Book excerpt: The third edition of Covert Investigation continues to provide a practical, straightforward guide for anyone working in the area of covert investigation. This edition is updated to include significant amendments to the Regulation of Investigatory Powers Act 2000 brought about by the Police and Crime Act 2009, as well as revisions to the Codes of Practice. Also included are discussions reflecting the considerations of Parliamentary and Home Office reviews of surveillance practice and law: reviews undertaken in response to practitioner concerns about the RIPA authority regime and wider public concerns about an emerging surveillance society. The book contains all the relevant legislation, codes of practice and case-law relating to covert investigation methods and examines the issues that investigators need to consider when deploying such investigative tools, concentrating on the full implications of RIPA with regards to daily, routine policing activity. The authors consider each different aspect of covert investigation in turn, discussing statutory provision and introducing case law alongside investigation management issues. It successfully demystifies an area of investigation and enforcement that has hitherto been poorly understood. It is intended to assist those planning and supervising investigations and those with a statutory obligation to sanction applications for authorised covert investigation or withhold such authority. It will help officers improve the quality of RIPA applications and ensure that applications for cover investigation are made only in appropriate circumstances. In particular, the third edition looks at incontrovertible evidence, the strict statutory and procedural frameworks governing collection of such evidence, and how to minimize the risk of unwitting abuse of these powers and procedures which can lead to technical acquittals and procedural challenges at court. The book forms part of the Blackstone's Practical Policing Series. The series, aimed at junior to middle ranking officers, consists of practical guides containing clear and detailed explanations of the relevant legislation and practice, accompanied by case studies, illustrative diagrams and useful checklists.

Book Electronic Communication Interception Technologies and Issues of Power

Download or read book Electronic Communication Interception Technologies and Issues of Power written by Daniel Ventre and published by John Wiley & Sons. This book was released on 2023-10-17 with total page 260 pages. Available in PDF, EPUB and Kindle. Book excerpt: In cyberspace, data flows transit massively and freely on a planetary scale. The generalization of encryption, made necessary by the need to protect these exchanges, has resulted in states and their intelligence services forgoing listening and interception missions. The latter have had to find ways to break or circumvent this protection. This book analyzes the evolution of the means of communication and interception, as well as their implementation since the advent of the telegraph in the 19th century. It presents this sensitive subject from a technical, historical and political perspective, and answers several questions: who are the actors of interception? Who has produced the recent technologies? How are the markets for interception means organized? Are the means of protecting communications infallible? Or what forms of power do interceptions confer?

Book Policing Digital Crime

Download or read book Policing Digital Crime written by Robin Bryant and published by Routledge. This book was released on 2016-04-22 with total page 277 pages. Available in PDF, EPUB and Kindle. Book excerpt: By its very nature digital crime may present a number of specific detection and investigative challenges. The use of steganography to hide child abuse images for example, can pose the kind of technical and legislative problems inconceivable just two decades ago. The volatile nature of much digital evidence can also pose problems, particularly in terms of the actions of the 'first officer on the scene'. There are also concerns over the depth of understanding that 'generic' police investigators may have concerning the possible value (or even existence) of digitally based evidence. Furthermore, although it is perhaps a cliché to claim that digital crime (and cybercrime in particular) respects no national boundaries, it is certainly the case that a significant proportion of investigations are likely to involve multinational cooperation, with all the complexities that follow from this. This groundbreaking volume offers a theoretical perspective on the policing of digital crime in the western world. Using numerous case-study examples to illustrate the theoretical material introduced this volume examine the organisational context for policing digital crime as well as crime prevention and detection. This work is a must-read for all academics, police practitioners and investigators working in the field of digital crime.

Book The Law of Covert Investigation

Download or read book The Law of Covert Investigation written by Denis Clark and published by Routledge. This book was released on 2006-11 with total page 420 pages. Available in PDF, EPUB and Kindle. Book excerpt: Should telephone conversations covertly recorded be admissible evidence in court? Is an employer allowed to read their employees email in order to detect possible misconduct? Which government departments are authorised to use covert surveillance methods and informants?Covert investigation allows evidence to be gathered without the co-operation and awareness of those being investigated. Methods such as the interception of communications, including email, surveillance and the use of informants are commonplace but invariably throw up important issues concerning ethics, human rights, privacy and permissibility of evidence. The recent growth in legislation and codes of practice regulating this investigative technique have done little to quell the controversy surrounding its methodology. The government's 'war on terrorism' has introduced new and provocative arguments in favour of further legislation in the area. This timely work examines all aspects of the law as it relates to covert investigation and pays particular attention to surveillance law and the admissibility of evidence. It is an invaluable resource for police investigators, lawyers and researchers in the fields of criminal justice and police powers.

Book Counter Terrorism Strategies in a Fragmented International Legal Order

Download or read book Counter Terrorism Strategies in a Fragmented International Legal Order written by Larissa van den Herik and published by Cambridge University Press. This book was released on 2013-07-18 with total page 799 pages. Available in PDF, EPUB and Kindle. Book excerpt: Few events have influenced our global order as intensely as the events of September 11, 2001. At various levels in the past ten years, persistent attempts have been made to address the threat of terrorism, yet there is still urgent need for a joint and coherent application of a variety of regulations relating to international criminal justice co-operation, the use of force and international human rights law. In an important contribution to international discourse, Larissa van den Herik and Nico Schrijver examine the relationship between different branches of international law and their applicability to the problem of terrorism and counter-terrorism. Using a unique combination of academic perspectives, practitioners' insights and a comprehensive three-part approach, Counter-terrorism Strategies in a Fragmented International Legal Order offers sound policy recommendations alongside thorough analysis of the state of international law regarding terrorism and provides fresh insights against the backdrop of recent practice.

Book Major and Serious Crime Investigations

Download or read book Major and Serious Crime Investigations written by Richard Carr and published by Critical Publishing. This book was released on 2024-01-08 with total page 274 pages. Available in PDF, EPUB and Kindle. Book excerpt: This text explores the concept of major and serious crime investigations as it takes the reader through the fundamental elements of investigative theory and practice that are relevant to this area of criminality. Unlike other texts that concentrate on either bespoke areas of criminality such as homicide, terrorism or tends in concepts such as county lines, this book recognises that the reader will be new to investigative study with little practitioner experience to anchor their learning. By using the latest evidence-based policing knowledge and critical thinking, it explores the concepts of major and serious crime, detailing key areas of legislation and how investigative strategies and decision making can influence successful outcomes. Other topics examined in this text is the key areas of risk for major and serious crime investigations, the impact on investigators, the concept of disclosure, investigative interviewing and how civil orders, designed to tackle this type of criminality can provide a successful alternative to prosecution. Both students and practitioners can find this book useful with this book's contemporary approach of using case studies and contemporary investigative examples relevant to the topic. This book brings together academic theory and operational understanding of major and serious crime that provides learners with an easy to follow guide that they can keep returning to throughout their career.

Book Unauthorised tapping into or hacking of mobile communications

Download or read book Unauthorised tapping into or hacking of mobile communications written by Great Britain: Parliament: House of Commons: Home Affairs Committee and published by The Stationery Office. This book was released on 2011-10-28 with total page 228 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Commons Home Affairs Committee "deplores" News International's attempt to "deliberately thwart" the original investigation into phone hacking in 2005-06 but also states that the police set aside a huge amount of material that could have identified other perpetrators and victims. The committee agrees with John Yates's own assessment that his 2009 review of this investigation was "very poor", that he did not ask the right questions and that he was guilty of a "serious misjudgement". The committee criticises Andy Hayman's cavalier attitude towards his contacts with those in News International who were under investigation which, even if entirely above board, risked seriously undermining confidence in the impartiality of the police, and accuses him of deliberate prevarication in order to mislead the committee. It urges the swift and thorough investigation of allegations that payments were made to police officers by the media, which will help to establish whether or not such payments may have influenced police inquiries into phone hacking. The committee welcomes DAC Sue Akers's decision to contact all potential victims of phone hacking by the News of the World as part of the current investigation, but is alarmed that only 170 have as yet been informed. At this rate it would take years to inform all of the several thousands of people potentially affected. The committee therefore recommends that extra resources are allocated to her investigation, by the Government directly if necessary. The committee also expresses concern about both the scope and understanding of current laws on phone hacking, with prosecutors and police still arguing over the meaning of relevant sections of the Regulation of Investigatory Powers Act 2000. However, this was no reason for the Metropolitan Police to limit their investigation of these matters. Finally, potential victims of phone hacking should be given a means of seeking formal advice from the Information Commissioner and easier access to redress. The Information Commissioner should be given additional powers to deal with breaches of data protection, including phone hacking and blagging. Mobile phone companies should give greater prominence to security advice in the information provided to their customers. The report sets out 24 conclusions and recommendations.

Book Marked Men

    Book Details:
  • Author : Nyron N. Crawford
  • Publisher : NYU Press
  • Release : 2024-05-21
  • ISBN : 1479816345
  • Pages : 127 pages

Download or read book Marked Men written by Nyron N. Crawford and published by NYU Press. This book was released on 2024-05-21 with total page 127 pages. Available in PDF, EPUB and Kindle. Book excerpt: Examines Black Americans’ suspicion about the potential political harassment of Black elected officials In Marked Men, Nyron N. Crawford offers a novel perspective on political scandal, corruption, and racial politics in the United States. Contrary to traditional beliefs that politicians are forgiven for their transgressions because of the benefits they provide their constituents, Crawford argues that Black Americans view political misdeeds by Black elected officials through a lens of suspicion towards the criminal legal system. Crawford’s work reveals that Black Americans often question the motivations behind investigations and indictments of Black politicians, expressing concern that such actions by the state are intended to undermine, embarrass, and harass Black leaders. Through a mixed-method approach including experiments, case studies, and survey data, Crawford illustrates that racialized suspicion shapes the way Black voters rally to protect their embattled Black political representatives. The book challenges conventional wisdom by highlighting how a tolerance of corruption is not the driving force behind the support for wayward politicians. Instead, racialized mistrust of the criminal justice system plays a pivotal role. By shedding light on this dynamic, Marked Men examines the complexities of political scandals and the intricate interplay between race and politics in contemporary America. The study calls for a deeper understanding of the motivations and attitudes of Black voters, prompting readers to reconsider prevailing assumptions about political accountability and forgiveness in the context of race.
