Book excerpt: John Rawls's international theory, The Law of Peoples, has been read and criticized as "A Theory of International Justice". His major objective, however, is not the establishment of a just (liberal) world order, but to guide liberal societies towards a reasonable peaceful, stable and just international system. From this starting point, the thesis assesses whether Rawls's international theory can meet its task to function as a guideline for the promotion of international peace, stability and justice and how that peace might be conceived. The author argues that Rawls sketches the path to a "decent peace". The scrutiny of the issue takes the form of an in-depth analysis and discussion of The Law of Peoples and a systematic investigation of a number of cases. The dissertation examines the possible contribution of Rawls's ideas, primarily the Society of Peoples and the principles of the Law of Peoples, to international peace, stability and justice. As the focus lies on decent regimes and a decent peace, three actual decent societies are identified (Oman, Qatar and Singapore), in order to highlight the applicability of the notion to the international system, as well as to ensure that decent regimes are not mere constructions serving to justify imposing liberal principles of non-liberal regimes. The dissertation finally investigates the enlargement of the democratic peace thesis towards a decent peace; it discusses the arguments for a democratic peace and applies them to Rawls's conception of decent peoples as well as to the identified regimes. It concludes asserting that the decent peace thesis is theoretically wellfounded, whereas the empirical evidence is - due to only three identified regimes - rather weak. As a guideline for the foreign policy of liberal (and decent) societies The Law of Peoples can contribute to more stability and justice in the international realm and promote a decent peace.

Book excerpt: This book explores the instability of the African postcolonial state and demonstrates that such a fundamental crisis can be solved only through discourses and practices that are designed beyond the Westphalian model of the modern state and out of the neo-patrimonialistic system of African governance. The challenge of instability will not be overcome by rebuilding the African nation-state undermined by social contradictions and complex emergencies; rather stability will be achieved by opening a public space of agonistic democracy that is supported mainly by an overlapping consensus on justice. The author argues that by reading critically, the African philosophy of solidarity is contradicted by structural violence and inequality. The political instrumentalization of kinship provokes the exclusion of minorities, the marginalization of masses, and the instability of the entire society. Governance is reduced to mere conflict management. The solution of legitimate violence becomes another version of the problem of institutional incapacity. The author's contention is people are the ultimate and permanent agents of stability, and the ground of stability must not be a strong state, but the politics of reciprocity and union among people that implies a sense of justice in the power sharing and in the decision making process.

Wars have negative consequences, not the least impinging on human life, and offer infrequent and uncertain benefits, yet war is part of the human condition. James G. Murphy’s insightful analysis of the jus ad bellum criteria—competent authority, just cause, right intention, probability of success, last resort, and proportionality—is grounded in a variety of contemporary examples from World War I through Vietnam, the "soccer war" between Honduras and El Salvador, Afghanistan, and the Middle East conflict. Murphy argues persuasively that understanding jus ad bellum requires a primary focus on the international common good and the good of peace. Only secondarily should the argument about going to war hinge on the right of self-defense; in fact, pursuing the common good requires political action, given that peace is not simply the absence of violence. He moves on to demonstrate the interconnectedness of the jus ad bellum criteria, contending that some criteria depend logically on others—and that competent authority, not just cause, is ultimately the most significant criterion in an analysis of going to war. This timely study will be of special interest to scholars and students in ethics, war and peace, and international affairs.
