Book excerpt: La reconnaissance et la mise en oeuvre de la protection des droits de propriété intellectuelle au Vietnam sont de plus en plus complexes, surtout après l'entrée en vigueur de l'Accord commercial bilatéral conclu avec les Etats-Unis et l'adhésion de ce pays à l'OMC et à l'Accord relatif aux ADPIC. La jeunesse et la faiblesse du système juridique vietnamien actuel risquent de compromettre les engagements conventionnels internationaux relatifs aux droits de propriété intellectuelle pris par ce pays. Aussi la priorité a-t-elle été donnée à l'amélioration des institutions qui est menée en parallèle aux réformes législatives, sans négliger les mesures d'exécution de la protection de la propriété intellectuelle, par voie administrative et judiciaire. Les références à un système de normes conforme aux exigences du volet ADPIC de l'OMC tel que le droit de propriété intellectuelle français fourniront de riches enseignements pour combler les lacunes et pour trouver des solutions aux problèmes d'un système vietnamien de droit de la propriété intellectuelle en voie de construction. La méthode comparative permet de prendre en considération les exigences propres de la situation d'un pays comme le Vietnam, et de choisir parmi les solutions possibles, celle qui traduit le mieux les traditions juridiques du pays et qui respecte le plus les intérêts sociaux-économiques du Vietnam. Les recherches menées dans le cadre de cette thèse pourraient ainsi contribuer, même modestement, à la création d'une théorie moderne de la propriété intellectuelle au Vietnam.
