Como es sabido, el pasado, presente y futuro de esta materia no puede entenderse si no es en conexión con la armonización de los derechos nacionales que se realiza a instancias de las instituciones comunitarias, pues la labor llevada a cabo por el Parlamento Europeo, la Comisión y el Tribunal de Justicia de la Unión Europea está siendo decisiva a la hora de crear un cuerpo normativo supranacional en este ámbito. Por tanto, es imposible, en la actualidad, abordar la propiedad intelectual sin tener en cuenta la perspectiva no solo internacional, sino especialmente la comunitaria. Así, los derroteros por los que discurrirán cuestiones tan importantes como los límites o la gestión colectiva indudablemente irán de la mano de las directrices que se nos marquen desde Europa. Del mismo modo, resulta también indispensable aludir a la jurisprudencia emanada por el TJUE cuyas sentencias de los últimos años en materia de derechos de autor han supuesto, en muchas ocasiones, verdaderos revulsivos para los legisladores nacionales en España. Desde esta perspectiva, la profesora Carmen Otero García-Castrillón, Profesora Titular de Derecho Internacional Privado, aborda la cuestión de la protección transfronteriza de los derechos de propiedad intelectual, con especial referencia a la competencia judicial internacional. La copia privada y, en particular, los últimos pronunciamientos del TJUE sobre este particular, son analizados por Eduardo Serrano Gómez, Profesor Titular de Derecho Civil, quien señala diversos criterios a tener en cuenta para la futura regulación de esta cuestión. María Serrano Fernández, Profesora Titular de Derecho Civil, aborda los límites establecidos a favor de instituciones de interés público, la normativa comunitaria en relación al derecho de préstamo y las plataformas online. El nuevo régimen de las entidades de gestión y, en particular, las nuevas obligaciones que les han sido impuestas por la normativa comunitaria, son objeto de estudio por parte de Abel Martín Villarejo, Profesor Asociado de Derecho Civil y Director General de Aisge (Artistas Intérpretes, Sociedad de Gestión). Por último, Luis A. Anguita Villanueva se ocupa del límite denominado «libertad de panorama» que en estos momentos está siendo objeto de gran debate con vistas a una inminente regulación.

El mito esconde importantes dosis de xenofobia y de criminalización de personas que simplemente han atravesado irregularmente una frontera o se hallan con una documentación caducada.El respeto de los Derechos Humanos de las personas en situación irregular no siempre se produce en nuestros democráticos Estados de Derecho{ en ellos surge con demasiada frecuencia el cinismo del doble o triple lenguaje. El respeto efectivo de los Derechos Humanos (universales, indivisibles, interdependientes, inalienables e irrenunciables) interesa a todos y a todas. Cuando algún grupo de personas sufre su violación, otras personas (en esta hipótesis, muchos ciudadanos de la Unión) no se dan cuenta de que se cuestiona, sufre y peligra la misma esencia de la democracia.
