While the very notion of a natural law has proved highly controversial among 20th Century scholars, the last decades have witnessed a renewed interest in it. Indeed, the threats and challenges as result of multiculturalism, plural societies and global changes have generated a renewed attention to natural law theory. Clearly, it offers solid basis as possible framework to a better understanding of human goods without contradictions and partial bias. The purpose of the present volume is to provide an overview of the history of this concept (Cicero, St. Paul, Aquinas, Melanchthon, Montaigne, Descartes, Leibniz, Hume, Burke, Kant, MacIntyre, etc.) as well as a deep understanding of ongoing research, both in Europe and in America. Furthermore, the specificity of these studies will be of particular value to philosophers, law-philosophers, historians, anthropologists, sociologists and theologians, and those concerned on such issues as the relation between law and moral norm, law and practical reason, and the presence of the idea of natural law in several prominent thinkers. It includes a selected bibliography on natural law. The book also provides an excellent introduction to several of the major topics in natural law theory making it useful both as a reference text and as a sourcebook for academics alike. This volume contains the proceedings of a conference organized in May 2015 by the Instituto Cultura y Sociedad (University of Navarra). The scope of this conference was very wide as is proved by the variety of the contributions. They deal with such topics as the relationships between material value ethics and the idea of natural law, the distinction between the moral sphere and the sphere of law, the criticisms of those theories which ground human rights in natural law, the motives which lead us to consider certain facts and duties as consequences of social acts, the meaning of “freedom” in criminal law or the critical exam of such views which try to reduce the Philosophy of Law to some psychological, social or historical questions. However, despite their diversity, the contributions share two elements: on the one hand, the emphasis of the necessity of a dialogue between such different disciplines as Philosophy and Law focusing on a central question, namely, the existence of pre-positive elements, prior to every positive legislation and, on the other hand, the conviction that such elements have an own intelligibility.

Además, articula las luchas prácticas con las investigaciones sobre el gobierno colectivo de los recursos naturales o de la información y designa formas democráticas nuevas que aspiran a tomar el relevo de la representación política y del monopolio de los partidos. Esta emergencia de lo común en la acción reclama un trabajo de clarificación en el pensamiento. El sentido actual de lo común se distingue de los numerosos usos que se ha dado a esta noción, ya sean filosóficos, jurídicos o teológicos: bien supremo de la ciudad, universalidad de esencia, propiedad inherente a ciertas cosas, incluso alguna vez el fin perseguido por la creación divina. Pero hay otro hilo que vincula lo común, no a la esencia de los hombres o a la naturaleza de las cosas, sino a la actividad de los hombres mismos: sólo una práctica de puesta en conjunto puede decidir qué es “común”, reservar ciertas cosas al uso común, producir determinadas reglas capaces de obligar a los hombres. En este sentido, lo común reclama una nueva institución de la sociedad por ella misma: una revolución.

Esta visión, auspiciada por los partidarios de la Contrarrevolución, posteriormente se ha hecho canónica al asentarse los principios proclamados por los revolucionarios franceses. Con la perspectiva de esta visión sesgada, los escritos referentes a la religión se ven como añadidos discordantes, explicándose por causas subjetivas los que se presentan como disarmonías. Frente a esta interpretación, la que el autor propone atiende a aspectos culturales, antes que a aspectos subjetivos. Rousseau es fruto de un momento de transición. Frente al XVIII como el siglo de la razón, el pueblo es eminentemente religioso. La opción de Rousseau por el sentimiento religioso es una opción epistemológica pero a su vez es una opción social, una opción por el pueblo llano, frente a la razón auspiciada por la élite. Rousseau propone una revolución moral presidida por esquemas religiosos, aunque esta religión tiene que adaptarse a los nuevos tiempos: la metafísica debe ceder ante lo terrenal, o la moral primar frente a lo teológico. La religión civil, como religión patriótica, es expresión de su deísmo en el ámbito político.

Specifically, memory is the framework of culture, because it links the present to the past - or tradition - and projects it into the future. For this reason, any work focusing on memory involves a double challenge: (1) to reveal the origin of concepts and (2) to glimpse the course of thoughts. This is the case of the present volume, in which the authors make several tastings of Europe's intellectual heritage, by taking into account both the Greek origin of this legacy and its relevance for understanding the European philosophical heritage. In particular, these papers focus on the Aristotelian tradition, the true keystone of Europe, and on other currents of thought that have also played an essential role in the intellectual evolution of the Old Continent. In the latter field, there are contributions, for instance, on philosophical-religious traditions such as Orphism or on certain fundamental aspects of Neoplatonism both in the Classical World and in Christian authors. The volume concludes with various works on the survival of these intellectual trends from the Renaissance to the present day. Consequently, this work offers the opportunity to delve deeper into some of the aspects that define Western civilisation, observed both from its origin and its evolution over the centuries. The volume contains papers in Spanish, Portuguese, Italian, and English. Este libro es una indagación en la memoria del mundo occidental. Específicamente, la memoria es el armazón de la cultura, porque liga el presente al pasado —o tradición— y lo proyecta al futuro. Por ello, toda obra centrada en la memoria entraña un doble reto: (1) revelar el origen de los conceptos y (2) atisbar el rumbo de los pensamientos. Este es el caso del presente volumen, en el que realizan diversas catas en el patrimonio intelectual europeo. Lo hace teniendo en cuenta tanto el origen griego de ese legado como su relevancia para comprender el acervo filosófico europeo. En concreto, se centra en la tradición aristótelica, verdadera clave de bóveda de Europa, y en otras corrientes de pensamiento que también han jugado un papel esencial en la evolución intelectual del viejo continente. En éste último ámbito hay contribuciones, por ejemplo, sobre tradiciones filosófico-religiosas como el orfismo o sobre determinados aspectos fundamentales del neoplatonismo en el mundo clásico y en autores cristianos. Concluye el volumen con diversos trabajos sobre la pervivencia de esas tendencias intelectuales desde el renacimiento hasta nuestros días.
