Sensible es que la Francia no haya cooperado con su inteligencia a la cultura de esta doctrina.La teoría del Derecho, que exponemos en este curso, considera el principio del Derecho como distinto e independiente de todos los otros principios que gobiernan el mundo moral y social; y sobre todo distingue con claridad el Derecho de la moral, con la que frecuentemente se le confunde; confusión que no solo es falsa en teoría, sino que en la aplicación produciría el más odioso despotismo, si el sentido positivo y recto de los hombres versados en el ejercicio del Derecho no se opusiesen a él; pues es indudable que a su sombra abocaría así el foro del Derecho o de la justicia todos los actos que pertenecen a la conciencia, único tribunal competente. Sin embargo, aunque el Derecho en cuanto a su principio, sea independiente y llene por sí solo el cuadro de una ciencia, no por eso deja de estar en íntima relación con las otras ciencias.
