Book excerpt: This work explores the operation and regulation of copyright collective management in Nigeria. The nexus between creativity and copyright and how creativity has played a pivotal role in development is explained. The need to balance the interests of authors and users is discussed and the societies representing the interest of copyright owners are illustrated. Further, Nigeria’s legal framework for collective management is enunciated from a pre-independence and post-independence perspective. In the course of this regulatory challenges encountered in the administration of collective management organizations, steps so far taken to address the problems, legislative reforms and judicial decisions are discussed. A path to the new regime is chartered. The South African Copyright collective management system is explored and a comparison between the Nigerian and South African system is made. Thereby the need for supervisory and regulatory agencies of government is shown to seek the national interest regarding the collective administration of copyright and related rights. Then, suggestions for improvement and lessons for Africa are provided.

Book excerpt: The introduction of a regulatory framework in the area of collective management of rights in Nigeria must have been intended to strengthen the creative industry. Unfortunately, it has thrown this industry and in particular the music and film industries into a battle of a regulated against a non-regulated collective administration sector for upward of twenty (20) years. My choice of research on this topic could be attributed to the interest I developed while administering the collective administration desk at the Nigerian Copyright Commission. Serving on that desk afforded the opportunity to see frustration of right owners who were being deprived the fruit of their labor, as the societies meant to collect and distribute royalties on their behalf were enmeshed in litigations and rarely paid any royalties to authors. This research therefore seeks to explore whether there is any merit in the continued existence of the current regulatory framework for collective management in Nigeria, and what the best operational framework for collective administration in Nigeria would be.A methodological approach entailing literature review of books, articles, journals, legislation, cases, reports of committees and possibly interviews with experts was adopted, with critical analysis carried out on particularly the Nigerian Copyright Act, the Nigerian Copyright (collective management organization) regulation, the South African Copyright Act, the South African Performers' Protection Act, the South African Collecting Societies Regulation, as well as judicial decisions challenging certain provisions in the said legislationIt is hoped that this research will spur a desire for the need for supervisory and regulatory agencies of government to seek the national interest above all others in taking and making decisions that affects the collective administration of copyright and related rights.

At that time, there was no specialised agency responsible for administration of copyright, and neither was any provision made in respect of supervising and/or regulating collective administration in Nigeria. The Act merely provided for a “competent authority,” whose role was a tangential one, dealing only with dissatisfactions regarding the grant of licenses with particular reference to collective administration. This provision was actually never activated which implied that there was little or no disputes that involved government's intervention, if there were any at all. Although copyright issues had started emerging, requiring both regulatory and industry attention, the challenge at the time pertained to the structure responsible for administering copyright collective administration in Nigeria. The impression of most stakeholders was that the private agency (run by the law firm of Giwa & Atilade) existed to serve imperialistic interests and hence local users were hesitant to pay the agency for use of works in which copyright subsists. With the benefit of hindsight, these “challenges” only prefaced subsequent developments after the enactment of legislative provisions establishing a regulatory framework for the collective administration of copyright in Nigeria.

Book excerpt: In the course of the last two decades, collective management organizations (CMOs) have become the nerve centres of copyright licensing in virtually every country. Their expertise and knowledge of copyright law and management have proven essential to make copyright work in the digital age. However, they have also been at the centre of debates about their efficiency, their transparency and their governance. This book, an extensively revised and updated edition of the major work on the legal status of CMOs, offers an in-depth analysis of the various operating CMO models, their rights and obligations vis-à-vis both users and members, acquisition of legal authority to license, and (most important) the rights to license digital uses of protected material and build (or improve current) information systems to deal with ever more complex rights management and licensing tasks. All the chapters have been updated since the 2010 edition. New chapters on Africa, China, Central Europe and New Zealand (together with Australia, which is no longer discussed in the separate chapter on Canada) have been added. Factors considered include the following: • role of 'families' such as the International Confederation of Societies of Authors and Composers (CISAC) and the International Federation of Reproduction Rights Organizations (IFRRO); • cases where the unavailability of adequating options makes authorized use difficult or impossible taking transaction costs into account; • growing importance of extended repertoire systems (also known as extended collective licensing); • relationship among collective management, rights to remuneration, and the ways in which CMOs acquire authority to license; • transnational licensing and the possible role of multi-territorial licensing; and • threat of monopolies or regional oligopolies for the management of online music rights. Legal underpinnings covered in the course of the analysis include the 1996 WIPO Copyright Treaties, the US Digital Millennium Copyright Act, the Napster case, the Santiago Agreement, relevant EU Papers and the 2014 Copyright Directive, and work done by the UN Committee on Economic, Social and Cultural Rights. Part I presents a number of horizontal issues that affect collective management in almost every country. Part II is divided on a geographical basis, focusing on systems representative of the principal models applied in various countries and regions. Each country specific or region-specific chapter provides a historical overview and a presentation of existing CMOs and their activities, gives financial information where available, describes how CMOs are supervised or controlled by legislation, and offers thoughts about the challenges facing CMOs in the country or region concerned. Many of these national and regional commentaries are the only such information sources available in English. Whatever the future of copyright holds, it is clear that users will continue to want access and the ability to reuse material lawfully, and authors and other rights holders will want to ensure that they can put some reasonable limits on those uses, including an ability to monetize commercially relevant uses. CMOs are sure to be critical intermediaries in this process. The second edition of this important resource, with its key insights into the changing nature of collective management, will be of immeasurable value to all concerned with shaping policy towards collective management or working with the ever more complex legal issues arising in digital age copyright matters.

The deregistration of the Music Copyright Society of Kenya (MCSK) in Kenya, the collapse of the South African Recording Rights Association Limited in South Africa and the ongoing battles involving the Music Copyright Society of Nigeria (MCSN) and the Nigerian Copyright Commission (NCC) in Nigeria are just a few recent examples that highlight the need to rethink the legal framework for regulation of collective management organisations (CMOs) in Africa.In this regard, this article begins with an examination of the legislative frameworks for regulation of CMOs in Kenya, South Africa and Nigeria by considering whether CMOs, once accredited, are adequately supervised by the State to ensure that the former operate effectively for the benefit of both rights holders and users. After examining the state of the respective country laws, this article reviews the current copyright reform initiatives in each of the countries and whether the tabled legislative proposals would be able to address the persisting regulatory challenges in the collective administration of copyright and related rights. This article concludes with several recommendations on reviewing the respective legislative frameworks for regulation of CMOs, the most important being the urgent need for empirical research on the impact of various legislative provisions on the collective management systems of Kenya, South Africa and Nigeria.

Book excerpt: “Afrobeats to the world” is a popular expression and hash tag used among African music lovers to describe the global acceptance of African music. In addition to possessing Africa's largest economy, Nigeria dominates the African music industry. In 2014, its music industry contributed 1.2% to Nigeria's overall GDP. Despite their international exposure, Nigerian artist receive less than 5% of their royalties internationally. As a result, Nigeria's top Afro-pop artists like Tiwa Savage, Davido, and Wizkid, have signed publishing and distribution deals with experienced US recording companies like Sony Music, RCA Records, and Rocnation. Part one of this paper will provide an overview of the role of collective management organization “CMOs” in the collection and distribution of royalties. Part two will discuss the role and methodology of the Copyright Society of Nigeria in collecting and distributing artists' royalties domestically and internationally. Recognizing the growth of Nigerian music being played in the United States and United Kingdom, part three will provide a comparative analysis of collective management societies: BMI, ASCAP, and PPL. Part four will present recommendations for collective management reform in Nigeria: improving the WIPOCOS software used to track royalties and current business strategy, and amending Nigeria's Copyright laws for Collective Management Organizations by incorporating language from the EU's 2016 Collective Rights Management Directive. If these recommendations are adopted, artist will be able to collect more royalties internationally.
