This universal credit will radically simplify the system to make work pay and combat worklessness and poverty. The consultation document (Cm. 7913, ISBN 9780101791328) spelt out the issues and the consultation responses (Cm. 7971, ISBN 9780101797122), publishing simultaneously with this paper, broadly welcomed the proposals that were put forward. Universal credit is an integrated working-age credit that will provide a basic allowance with additional elements for children, disability, housing and caring. It will support people both in and out of work replacing working tax credit, child tax credit, housing benefit, income support, income-based jobseeker's allowance and income related employment and support allowance. The universal credit will improve financial work incentives by ensuring that support reduction is tapered at a consistent and managed rate. It will also be backed up by a strong system of conditionality. As a simpler system managed by one department it will reduce the scope for costly errors and fraud. The universal credit will not replace: contributory jobseeker's allowance & contributory employment and support allowance which will continue aligned to earnings; disability living allowance; child benefit; and bereavement benefits, statutory sick pay, statutory maternity pay, maternity allowance and industrial injuries disablement benefit

Book excerpt: Approximately half of the total UK population are in receipt of one or more welfare benefits, giving rise to the largest single area of government expenditure. The law and structures of social security are highly complex, made more so by constant adjustments as government pursues its often conflicting economic, political and social policy objectives. This complexity is highly problematic. It contributes to errors in decision-making and to increased administrative costs and is seen as disempowering for citizens, thereby weakening enjoyment of a key social right. Current and previous administrations have committed to simplifying the benefits system. It is a specific objective of the Welfare Reform Act 2012, which provides for the introduction of Universal Credit in place of diverse benefits. However, it is unclear whether the reformed system will be either less complex legally or more accessible for citizens. This book seeks to explain how and why complexity in the modern welfare system has grown; to identify the different ways in which legal and associated administrative arrangements are classifiable as 'complex'; to discuss the effects of complexity on the system's administration and its wider implications for rights and the citizen-state relationship; and to consider the role that law can play in the simplification of schemes of welfare. While primarily focused on the UK welfare system it also provides analysis of relevant policies and experience in various other states.

Book excerpt: The benefits system as it stands often provides incentives to stay on benefits rather than take on a job. This paper identifies the key failings of the benefits system and outlines the objectives the Government believes the system should attempt to achieve. The framework being considered looks at the system of state support for the less well off as a whole and is designed to produce positive behavioural effects. The intention is to maximise work incentives while continuing to protect those most in need. This aim is to achieve this through new rules on how much of their earnings people can keep without losing benefit and by withdrawing benefits as earnings rise at a single, reasonable rate. The models being put forward for consultation include: i) a universal credit whereby elements of the current income-related and tax credit systems are combined, bringing out-of-work and in-work support together in a single system and supplement household earnings through credit payments; ii) a single unified taper would retain a set of benefits with a reformed delivery system whereby withdrawal would be through a taper applied to overall benefit eligibility as income increased; and ii) a single working age benefit which would give all working age claimants the same level of replacement income regardless of whether they were jobseekers, lone parents, sick or disabled. The Government is also looking at how to use smart automation to deliver support without the wasteful bureaucratic delays to payment that make the move into work more stressful than necessary

Book excerpt: The social security system of Great Britain has reached a crossroads, following the election of a Labour Government promising a 'New Age' of welfare and seemingly prepared to 'think the unthinkable' on welfare reform, at a time when public expenditure on welfare benefits has reached nearlyL100 billion per annum. In 1985 the Conservative's Green Paper on social security reform announced that the benefits system had 'lost its way'. Attempts were made to curb benefits expenditure and reduce welfare dependency, for example through better 'targeting' of needs, the reinforcement ofpersonal and family responsibility, and tighter administrative controls. The ten years from 1988 to 1998 saw the introduction of many new benefit schemes including income support, family credit, the social fund, disability living allowance, incapacity benefit, and jobseeker's allowance as well asthe increasing influence of European Law. Yet the system 'achieves too little' according to the new Government's Green Paper on welfare reform, which promises ' a new contract between the citizen and the Government, based on responsibilities and rights'. The precise form these responsibilities andrights will take remains unknown, although we already have schemes like the New Deal and proposals for stakeholder pensions. Meanwhile, social security law continues to impact upon the lives of millions of citizens.After ten years of major legislative change, and with the prospect of a new direction, this is a time to take stock and to analyse the social and legal impact of the past decade's legislation, case law, and policy, as well as considering possible reforms. The book's approach is to organise this taskthematically, particularly with regard to the social context to social security, through discrete chapters on, for example, gender and the family, disability, housing, old age, and unemployment.
