The study presents a comprehensive analysis of divorce as a psychological process that is situated within a social and a legal context. It presents a comprehensive view of divorce as a psychosocial, economic and legal phenomenon and contains a review of the research literature about divorce and its consequences for parents and children. Moreover, it describes divorce by proposing conceptual frames and explanatory models.

Book excerpt: This book is formed by various chapters studying the manner in which conflicts, changes and ideologies appear in contemporary Hispanic discourses. The contributions analyze a wide variety of topics related to the manner in which ideological and epistemological changes of the 19th, 20th and 21st centuries are reflected in, and shape, Spanish language, literature, and other cultural expressions in both Spain and Latin America. The 19th century was conducive to various movements of independence, while, in Europe, radical changes of different types and in all contexts of life and knowledge occurred. Language was certainly affected by these changes resulting in new terminology and discourse strategies. Likewise, new schools of thought such as idealism, dialectic materialism, nihilism, and nationalism, among others, were established, in addition to new literary movements such as romanticism, evocative of (r)evolution, individualism and realism, inspired by the social effects of capitalism. Scientific and technological advances continued throughout the 20th century, when the women’s liberation movement consolidated. The notion of globalization also appears, simultaneously to various crises, despotism, wars, genocide, social exclusion and unemployment. Together, these trends give rise to a vindicating discourse that reaches large audiences via television. The classic rhetoric undergoes some changes given the explicit suasion and the absence of delusion provided by other means of communication. The 21st century is defined by the flood of information and the overpowering presence of mass communication; so much so, that the technological impact is clear in all realms of life. From the linguistic viewpoint, the appearance of anglicisms and technicalities mirrors the impact of post-modernity. There is now a need to give coherence to a national discourse that both grasps the past and adapts itself to the new available resources with the purpose of conveying an effective and attractive message to a very large audience. Discourse is swift, since society does not seem to have time to think, but instead seeks to maintain interest in a world filled with stimuli that, in turn, change constantly. Emphasis has been switched to a search for historical images and moments that presumably explain present and future events. It is also significant that all this restlessness is discussed and explained via new means such as the world-wide-web. The change in communication habits (e-mail, chats, forums, SMS) and tools (computers, mobile phones) that was initiated in the 20th century has had a net effect on the directness and swiftness of language.

An important critical assumption made by the authors is that the gender equality perspective has been largely neglected in several branches of private law, since scholars researching the intersection between gender and legal studies are mostly focused on public law and human rights law. In light of that, the book contributes not only to the deconstruction of gender-blind private law, but also to the development of a gender-competent analysis of the key branches of private law, starting with private international law. Gender perspective in family law is analyzed on the basis of gendered and heteronormative operations of family law with reference to the formation of legally recognized relationships, the establishment of legal parenthood, the division of marital property after a divorce, and the arrangements for post-separation parenting. Also, regulation of family matters in Indian society and the gender equality perspective from the principle of the child’s best interest are considered. As far as tort law is concerned, the book addresses compensation for damages suffered by women performing unpaid household work. Further, it contains papers dedicated to the following labour law issues: the genesis of labor law and its capacity to contribute either to worsening gender inequality in the world of work or to promoting gender equality; gender segregation in the labour market and its connection to family-friendly policies in the European Union; sexual harassment at work; and the impact of work digitalization on gender-related labour law issues. Lastly, the authors analyze gender equality in civil procedural law, as well as in mediation as a tool for encouraging the peaceful settlement of disputes. The book is intended to improve awareness of the wide range of private law issues that are important for understanding the ways in which gender inequality shapes everyday experiences, while also presenting critical considerations of the key private law instruments for achieving gender equality.

El ejercicio de la patria potestad como consecuencia de la ruptura matrimonial o la desestructuración de la unión de hecho se resquebraja, aspecto que da lugar a diferentes sistemas de ejercicio. -- Junto a ello, y sin necesidad de que existan rupturas, cada vez son más los casos en los que es la propia movilidad de las personas a nivel internacional lo que genera dificultades en el ejercicio de la patria potestad por parte de progenitores que sí están bien avenidos pero que no conviven regularmente. -- La custodia compartida, regulada desde 2005 en nuestro Código civil, no termina de consolidarse, porque, como dice Clavijo Suntura, se condiciona su aplicación al cumplimiento de determinados requisitos que no hacen factible su implementación. El interés del menor debe compaginarse con otros criterios que han de ser aplicados en cada caso concreto, como son la conveniencia de mantener unidos a los hermanos, el lugar de residencia de los padres o la profesión de éstos.

Book excerpt: This in-depth examination of one of the most controversial episodes in U.S.-Cuba relations sheds new light on the program that airlifted 14,000 unaccompanied children to the United States in the wake of the Cuban Revolution. Operation Pedro Pan is often remembered within the U.S. as an urgent "rescue" mission, but Deborah Shnookal points out that a multitude of complex factors drove the exodus, including Cold War propaganda and the Catholic Church's opposition to the island's new government. Shnookal illustrates how and why Cold War scare tactics were so effective in setting the airlift in motion, focusing on their context: the rapid and profound social changes unleashed by the 1959 Revolution, including the mobilization of 100,000 Cuban teenagers in the 1961 national literacy campaign. Other reforms made by the revolutionary government affected women, education, religious schools, and relations within the family and between the races. Shnookal exposes how, in its effort to undermine support for the revolution, the U.S. government manipulated the aspirations and insecurities of more affluent Cubans. She traces the parallel stories of the young "Pedro Pans" separated from their families--in some cases indefinitely--in what is often regarded in Cuba as a mass "kidnapping" and the children who stayed and joined the literacy brigades. These divergent journeys reveal many underlying issues in the historically fraught relationship between the U.S. and Cuba and much about the profound social revolution that took place on the island after 1959.
