Despite its weaknesses and strengths, the substance of this book has gained recognition from scientists at the international level. The anatomy of a culture of abuse of power in Indonesia from the standpoint of criminology and law has an impact on deviations not only on the discretion of power and moral behavior of public officials. In fact, many public officials abuse power by being corrupt or punished, even by severe law, even the perpetrators of power violations continue to commit corruption or it can be seen that there is no clear effect for corruptors. However, it is a wrong system in the life of the nation and state, when public officials who depart from the people do not have the view of life as a nation and state as they should. Therefore, in accordance with the views and suggestions of the author, this nation and state need to return to the joint system of life of the nation and state of Indonesia, namely implementing the points of practice and appreciation of the Pancasila precepts with truth rather than mere rhetoric, because the ideology of the Pancasila state has been built since the country was founded by the founding fathers.

Book excerpt: This book critically evaluates different models of judicial leadership in Indonesia to examine the impact that individual chief justices can have on the development of constitutional courts. It explores the importance of this leadership as a factor explaining the dynamic of judicial power. Drawing on an Aristotelean model of heroism and the established idea of judicial heroes to explore the types of leadership that judges can exercise, it illustrates how Indonesia’s recent experience offers a stark contrast between the different models. First, a prudential-minimalist heroic chief justice who knows how to enhance the Court’s authority while fortifying the Court’s status by playing a minimalist role in policy areas. Second, a bold and aggressive heroic chief justice, employing an ambitious constitutional interpretation. The third model is a soldier-type chief justice, who portrays himself as a subordinate of the Executive and Legislature. Contrary perhaps to expectations, the book’s findings show a more cautious initial approach to be the most effective. The experience of Indonesia clearly illustrates the importance of heroic judicial leadership and how the approach chosen by a court can have serious consequences for its success. This book will be a valuable resource for those interested in the law and politics of Indonesia, comparative constitutional law, and comparative judicial politics.

In traditional federal theories, this is considered an anomaly. The degree of symmetry and asymmetry is seen as an indicator of the degree of harmony or conflict within each system. Therefore symmetrisation processes tend to be encouraged to secure the stability of the political system. However, scholars have linked asymmetry with multinational federalism, presenting federalism and asymmetry as forms of ethnical conflict management. First, is the problem of the marginalization of indigenous Papuans, and the discriminatory impacts on them resulting from the economic development of, political conflicts in, and mass migrations to Papua since 1970. To respond to this problem, an affirmative policy of recognition must be developed to empower indigenous Papuans. The second issue is the failure of development, particularly in the fields of education, health, and people's economic empowerment. This requires a new paradigm of development, focused on improving public services for the welfare of indigenous Papuans in the villages. The third main problem is the contradictions that exist between Papuan and Jakartan constructions of political identity and history. This problem can only be settled through dialogue, along the lines of the dialogue that was conducted for Aceh. The fourth issue is accountability for past state violence toward Indonesian citizens in Papua. For this, a road to reconciliation must be cleared, on which courts of human rights and the disclosure of the truth are the means of choice for law and justice to be upheld in Papua, for the victims and their families in particular, and all Indonesian citizens of Papua in general. The above four issues and agendas can be woven together to form a mutually interrelated policy strategy for comprehensive long-term resolution of the Papuan conflict. The atmosphere of Reformasi, and the existence of the accommodative Law No. 21/2001 on Special Autonomy (UU Otsus), a responsive central government, as well as the very large size of Papua's budget, lead the LIPI team to have faith that the problems of Papua can be resolved with justice, peace and dignity.
