Book excerpt: Cet ouvrage est consacré à l'étude de l'obligation faite à l'État, en droit canadien, de consulter les peuples autochtones lorsqu'il envisage de prendre des mesures portant atteinte à leurs droits et intérèts. En examinant la manière dont la jurisprudence canadienne relative à leurs droits ancestraux en est arrivée à reconnaître cette obligation, on constate que c'est en s'approchant au plus près de l'idée d'autonomie gouvernementale autochtone - soit en définissant le titre ancestral, droit autochtone à la terre elle-mème - que la Cour suprème du Canada en est venue à concevoir la consultation comme véritable outil de dialogue entre l'État et les Premières nations. Pour assurer le caractère dialogique du processus consultatif, la Cour a dû tenter d'équilibrer le rapport de forces entre les parties, ce qu'elle a fait en admettant le manque de légitimité du pouvoir étatique sur les autochtones. Or, l'égalité qu'exige un processus consultatif signifiant remet également en question l'approche culturaliste de la Cour aux droits ancestraux et devrait la conduire à refonder ces droits sur la reconnaissance de la continuité des ordres juridiques autochtones.

With or without formal self-government, Aboriginal communities and nations are increasingly assertive in establishing their own authority in areas as diverse as education, land management, the administration of justice, family and social services, and housing. The 2013 State of the Federation volume gathers experts and practitioners to discuss the contemporary dynamics, patterns, and challenges of Aboriginal multilevel governance in a wide range of policy areas. Recent court decisions on Aboriginal rights, notably on the duty to consult, have forced provincial and territorial governments to develop more sustained relationships with Aboriginal organizations and governments, especially in the management of lands and resources. Book excerpt: Historically, Canada’s Constitution has been principally viewed as a federal framework or a rights bulwark. This book offers a brand new interpretation. The “Strategic Constitution,” as proposed by Irvin Studin, can be a framework for Canada to project strategic power in the world. This framework lays the foundations for a new school of Canadian constitutional scholarship. Studin begins by reducing the Constitution to its strategically relevant essentials or building blocks. He then provides a wide-ranging audit of the Constitution in terms of its implications for so-called factors of strategic power: the military, diplomacy, executive potency, natural resources, the economy, strategic communications, and the national population. He later applies the Strategic Constitution framework to four policy case studies: Canadian regional leadership in the Americas; bona fide war (as in Afghanistan); Arctic sovereignty; and counterterrorism.
