources Management, as well as the last series of conferences in Bali on July 26 2023 at Warmadewa University, becoming a series of academic activities that have a broad spectrum and dimension of legal knowledge with various legal perspectives such as business law, corporate law, civil law, criminal law, intellectual property law, telematics law, agrarian law, environmental law, HTN/HAN etc. This event was carried out within the framework of the first round of the APPTHI international program which will continue to be held regularly every year. This program is also a form of implementation of various forms of international cooperation in several countries such as New York University, Utrecht University, National University of Malaysia, Hankuk University, and Jawaharlal Nehru University. In this event APPTHI collaborated with the international program organizer, PASQAPRO. For the activities of The First APPTHI International Conference on Changing Law, The Series, involving campuses as co-hosts in Jakarta (hosted by Trisakti University), including: Jakarta Islamic University, Universitas Suryakancana, cianjur, Lampung Mitra University, Palembang Law School STIHPADA, Islamic University Jakarta, Muhamadiyah University Jakarta, YARSI University, National University, Borobudur University, while co-hosted in Makassar (Host Indonesian Muslim University): Panca Bakti University, West Kalimantan, Sawerigading University, Christian University of Paulus, Makasar, Universitas Juanda, Bogor and Seventeen August University (UNTAG) Semarang, for Bali with the host university Warmadewa, assisted by co-hosts including: Caritas College of Law, Papua. Hopefully this conference will not only be a scientific forum for APPTHI members and various foreign partner universities by providing outputs in the form of indexed proceedings and journals, but also an event that will contribute thoughts in the field of law for the Indonesian government in conducting studies on legal changes positively as well as being a think tank for the formation of state laws and policies.

Book excerpt: From its establishment in 1954 part of the mandate of Cornell's Modern Indonesia Project has been the translation and publication in English of important documents that would otherwise have been unavailable to many of those interested in Indonesia's social and political history. These have included the writings of Hatta, A. K. Pringgodigdo, Simatupang, Sjahrir, Sudjatmoko, Sukarno, Supomo, Widjojo, and Wilopo. Also included in this coverage of the Translation Series have been documents unavailable even in the original Dutch or Indonesian, such as the long suppressed report by the Netherlands East Indies Government's Coolie Budget Commission, Living Conditions of Plantation Workers and Peasants on Java, which we published twenty-five years ago. The translation here presented of Heri Akhmadi's defense statement at his trial is of a similar genre; for despite its intrinsic significance and its relevance to an appreciation of how the leaders of a new generation of educated Indonesians view their country's government and its major social, economic, and political problems, it too has been suppressed. To prevent this important insight into the current Indonesian situation becoming buried and unavailable, we are pleased to help provide for the dissemination it deserves. I would predict that a quarter of a century from now, Heri Akhmadi's statement may well be regarded as having at least as much importance to understanding present-day Indonesia as the Coolie Budget Commission report had for an earlier period in the country's history. Heri Akhmadi was elected by the student body of the Bandung Institute of Technology - one of the most prestigious institutions of higher learning in the country - as Chairman of their Student Council and their principal representative. Since his views are close to those of the elected student leaders from more than two dozen other universities and colleges who were arrested at the same time, his statement can be regarded as representative of the ideas of the intellectual vanguard of the contemporary generation of Indonesian students, which - despite ongoing efforts to suppress them - are likely to have a significant effect on their country's history. Heri Akhmadi and these other student leaders were arrested and jailed in 1978 following widespread student protest at Suharto's unopposed election for another term as President. As a consequence, they were charged with having insulted the head of state, and it is because of the nature of this charge that Heri Akhmadi's defense statement takes the form it does. What the government considers as an insult to the head of state is what the students see as valid criticism of its policies. The main theme of this research is the three-pillar framework of the Tanah-Air concept, which includes the political culture of persatuan nasional (national unity), the strategic culture of cakra manggilingan (turning of the times from dark to golden periods), and the geopolitical context of posisi silang dunia (world crossroad position). The findings of this publication indicate the dominant influence of Javanese political culture, philosophy, values, and traditions on the distinct character of Indonesia’s maritime orientation. Specifically, Javanese political philosophy and traditions within each pillar of Tanah-Air have influenced continuity rather than change in the evolution of Indonesia’s maritime policy. This book helps readers understand how the defining theme of unity in national political culture has shaped the evolution of Indonesia’s maritime policy from 1945 to 2019. It illustrates how the continuous influence of the theme of national unity as devised by the political elites through history has addressed the realities of the archipelago’s geography, and it is significant from both an academic and practical policy perspective. Digitalization encourages increased problems with people’s constitutional rights such as freedom of opinion, protection of the rights of other citizens, defamation, and pollution. Ethnicity, religion, race, between groups, and so on. Another problem that must also be accommodated is the problem of organizing democracy, statehood, and government policies. So there needs to be an optimization of the conception of a country’s democracy to create protection for citizens, governments, and so on to create optimal democratic implementation, accountability, and the state’s principles, and ideals.
